Article 1 In order to strengthen the energy conservation management of civil buildings in our province, reduce the energy consumption of civil buildings, and improve energy utilization efficiency, in accordance with the "Energy Conservation Law of the People's Republic of China" and the "Regulations on Energy Conservation of Civil Buildings" , "Measures of Zhejiang Province for the Implementation of the Energy Conservation Law of the People's Republic of China and the State", "Measures for the Management of Energy Conservation Assessment and Review of Fixed Asset Investment Projects of Zhejiang Province" and "Several Opinions of the People's Government of Zhejiang Province on Actively Promoting the Development of Green Buildings" and other relevant regulations to formulate these measures. Article 2 These Measures shall apply to the energy conservation assessment and review of newly built, renovated and expanded civil building projects within the administrative region of this province. Article 3 The term “civil construction project energy conservation assessment” as mentioned in these Measures refers to the analysis and evaluation of the scientificity and rationality of civil construction project design plans in accordance with the laws, regulations, rules, policies and energy conservation standards related to civil construction energy conservation, and proposes improvements Energy utilization efficiency, countermeasures and measures to reduce energy consumption, and the act of preparing an energy-saving assessment report, energy-saving assessment report form (collectively referred to in these Measures as energy-saving assessment documents) or filling out an energy-saving registration form. The term "energy-saving review of civil construction projects" as mentioned in these Measures refers to the behavior in which the construction authorities review the design plans and energy-saving assessment documents or energy-saving registration forms of civil construction projects in accordance with the law, formulate review opinions, and supervise the implementation. Article 4 The construction administrative departments of the people's governments at or above the county level are responsible for the supervision and management of energy conservation assessment and energy conservation review of civil construction projects. Article 5 The energy-saving assessment of civil building projects shall be managed in a classified manner based on the building scale converted from the project’s total annual comprehensive energy consumption (theoretical calculation value) (the annual comprehensive energy consumption of one thousand tons of standard coal is converted into the benchmark building scale): (1) Civil construction projects with a total building area that is more than three times the benchmark building scale must prepare an energy-saving assessment report; (2) Civil construction projects with a total building area that is more than three times the benchmark building scale but less than three times the benchmark building scale must prepare an energy-saving assessment report; (3) ) Civil construction projects with a total construction area below the benchmark building scale must fill in an energy conservation registration form. Article 6 The construction unit shall entrust a civil building energy conservation assessment agency registered with the provincial construction authority to conduct energy conservation assessment. The assessment agency shall prepare energy conservation assessment documents within its business scope. The construction unit can fill in the energy saving registration form by itself. The evaluation agency shall not have any affiliation or other interest relationship with the construction unit, design unit, or construction drawing design document review agency of the project being evaluated. For energy-saving assessment agencies that have not been registered or that undertake business beyond the scope of registered business, the energy-saving assessment documents prepared by them cannot be used as the basis for energy-saving review. Article 7 The construction authorities shall not designate energy-saving assessment agencies for civil construction projects in any way, and shall not charge energy-saving review fees from construction units. Article 8 Energy conservation assessment documents for civil construction projects shall include the following contents: (1) Project overview and assessment basis; (2) Energy supply conditions of the project location and the impact of the project on the local energy supply situation; (3) Thermal insulation insulation of the building envelope Thermal shading system design plan and material evaluation; (4) Building water-saving design plan evaluation; (5) Building renewable energy and other new energy utilization plan evaluation; (6) Building energy equipment system design plan evaluation; (7) Building electrical System (including sub-measurement) design plan evaluation; (8) Building wind environment design plan evaluation; (9) Analysis of the number of building energy consumption types, energy consumption structure, energy utilization efficiency and energy management; (10) Analysis of building energy saving effects and suggestions for energy-saving measures; (11) Assessment conclusions. Article 9 The energy-saving assessment document should have a dedicated page signed by the compilers of each major (major majors such as architecture and HVAC should be signed by registered architects or registered engineers in the corresponding countries), and should be stamped with the agency's special seal for civil building energy-saving assessment results. . Article 10 The construction unit and the organization and compiler of the energy conservation assessment documents are jointly responsible for the authenticity and validity of the energy conservation assessment documents. The construction unit is responsible for the authenticity and validity of the energy-saving registration form filled out by itself. Article 11 The energy conservation review of civil construction projects shall be conducted with hierarchical responsibilities. Civil construction projects with a total construction area more than five times the benchmark building scale shall be subject to energy conservation review by the provincial construction department; civil construction projects with a total construction area less than five times the benchmark construction scale shall be reviewed by the city, county (city, District) construction authorities are responsible for energy conservation review within their respective responsibilities according to their authority. Article 12 When submitting the construction project design plan to the urban and rural planning authority where the civil construction project is located, the construction unit shall attach the energy conservation review application materials.

