Notice of the Ministry of Posts and Telecommunications on Issuing the Provisions on the Administration of Examination and Approval of Telecom Terminal Equipment Entering the Network

Chapter I General Provisions Article 1 These Provisions are formulated in order to strengthen the management of telecommunication terminal equipment connected to the national communication network, ensure the integrity, unity and advancement of the national communication network, and safeguard national interests and users' rights and interests. Article 2 The term "telecommunication terminal equipment" as mentioned in these Provisions refers to telecommunication equipment connected to the national communication network and installed in the user's place for direct use, such as telephones, group telephones, private branch exchanges, mobile phones, wireless pagers, fax machines, modems, data terminals and other equipment. Article 3 The Ministry of Posts and Telecommunications is the competent department for the examination and approval of telecommunication terminal equipment entering the network, and the telecommunication management department of the Ministry of Posts and Telecommunications is specifically responsible for the examination and approval of telecommunication terminal equipment entering the network. The post and telecommunications administrations of all provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as the post and telecommunications administrations) shall be responsible for the management of telecommunication terminal equipment entering the network within their respective jurisdictions. Article 4 The Ministry of Posts and Telecommunications shall implement a nationwide unified network access permit system for telecommunication terminal equipment accessing the national communication network. Article 5 All telecommunication terminal equipment connected to the national communication network must conform to the technical system, standards and communication industry standards stipulated by the state and the relevant business regulations of the Ministry of Posts and Telecommunications, and have the network access license issued by the Ministry of Posts and Telecommunications; Telecom terminal equipment that has not obtained network access license shall not be connected to the national communication network for use. Chapter II Examination and Approval Procedures for Network Access Article 6 Procedures for domestic production enterprises (hereinafter referred to as production enterprises) to handle the network access license model of telecommunication terminal equipment:

(1) The manufacturer shall provide the following documents to the telecommunications management department of the Ministry of Posts and Telecommunications:

1, written application report, pictures of network access equipment and related technical data, etc.

2. Business license of enterprise legal person (copy).

3, the opinions of the competent department. If there is no competent department, it shall provide corresponding valid certification documents.

4. Chinese-foreign equity joint ventures and wholly foreign-owned enterprises shall provide the approval of the proportion of domestic and foreign exports approved by the competent government departments, as well as the contract and articles of association for the establishment of the enterprise.

5, enterprise profile (including personnel, equipment, production conditions, affiliation, etc.). ).

6. Quality assurance system and after-sales service measures.

7, mobile phones, cordless phones should also provide the approval documents of the local radio management committee.

8. Preliminary report of the Bureau of Posts and Telecommunications.

(2) The telecommunication management department of the Ministry of Posts and Telecommunications shall review the above materials and give a reply within 10 days.

(three) according to the manufacturer's approval for network access procedures, testing the prototype. After passing the test, you can apply to the post and telecommunications administration to arrange a trial. During the prototype test, the manufacturer shall arrange routine tests on the prototype and prepare for the production model identification. After the probation period expires, the user's trial report shall be submitted to the post and telecommunications administration.

(4) After the telecom terminal equipment produced by the production enterprise has passed the production finalization appraisal organized by the Ministry or the provincial competent department, it shall submit the appraisal certificate and the main documents of the appraisal meeting to the telecom management department of the Ministry of Posts and Telecommunications, and submit the application report for network access detection.

The manufacturer may also submit an application report for network access test to the Telecommunications Management Department of the Ministry of Posts and Telecommunications before the product is finalized.

(5) After receiving the report, the telecommunication management department of the Ministry of Posts and Telecommunications shall notify the post office in writing to conduct sampling, and entrust the network access testing unit to conduct network access testing. When necessary, an on-site inspection of the manufacturer's production requirements and quality assurance system can be arranged, and the inspection shall be completed within 30 days, and the inspection results shall be reported in writing to the telecommunications management department of the Ministry of Posts and Telecommunications. The notice of network access detection is valid for 30 days.

(6) The testing unit shall complete the normal temperature testing within 15 days after receiving the sampling equipment. For all projects that pass the test, the testing unit will submit the test report to the Telecommunications Management Department of the Ministry of Posts and Telecommunications.

If some projects fail to pass the inspection, the inspection unit will send a notice of unqualified inspection to the production enterprise and submit it to the Telecommunications Management Department of the Ministry of Posts and Telecommunications. After the manufacturers rectify the existing problems, they apply to the Telecommunication Management Department of the Ministry of Posts and Telecommunications, and the Telecommunication Management Department of the Ministry of Posts and Telecommunications will reissue the notice of network access detection.

(7) The telecommunication management department of the Ministry of Posts and Telecommunications shall, after comprehensively reviewing the test report submitted by the testing unit and the relevant documents and materials of the production enterprise, issue the network access license of the telecommunication terminal equipment of the Ministry of Posts and Telecommunications to the production enterprise within 15 days. Article 7 The procedures for the distribution unit to handle the batch network access license of telecommunication terminal equipment are as follows:

(a) the distribution unit shall provide the following documents to the telecommunications management department of the Ministry of Posts and Telecommunications:

1, application report. The report shall clearly state the source, model, quantity and import channel of the equipment.

2. Business license (copy).

3. If the approval documents, customs declarations and tax payment orders approved by the relevant state departments are entrusted to other units for import, an agreement or contract between the two parties shall be attached.

4. Equipment applying for network access (except mobile phones and wireless pagers) shall regularly print serial numbers (in triplicate).

5. Technical data of equipment applying for network access (including Chinese user manual, maintenance manual, circuit diagram, etc.). ).

6. After-sales service measures and proof of ensuring the supply of maintenance spare parts.

7. Fax machines, modems and group telephones should be accompanied by the manufacturer's warranty card. The warranty card shall indicate the address and warranty measures of the maintenance center or designated maintenance station established in China.

8. The distribution unit shall provide the environmental adaptability and service life test report made by the testing unit designated by the Ministry of Posts and Telecommunications on the models applying for network access.

(two) after the audit of the Telecommunications Management Department of the Ministry of Posts and Telecommunications meets the requirements, it entrusts the post office to conduct sampling according to the prescribed proportion, and informs the testing unit to arrange network testing.

(three) after receiving the sampling equipment, the testing unit shall complete the network access test within 15 days and report it to the telecommunications management department.

If it fails to pass the test, the distribution unit will re-apply to the telecommunications management department of the Ministry of Posts and Telecommunications for re-testing after rectifying all the equipment.

(4) After passing the network access test, the telecommunication management department of the Ministry of Posts and Telecommunications will issue the network access license of the telecommunication terminal equipment of the Ministry of Posts and Telecommunications within 15 days.
