General Aviation Business License Management Regulations (2018 revision)

Chapter 1 General Provisions Article 1 In order to standardize the management of the general aviation industry and promote the safe, orderly and healthy development of general aviation, in accordance with the "Civil Aviation Law of the People's Republic of China" and "Civil Aviation Law of the People's Republic of China" ***Administrative Licensing Law of the People's Republic of China and relevant national laws and administrative regulations, these regulations are formulated. Article 2 These regulations apply to the business licenses and corresponding supervision and management of general aviation enterprises engaged in commercial general aviation activities within the territory of the People's Republic of China and the People's Republic of China (excluding Hong Kong, Macao and Taiwan). Article 3 To engage in general aviation business activities, a general aviation business license must be obtained.

Enterprises that have obtained a general aviation operating license shall abide by the provisions of national laws, administrative regulations and rules, and carry out business activities within the approved business scope in accordance with the law. Article 4 The Civil Aviation Administration of China (hereinafter referred to as the Civil Aviation Administration) implements unified management of general aviation business licenses and corresponding supervision and management. The Regional Civil Aviation Administration of China (hereinafter referred to as the Regional Civil Aviation Administration) is responsible for the implementation of general aviation business license management within its jurisdiction. Article 5 The implementation of general aviation business license management shall follow the following basic principles:

(1) Promote the development of general aviation, safeguard the interests of the public and protect the legitimate rights and interests of consumers;

(2) Comply with general aviation development policies;

(3) Meet the requirements of scientific planning, market guidance, and coordinated development;

(4) Ensure flight and operational safety. Article 6 Enterprises that carry out the following business projects shall obtain a general aviation business license:

(1) Category A general aviation charter flights, petroleum services, helicopter piloting, medical rescue, and commercial pilot license training;

(2) Category B air tours, helicopter external load flights, artificial precipitation, aerial prospecting, aerial photography, ocean monitoring, fishery flights, urban firefighting, aerial inspections, power operations, aircraft hosting, and parachuting flight services ;

(3) Class C private pilot license training, aviation forest protection, aviation spraying (spraying), aerial photography, aerial advertising, scientific experiments, meteorological detection;

(4 ) Category D uses manned free balloons and airships with standard airworthiness certificates to carry out aerial tours; uses aircraft with special airworthiness certificates to carry out air show flights, personal entertainment flights, sports pilot license training, aviation spraying (spraying), electric power Operations and other business projects.

Other business projects that require permission shall be determined by the Civil Aviation Administration of China.

Emergency and disaster relief are not restricted by the division of the above items and shall be implemented in accordance with the relevant regulations of the Civil Aviation Administration. Article 7 The Civil Aviation Administration and regional civil aviation administrations shall supervise and manage enterprises engaged in commercial general aviation support business. Chapter 2 Business License Conditions and Procedures Article 8 To obtain a general aviation business license, the following basic conditions must be met:

(1) The entity engaged in general aviation business activities shall be an enterprise legal person, and the main business shall be general aviation Aviation business projects; the legal representative of the enterprise is a Chinese citizen;

(2) The name of the enterprise should reflect the general aviation industry and operating characteristics;

(3) Purchase or lease no less than Two civil aircraft. The aircraft must be registered in the People's Republic of China and meet airworthiness standards; (4) It must be suitable for civil aircraft, undergo professional training, and obtain corresponding licenses or training certificates. aviation personnel;

(5) Establish management, operation and safety management organizations and equip them with professionals suitable for business projects;

(6) Senior managers of enterprises should complete general Aviation regulations and standards training, the person in charge of flight and operation quality should also have more than three years of cumulative work experience in relevant professional fields in the last six years;

(7) Comply with relevant laws, regulations and standards, Operational facilities and equipment that have passed the inspection;

(8) Have sufficient liability-bearing capacity, and purchase ground third-party liability insurance and other insurance in accordance with regulations;

(9) Civil Aviation Other conditions deemed necessary by the Bureau.

Article 9 If any of the following circumstances occurs, the regional civil aviation administration will not accept the application for a general aviation operating license:

(1) Failure to comply with Article 5 of these regulations;

( 2) If the applicant conceals relevant information or provides false materials, the application is not accepted or permission is not granted, and the applicant reapplies within one year; After receiving the aviation operating license, the applicant applies again within three years;

(4) After receiving the decision not to grant the license, the applicant reapplies for the operating license based on the same facts and materials;

(5) Other circumstances that are not acceptable as stipulated by laws and regulations. Article 10 The applicant shall submit an application for a general aviation operating license to the regional civil aviation administration bureau of the place where the enterprise is domiciled, submit the following application materials in the prescribed format and ensure that they are true, complete and valid:

(1) General aviation Application for aviation operating license;

(2) Articles of Association;

(3) Documents and qualifications of the legal representative, the person in charge of operations, and the person in charge of flight and operational technical quality Form, identity certificate, non-criminal record statement; documents proving the appointment, election or employment of the company’s directors, supervisors and managers;

(4) Aircraft purchase and lease contract, documents proving the ownership and possession of the aircraft;

(5) Civil aircraft nationality registration certificate, airworthiness certificate and license for an airborne radio station equipped in accordance with the requirements of civil aviation regulations;

(6) Aviation personnel license and the applicant’s A valid labor contract signed;

(7) Proof of the ability to bear sufficient liability for compensation, including insurance documents for ground third-party liability insurance, etc.;

(8) Enterprises and The mailing address and contact information of the legal representative (person in charge), and proof of ownership or right to use the company's office space;

(9) If there is foreign investment, the applicant shall comply with relevant national and civil aviation foreign investment regulations Submit foreign investment project approval or filing documents and foreign-invested enterprise approval certificates;

(10) Documents stating that all application materials are true and valid.
