Article 39: "If a medical institution is opened without authorization for the practice of medicine or if a non-physician is practicing medicine, the administrative department of health of the people's government at or above the county level shall outlaw the practice of medicine, confiscate the illegal proceeds and its medicines and equipment, and impose a fine of not more than 100,000 yuan; the physician shall have his or her certificate of practice revoked; the patient who has suffered damage may be ordered to stop the practice of medicine.
