The National Certification and Accreditation Administration (hereinafter referred to as CNCA) uniformly manages, supervises and comprehensively coordinates the accreditation of laboratories and inspection institutions.
The quality and technical supervision departments of the people's governments of all provinces, autonomous regions and municipalities directly under the Central Government and the entry-exit inspection and quarantine institutions directly under them (hereinafter referred to as local quality inspection departments) are responsible for the qualification identification, supervision and inspection of laboratories and inspection institutions within their respective jurisdictions according to their respective responsibilities
Measures for the measurement supervision and management of filling stations?
article 1 these measures are formulated in accordance with the "national metrology law of the people's Republic of China" and the responsibilities entrusted to the state administration of market supervision by the State Council, in order to strengthen the supervision and management of metering at gas stations, standardize the metering behavior of gas stations, maintain the order of national retail tax collection and management of refined oil products, and protect the legitimate rights and interests of consumers.
article 2 these measures are applicable to the supervision and management of measuring instruments, sales measurement of refined oil products and related measurement activities in the operation of gas stations in the people's Republic of China.
the gas station as mentioned in these measures refers to a fixed place where metering instruments such as fuel tankers are used to retail refined oil products.
article 3 the state administration of market supervision shall exercise unified supervision and management over the metering work of gas stations throughout the country.
the local market supervision and management departments at or above the county level shall supervise and manage the metering work of gas stations within their respective administrative areas.
article 4 in the retail operation of refined oil products at gas stations, the accuracy of measuring instruments and retail volume of refined oil products, law-abiding operation and honest service shall be guaranteed.
the state encourages refined oil operators to improve the measurement and testing system to ensure accurate measurement of refined oil sales.
Article 5 Gas station operators shall abide by the following provisions:
(1) Abide by metering laws, regulations and rules, formulate the metering management system of gas stations and protect consumers' rights and interests, maintain and manage the metering instruments used, and accept the metering supervision of market supervision and management departments.
(2) having full-time (part-time) metering personnel to be responsible for metering management of gas stations. Metering personnel at gas stations shall receive corresponding training in metering business knowledge.
(3) The use of measuring instruments subject to compulsory verification shall be registered and filed with the local market supervision and administration department, and the compulsory verification shall be done with the cooperation of the market supervision and administration department and its designated legal metrological verification institutions.
(4) The measuring instruments such as fuel tankers used shall have factory product qualification certificates; After the fuel tanker is installed, it can be put into use only after it is verified by the legal metrological verification institution authorized by the local market supervision and management department.
(5) If it is necessary to repair the fuel tanker, it should be reported to the unit with legal maintenance qualification. The repaired fuel tanker should be reported to the legal metrological verification institution that carries out compulsory verification before it can be put into use again.
(6) It is not allowed to use non-legal units of measurement, nor to use measuring instruments with non-legal units of measurement in violation of regulations and measuring instruments explicitly eliminated or prohibited by the state for the transfer of refined oil trade.
(7) measuring instruments that have not been verified, exceed the verification period or fail to pass the verification shall not be used; Do not destroy the measuring instruments and their lead seals, alter or disassemble the fuel dispenser without authorization, use the fuel dispenser that has been altered without approval, or practise fraud.
(8) In the retail of refined oil products, measuring instruments such as fuel tankers shall be used, and the measuring unit, measuring process and the value displayed by the measuring instruments shall be clearly stated, and the charging shall not be estimated. The settlement value of the retail volume of refined oil shall be consistent with the actual value, and its deviation shall not exceed the allowable error stipulated by the state; If the state has no regulations on measurement deviation, the deviation shall not exceed the allowable error of the measuring instruments used.
(9) To apply for verification of measuring instruments, fees shall be paid according to the items and charging standards approved by the price department.
Article 6 Market supervision and management departments at all levels shall abide by the following provisions when conducting metrological supervision and management:
(1) Publicize metrological laws, regulations and rules, and help and urge gas station operators to do a good job in metrological management of gas stations in accordance with the requirements of metrological laws, regulations and relevant provisions.
(2) to supervise and manage the metering instruments, sales metering of refined oil products and related metering activities at gas stations, organize law enforcement inspection of metering, and crack down on illegal metering activities.
(3) guide gas stations to strengthen the measurement assurance ability and improve the measurement detection system.
(4) accepting complaints about measurement disputes, and being responsible for mediation and arbitration verification of measurement disputes.
Article 7 When carrying out metrological verification and testing, metrological verification institutions and metrological verification personnel shall abide by the following provisions:
(1) Conduct verification in accordance with the national metrological verification regulations, complete verification within the prescribed time limit, issue verification certificates, and affix verification qualified marks on fuel tankers. If it is found that the lead seal is damaged during verification, it shall be reported to the relevant local market supervision and management department immediately.