The urban and rural planning department shall submit the energy conservation review application materials to the construction department for comments. Among them, for civil construction projects that are legally responsible for energy-saving review by the provincial construction department, the energy-saving review application materials will be forwarded to the provincial construction department by the local construction department. For civil construction projects that really need to be implemented in phases, the construction unit may apply for energy conservation review in phases, but the classification assessment and graded review will still be conducted based on the total construction area stipulated in these Measures. Article 13 The application materials for energy conservation review of civil construction projects include the following: (1) Energy conservation review application; (2) Energy conservation assessment documents or energy conservation registration forms; (3) Construction project design plans; (4) Legal person certification of the construction unit; ( 5) Other materials that need to be provided. Article 14 For civil construction projects and other important civil construction projects that require the preparation of energy conservation assessment documents in accordance with the provisions of these Measures, the construction competent department shall organize experts to review the energy conservation review application materials. The expert group is composed of more than five experts in architecture, structure, equipment, electrical and other related professions who have senior professional titles or above or have the qualifications of a national registered architect or a national registered survey and design engineer in the corresponding profession. The expert group focused on qualitative and quantitative analysis of the civil building design plan’s thermal insulation and shading systems, renewable energy building applications, air conditioning systems, water supply and drainage systems, power distribution systems, and building layout, shape, orientation and ventilation. Review, evaluate the implementation of energy-saving design standards and energy-saving policies, and form expert review opinions. Article 15 The construction competent department shall, within 10 working days from the date of receipt of complete project energy-saving review application materials, based on national and provincial energy-saving policies, civil building energy-saving design standards and other relevant mandatory standards and expert review opinions. Propose energy-saving review opinions and issue civil building energy-saving review opinions to civil building projects that pass the energy-saving review. For civil construction projects that require national approval or approval, the construction authority shall submit an energy conservation review in conjunction with the development and reform department in accordance with the provisions of Article 18, Paragraph 3, of the "Zhejiang Provincial Measures for the Implementation of the Energy Conservation Law of the People's Republic of China and the People's Republic of China" Opinion. Article 16 For civil construction projects that fall under any of the following circumstances, the construction authority shall not pass the energy-saving review and inform the construction unit of the reasons for not passing the review: (1) Failure to comply with relevant mandatory standards such as civil building energy-saving design standards ; (2) Failure to carry out renewable energy building applications in accordance with national and provincial standards; (3) Using building materials, energy-using products, equipment, and processes that have been phased out by the state and province; (4) Failure to comply with other national and provincial regulations Energy saving regulations. For projects that fail to pass the review, the construction unit shall organize the modification of the engineering design plan and energy-saving assessment documents (or energy-saving registration form) and then re-apply for energy-saving review. Article 17 After the energy conservation review of a civil construction project is passed, if there are major changes in the construction location, construction scale, design plan, etc., the construction unit shall resubmit the energy conservation assessment document or fill out the energy conservation registration form, and re-apply for the energy conservation review. Article 18 Except for the circumstances specified in paragraph 2 of Article 12 of these Measures, if the construction unit obtains the civil building energy conservation review opinion by splitting the project, providing false materials, or other improper means, the person who issued the energy conservation review opinion shall The construction authority revoked it. Article 19 According to the provisions of Articles 14 and 18 of the "Zhejiang Province Measures for the Implementation of the Energy Conservation Law of the People's Republic of China" and Article 36 of the "Zhejiang Province Urban and Rural Planning