Measures for the administration of live poultry trading in Zhejiang Province

Article 1 In order to strengthen the management of live poultry trading, prevent and control infectious diseases, and ensure human health and public health safety, these Measures are formulated in accordance with relevant laws and regulations and combined with the actual situation of this province. Article 2 These Measures shall apply to the management of live poultry trading in cities and towns in this province. Where laws and regulations provide otherwise for the management of live poultry trading, such provisions shall prevail.

The term "live poultry" as mentioned in these Measures refers to edible poultry such as chickens, ducks, geese, pigeons and quails and wild poultry domesticated and propagated artificially.

The term "live poultry trading market" as mentioned in these Measures refers to live poultry wholesale markets, live poultry shops (direct sales outlets), live poultry trading areas in farmers' markets and other retail markets. Article 3 The people's governments at or above the county level shall strengthen the organization and coordination of the management of live poultry trading, make overall plans for the construction of live poultry trading markets and designated slaughtering plants (fields), and support and guide the establishment and improvement of the supply service system of chilled poultry products.

The people's governments at or above the county level and their relevant departments shall strengthen the publicity on the safe consumption knowledge of live poultry and poultry products, and guide the public to change the consumption habits of live poultry. Article 4 The administrative department of agriculture of the people's government at or above the county level shall be responsible for the management of fixed-point slaughter of live poultry and the animal epidemic prevention work related to live poultry trading.

The market supervision and management departments of cities and counties (cities, districts) with districts are responsible for the supervision and management of the trading behavior and food safety of live poultry and poultry products. The provincial administrative department for industry and commerce and the provincial food and drug supervision and administration department shall, in accordance with their respective responsibilities, strengthen the guidance and supervision of relevant management work.

The health and family planning administrative department of the people's government at or above the county level is responsible for monitoring and controlling the epidemic situation of live poultry traders infected with avian influenza and other related diseases, and guiding the organizers and operators of live poultry trading markets to do a good job in cleaning and disinfection.

Departments of finance, forestry, commerce and urban management administrative law enforcement (comprehensive administrative law enforcement) of the people's governments at or above the county level shall do a good job in the management of live poultry trading according to their respective responsibilities. Article 5 A city divided into districts restricts live poultry trading, and the specific scope of the restricted trading shall be determined and promulgated by the municipal people's government divided into districts in accordance with the relevant provisions of the provincial people's government. No live poultry trading market shall be set up in the restricted live poultry trading area, and no live poultry trading activities shall be engaged.

The county (city) people's government may, according to the needs of the prevention and control of avian influenza and other diseases, take the restrictive measures specified in the preceding paragraph. The setting conditions, examination and approval procedures and slaughter management of live poultry slaughtering plant (field) shall be implemented with reference to the relevant provisions of the Measures for the Implementation of the Regulations on the Management of Pig Slaughtering in Zhejiang Province. Article 7 The layout of the live poultry trading area and slaughter area in the live poultry trading market set up outside the restricted live poultry trading area, as well as the equipment and installation of related facilities, shall meet the conditions for animal epidemic prevention stipulated by the state. Do not engage in live poultry trading activities outside the live poultry trading market. Article 8 Whoever slaughters, sells or transports live birds shall, in accordance with the relevant provisions of the state and the province on animal epidemic prevention, declare quarantine to the local supervising agency for animal health and obtain the animal quarantine certificate. If live birds that have passed the quarantine inspection need to be delivered, a certificate of traceability of quarantine information shall be issued.

If live birds are transferred from outside the province, they shall be declared for the record and submitted for inspection in accordance with the provisions of the state and the province on animal epidemic prevention.

Live birds entering the live poultry trading market or slaughtered by designated slaughtering plants (fields) shall be accompanied by animal quarantine certificates or traceability certificates of quarantine information.

Vehicles should be cleaned and disinfected in time before and after loading and unloading. Ninth live poultry market organizers shall comply with the following provisions:

(a) daily cleaning and disinfection of live poultry trading and slaughtering areas and related facilities and equipment, centralized collection and harmless treatment of waste and sick birds;

(2) The live poultry trading market shall operate continuously for no more than 10 day, and shall be closed for no less than 3 days every month. During the rest period, the live poultry trading and slaughtering areas and related facilities and equipment shall be thoroughly cleaned and disinfected;

(three) to guide and urge live poultry operators to establish management systems such as inspection and acceptance of incoming goods, licensing and ticketing, and purchase and sale ledger;

(four) health protection training for live poultry traders, the implementation of health management requirements and health protection measures;

(five) to formulate an emergency plan for the prevention and control of live poultry diseases, and to report to the local animal health supervision agency immediately according to law when finding live poultry infected or suspected to be infected, and take corresponding control measures. Tenth live poultry operators shall inspect and publicize the "Animal Quarantine Certificate" or the traceability certificate of quarantine information in the business premises.

Live poultry operators shall strictly implement the management system of sanitation, disinfection, harmless treatment and regular closure of live poultry transactions; Unsold live birds shall be refrigerated or frozen after slaughter in the market before the market is closed, and live birds shall not stay in the market during the market is closed.

Live birds retailed by live poultry operators must be slaughtered before they can be delivered to buyers.

Live poultry trading practitioners should master basic health protection knowledge; In the process of live poultry trading and slaughtering, personal protective measures shall be taken in accordance with the relevant requirements of the administrative department of health and family planning. Article 11 The administrative departments of agriculture, health and family planning of the people's governments at or above the county level shall, according to their respective functions and duties, organize the monitoring and control of the epidemic situation of live poultry diseases, live poultry traders and related personnel infected with avian influenza, and inform each other of the monitoring information in a timely manner.