(2) The metrological standards that have not passed the examination or exceeded the validity period shall not be used for verification.
(3) personnel who do not have metrological verification ability shall not be assigned to engage in metrological verification.
(4) the verification period shall not be adjusted at will, the verification time shall not be delayed without reason, and the fees shall not exceed the standard.
article 8 consumers who object to the accuracy of measuring instruments such as fuel dispensers and the retail volume of refined oil products at gas stations may apply to the market supervision and management department for arbitration verification under the condition of keeping the site intact, and may claim compensation from the gas station operators according to the arbitration verification results of the market supervision and management department.
article 9 gas station operators who violate the relevant provisions of these measures shall be punished according to the following provisions:
(1) those who violate the provisions of item (4) of article 5 of these measures and use measuring instruments with incomplete factory product certificates shall be ordered to stop using them, their measuring instruments and all illegal income shall be confiscated, and a fine of less than 2, yuan may be imposed. If the fuel tanker is put into use without being reported to the legal metrological verification institution authorized by the market supervision and management department for compulsory verification, it shall be ordered to stop using it and may be fined not more than 5, yuan; If losses are caused to the state and consumers, they shall be ordered to compensate for the losses, and may be fined between 5, yuan and 3, yuan.
(2) In violation of the provisions of Item (5) of Article 5 of these Measures, it shall be ordered to make corrections and stop using, and may be fined up to 5, yuan; If losses are caused to consumers, they shall be ordered to compensate for the losses, and may be imposed with a fine ranging from 5, yuan to 3, yuan.
(3) Whoever, in violation of the provisions of Item (7) of Article 5 of these Measures, uses measuring instruments that have not been verified, exceed the verification period or fail to pass the verification, shall be ordered to stop using them, and may also be fined up to 1 yuan. Those who destroy measuring instruments and their lead seals, alter or disassemble fuel tankers without authorization, use fuel tankers that have been altered without approval, and resort to deceit, thus causing losses to consumers, shall be ordered to compensate for the losses and be punished in accordance with the relevant provisions of the Detailed Rules for the Implementation of the People's Republic of China and the National Metrology Law; If a crime is constituted, criminal responsibility shall be investigated according to law.
(4) In violation of the provisions of Item (8) of Article 5 of these Measures, if measuring instruments are not used, it shall be corrected within a time limit; if it is not corrected within the time limit, it shall be fined from 1 yuan to 1 yuan; If the difference between the settlement value and the actual value of the retail volume of refined oil exceeds the allowable error stipulated by the state, it shall be ordered to make corrections, and if losses are caused to consumers, it shall be ordered to compensate for the losses, and a fine of less than 3 times the illegal income and no more than 3, yuan shall be imposed.
article 1 gas station operators who, in violation of these measures, refuse to provide retail accounts of refined oil products or provide untrue accounts, making it difficult to calculate the illegal income, may be fined up to 3, yuan according to the seriousness of the illegal act.
Article 11 Any state functionary engaged in the metrological supervision and management of gas stations who abuses his power, neglects his duty or engages in malpractices for personal gain, if the circumstances are minor, shall be given administrative sanctions; If a crime is constituted, criminal responsibility shall be investigated according to law.
article 12 if the metrological verification institutions and metrological verification personnel engaged in the verification of measuring instruments at gas stations violate the metrological laws, regulations and the provisions of these measures, they shall be punished in accordance with the relevant provisions of the detailed rules for punishment of metrological violations.
article 13 the administrative penalties stipulated in these measures shall be decided by the local market supervision and administration departments at or above the county level.
the local market supervision and management departments at or above the county level must abide by the relevant provisions of the State Administration of Market Supervision on the procedures for handling administrative cases when implementing administrative penalties in accordance with these Measures.
article 14 if an administrative counterpart refuses to accept the provisions on administrative punishment, he may apply for administrative reconsideration or bring an administrative lawsuit according to law.
article 15 the supervision and management of measuring instruments, sales measurement of refined oil products and related measurement activities in refined oil business such as oil depots, refueling boats, mobile refueling trucks and refueling points other than gas stations as stipulated in article 2 of these measures shall be implemented with reference to these measures.
article 16 the pattern of the qualified marks for the inspection of tankers as stipulated in these measures shall be uniformly stipulated by the state administration of market supervision.
Article 17 The State Administration of Market Supervision shall be responsible for the interpretation of these Measures.
article 18 these measures shall come into force as of February 1, 23.
