Article 3 On-the-job employees and professional technicians of enterprises and institutions can use their spare time to provide paid services to individual industrial and commercial households, private enterprises and enterprises with other economic sectors, and engage in business activities permitted by national policies such as technology development, new product development, staff training and consulting services. Article 4 To apply for engaging in individual business or starting private enterprises, except for industries and important varieties that require production and operation licenses or special approval as stipulated by laws, regulations and documents of the people's governments of the State Council and autonomous regions, other industries do not implement the licensing system, and may directly apply to the administrative department for industry and commerce for registration. Article 5 Entrusted by the county-level administration for industry and commerce, the administration for industry and commerce may approve the issuance of temporary business licenses for individual industrial and commercial households; With the authorization of the administrative department for industry and commerce at the county level, farmers and herdsmen who apply to engage in self-employment and start private enterprises in marginal areas may issue business licenses for individual industrial and commercial households and private enterprises. Article 6 Except for industries and commodities explicitly prohibited by the state and autonomous regions, individual industrial and commercial households and private enterprises are allowed to produce and operate, and can engage in wholesale, retail, wholesale and retail, purchasing, consignment, warehousing, transportation and long-distance trafficking. Article 12 All individual industrial and commercial households and private enterprises that have been approved and registered by the administrative department for industry and commerce, hold a business license, have a registered capital of not less than 300,000 yuan, have a fixed place of business and have been in business for more than two years may apply for establishing Sino-foreign joint ventures, cooperation or partnerships with foreign businessmen (including Hong Kong, Macao and Taiwan businessmen), and may conduct economic and trade business through joint ventures with companies with import and export rights or entrust agents.