Regulations", no For civil construction projects that fail to pass the energy conservation review or have not passed the energy conservation review, the urban and rural planning authorities will not issue a construction project planning license, the construction drawing design document review agency will not issue a construction drawing design document review certificate, and the construction authorities will not issue a construction project construction permit. license. Article 20 According to the provisions of Article 20, Paragraph 1 of the "Zhejiang Province Measures for the Implementation of the "Energy Conservation Law of the People's Republic of China and the State", after a civil building above the benchmark building scale is completed, the construction unit shall organize completion acceptance before Entrust a building energy efficiency evaluation agency with corresponding qualifications to evaluate the energy efficiency of the building; if the building energy efficiency evaluation result is unqualified, it shall not pass the completion acceptance. Article 21 The construction competent department shall strengthen supervision and inspection of the implementation of energy conservation review opinions during the design and construction of civil construction projects. Article 22 If a civil construction project fails to undergo energy conservation review in accordance with the law or starts construction without approval without passing the energy conservation review, the construction competent department at or above the county level shall comply with the "Zhejiang Provincial Measures for the Implementation of the Energy Conservation Law of the People's Republic of China and the State". Penalty shall be imposed in accordance with Article 50.

Article 23 If an energy-saving assessment agency is irresponsible or commits fraud in the assessment of civil building energy-saving, resulting in serious inaccuracies in the energy-saving assessment documents, the competent construction authorities at or above the county level shall, in accordance with the "Zhejiang Province Implementation of the People's Republic of China and the National Energy Conservation Penalties shall be imposed in accordance with Article 51 of the Energy Law Measures. Article 24 If any staff member of the construction competent department abuses his or her power, neglects his duties, or engages in malpractice for personal gain during the energy conservation review of civil construction projects, he or she shall be punished in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law. Article 25 The meanings of the following terms in these Measures: (1) Civil buildings refer to residential buildings and public buildings. (2) Public buildings refer to buildings for people to carry out social activities, including buildings used for offices, commerce, tourism, education, scientific research, culture, health, sports, postal communications, transportation (airports, ports, stations) ), exhibitions and other activities. (3) Total construction area. Civil construction projects on state-owned construction land refer to the total construction area (including underground construction area) within the scope of one-time transfer or allocation of state-owned construction land; civil construction projects on collective construction land refer to the construction land planning The total construction area (including underground construction area) within the scope of the construction land approved by the permit. (4) Baseline building scale, office buildings, civil affairs buildings, judicial buildings and religious buildings refer to a building area of ??20,000 square meters; commercial buildings, entertainment buildings, sports buildings, cultural buildings, transportation buildings and other buildings refer to a building area of ??10,000 square meters m; buildings such as hotels (restaurants), financial buildings, medical and health buildings, educational buildings, scientific experimental buildings, radio stations, television stations, post offices and telecommunications bureaus refer to the building area of ??15,000 square meters; residential buildings refer to the building area Fifty thousand square meters. For commercial and residential buildings or building complexes and other civil construction projects that have functions of different types of public buildings and residential buildings at the same time, the benchmark building scale shall be converted into corresponding public buildings or residential buildings according to the proportional relationship stipulated in these Measures. , as long as it reaches one of the boundary scales, it will be classified and managed hierarchically according to that scale. Article 26 "Above" as stipulated in these Measures includes the original number, and "below" does not include the original number. Article 27 The construction administrative departments of the people's governments of all districts and cities may formulate implementation details in accordance with these Measures. Article 28 These Measures shall come into effect on October 6, 2011.
