The term "water conservancy projects" as mentioned in these Regulations refers to all kinds of projects and supporting facilities for the development, utilization, control, deployment and protection of rivers, lakes and underground water sources such as dikes, reservoirs, dams, sluices, pumping stations, channels and hydropower stations.
The construction, management and protection of shipping, urban water supply, urban drainage, sewage treatment and tailings dam projects shall be implemented in accordance with the provisions of relevant laws and regulations. Article 3 The people's governments at or above the county level shall strengthen their leadership over the construction, management and protection of water conservancy projects, incorporate the construction of water conservancy projects into the national economic and social development plan of their respective administrative regions, increase investment in the construction, management and protection of water conservancy projects, and ensure the safe and normal operation of water conservancy projects. Fourth water administrative departments of the people's governments at or above the county level shall be responsible for the management and supervision of water conservancy projects within their respective administrative areas in accordance with the authority of hierarchical management.
The relevant administrative departments of the people's governments at or above the county level, such as development and reform, industrial information industry, finance, price, transportation, housing and urban and rural construction, land and resources, health and environmental protection, shall be responsible for the management of water conservancy projects according to their respective functions and duties.
Township people's governments shall, in accordance with the provisions of these regulations, be responsible for the management of small rural water conservancy projects directly managed by the water administrative departments of the people's governments at or above the county level within their respective administrative areas. People's governments at or above the county level shall take measures to increase investment in small-scale water conservancy projects in rural areas to ensure the safety and normal operation of small-scale water conservancy projects in rural areas.
Water conservancy project management unit or water conservancy project manager is responsible for the daily operation, maintenance and safety management of water conservancy projects. Article 5 Collective economic organizations, individuals and other organizations are encouraged to invest in the construction of water conservancy projects according to law, and their legitimate rights and interests are protected by law.
Support and encourage agricultural water users to set up rural water cooperation organizations according to law, and implement daily management of small rural water conservancy projects and final canal system projects in irrigation areas. Article 6 All units and individuals have the obligation to protect water conservancy projects according to law, and have the right to stop, report and accuse the acts of embezzlement and damage to water conservancy projects. Chapter II Construction of Water Conservancy Projects Article 7 The construction of water conservancy projects (including new construction, renovation and expansion, the same below) shall meet the requirements of comprehensive river basin planning, flood control planning and other related planning and water function zoning, and go through the examination and approval procedures for environmental protection, land use, water resources utilization, soil and water conservation and project construction according to law. Irrigation-oriented water conservancy projects should improve the supporting construction of canal system.
Water conservancy project construction units shall formulate water conservancy project management plans while formulating new water conservancy project construction plans. The relevant administrative departments shall not approve or approve a water conservancy construction project without a governance plan. Eighth water conservancy construction projects shall implement the project legal person responsibility system, bidding system, project supervision system and project quality lifelong responsibility system according to law.
The legal person of water conservancy construction project is responsible for the project quality, project progress, fund management and safety production.
The survey, design, construction and supervision of water conservancy construction projects and the procurement of important equipment and materials related to the project construction shall be subject to tender according to law. Units engaged in the survey, design, construction and supervision of water conservancy construction projects shall have corresponding qualification grades.
Water conservancy construction project supervision units shall, in accordance with the provisions of the supervision contract, send qualified supervision personnel to the construction site of water conservancy projects, and carry out supervision in accordance with the supervision norms.
The administrative person in charge of the water conservancy construction project, the legal representative of the project and the legal representatives of the survey, design, construction and supervision units shall be responsible for the project quality for life according to their respective responsibilities. Article 9 The water administrative department of the people's government at or above the county level and other relevant departments shall, according to their respective functions and duties, supervise and inspect the quality of water conservancy projects, the construction progress and the use of government investment funds, put forward rectification opinions in time when problems are found, and urge the construction unit to rectify in place. Tenth water conservancy construction projects shall be accepted in accordance with the provisions of the state and the province on the acceptance of water conservancy projects. Without acceptance or unqualified acceptance, it shall not be delivered for use. Eleventh construction units will hand over the project to the water conservancy project management unit, it should also hand over the project land use right certificate, water conservancy project construction project files and other information. Twelfth reservoir dams and sluices after the completion of acceptance, water conservancy project management units or water conservancy project managers shall be registered in accordance with the relevant provisions of the water administrative department of the State Council. Without registration, it shall not be put into use. Chapter III Management of Water Conservancy Projects Article 13 The management of water conservancy projects follows the principle of combining unified management with hierarchical management.
Water conservancy projects that benefit and protect within the same administrative area shall be managed by the water administrative department of the city or county (district) or the township people's government. Water conservancy projects across administrative regions shall be managed by the water administrative department of the people's government at the next higher level, or by the water administrative department of the city or county (district) or the township people's government that mainly benefits.
