The relevant departments of industry and commerce, price, medicine and public security at all levels should cooperate with the administrative department of health to do a good job in the management of social medical institutions according to their respective responsibilities. Fourth social medical institutions must engage in medical services according to law, implement the principles and policies of health work, and consciously accept the supervision and management of relevant departments; Social medical supervision and management departments shall safeguard the legitimate rights and interests of social medical institutions. Article 5 Employees of social medical institutions shall abide by medical ethics, heal the wounded and rescue the dying, and serve the people wholeheartedly. Chapter II Management of Business Opening Article 6 The establishment of social medical institutions shall be based on the planning of the establishment of medical institutions in their respective jurisdictions and follow the principle of adhering to norms and facilitating medical treatment. Article 7 To set up a social medical institution, there must be a site that meets the hygiene requirements and necessary medical facilities and equipment; Be able to bear civil liability independently and meet the following conditions:
(a) medical practitioners in individual clinics, cities and towns must have the title of doctor or above, and rural areas must have the technical title of healer or above; Houses with an area of more than 20 square meters.
(two) the legal representative of the joint clinic, with the title of doctor or above; There are no fewer than 6 employees, including 3 with the title of doctor or above, 1 person with the title of nurse or above, and 1 person with the title of medical technology such as primary pharmacy or above; Houses with an area of more than 50 square meters are equipped with internal and surgical consultation rooms, pharmacies, treatment rooms, auxiliary diagnosis departments and observation rooms.
(3) The legal representatives of Chinese medicine clinics and specialist clinics, with the title of specialist attending physician or above; The staffing of employees and the setting of houses and departments must be higher than that of joint clinics.
(four) the legal representative of the comprehensive outpatient department, with the title of attending physician or above, with no less than 12 employees, including 5 people with the title of physician or above; Houses with an area of 160 square meters or more, internal and external, gynecological and pediatric clinics.
(five) the legal representative of the hospital or branch, with the title of attending physician or above; Housing conditions, department settings, staffing ratio, medical equipment, etc. Refer to the classification management standards of the Ministry of Health.
(6) The legal representatives of sanatoriums and rest homes, with the title of attending physician or above; And equipped with health technology, industry and management personnel according to regulations; Houses with an area of over 200 square meters and more than 30 beds; There are certain activity places and green spaces. Article 8 The establishment of medical treatment, rehabilitation and consultation institutions must meet the requirements stipulated by relevant professions. Ninth field to practice medicine in this city (including employment), in addition to the necessary documents, but also by the municipal health administrative department to organize expert assessment, qualified before practicing medicine or employment. Tenth whoever applies for the establishment of social medical institutions must go through the examination and approval procedures in accordance with the following provisions:
(a) in the city to bid for individual clinics, in the county (city) to bid for social medical institutions, apply to the health administrative department of the local people's government at the county level and submit relevant materials and certificates, which shall be examined and approved by the local county (city) and district health administrative departments;
(two) in the city to bid for joint clinics, outpatient departments, hospitals, branches, sanatoriums (institutes), medical care, health care, rehabilitation and consulting institutions, to apply to the municipal public health administrative department, and submit relevant materials and certificates, which shall be examined and approved by the municipal public health administrative department;
(three) the approved social medical institutions shall be uniformly registered by the approving organ at the municipal health administrative department, and the social medical execution license shall be issued.
The administrative department of health shall complete the examination and approval within 30 days from the date of receiving the application. If it is not approved, it shall explain the reasons. Eleventh without the approval of the administrative department of health, medical-related optometry, beauty, qigong, biological species determination and other activities may not be carried out.
No unit or individual may illegally practice medicine or sell drugs. Twelfth people who suffer from diseases that are not suitable for practicing medicine and who are disqualified from practicing medicine may not work in social medical institutions. Chapter III Practice Management Article 13 Medical personnel in social medical institutions must strictly implement various medical systems, drug use regulations and operating rules of medical treatment, nursing and medical technology. Fourteenth social medical institutions must have corresponding first-aid facilities and medicines, and implement the responsibility system of first diagnosis.
Patients with infectious diseases and patients suspected of infectious diseases shall abide by the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Infectious Diseases.
It is strictly forbidden for social medical institutions to carry out STD treatment and family planning medical services without approval. Fifteenth medical errors and medical accidents, must immediately and truthfully report to the administrative department of health. The administrative department of health shall deal with it in a timely manner in accordance with relevant regulations.
