Provisions of the Standing Committee of the Jinan Municipal People's Congress on Discussing and Deciding on Major Matters

Article 1 In order to ensure that the Standing Committee of the Municipal People's Congress effectively exercises its authority to discuss and decide on important matters in accordance with the law, and to ensure compliance with and implementation of the Constitution, laws and regulations, and the resolutions and decisions of the National and Provincial People's Congresses and their Standing Committees, as well as those of the people's congresses at this level, these provisions have been formulated in accordance with the Constitution of the People's Republic of China and the Organizational Law of the Local People's Congresses at Different Levels and Organizational Law of Local People's Congresses at All Levels" and other laws and regulations, and in the light of the actual situation in the city, these provisions are formulated. Article 2 These provisions shall apply to the Standing Committee of the Municipal People's Congress (hereinafter referred to as the Standing Committee of the Municipal People's Congress) in discussing and deciding on major matters in the administrative area of the city in respect of politics, economy, education, science, culture, health, environment and resource protection, civil affairs and nationalities. Article 3 The following major matters shall be considered at a meeting of the Standing Committee of the Municipal People's Congress and corresponding resolutions and decisions shall be made:

(1) partial changes in the annual plan for the national economic and social development of the city;

(2) adjustments to the annual budget of the municipal finances and the annual final accounts of the municipal finances;

(3) requests for the revocation of resolutions or decisions of the county (municipal, district) people's congresses and their standing committees that are not resolutions and decisions;

(4) submitting for revocation of inappropriate decisions and orders of the Municipal People's Government;

(5) matters submitted for decision by the Procurator-General of the Municipal People's Procuratorate who disagrees with the decisions of a majority of the Procuratorate's committee members on important issues;

(6) the general plan of the city and its alteration;

(7) the conclusion of friendly city relations;

(viii) the granting of local honorary titles;

(ix) the determination and change of the municipal standard, municipal tree and municipal flower;

(x) other matters prescribed by laws and regulations.

The major matters listed in the preceding paragraph shall be proposed in the form of a motion. Article 4 The following important matters shall be reported to the Standing Committee of the Municipal People's Congress, and if necessary, considered at a meeting of the Standing Committee of the Municipal People's Congress, and corresponding resolutions and decisions may be made:

(1) implementation of the resolutions and decisions of the Municipal People's Congress and its Standing Committee;

(2) handling of the motions of the Municipal People's Congress and the suggestions, criticisms, and opinions put forward by the deputies of the Municipal People's Congress (c) important law enforcement inspections;

(d) major measures for the reform of the economic and political systems;

(e) adjustments and changes in the city's administrative divisions;

(f) the implementation of major urban construction projects within the city's annual plan for national economic and social development, and their implementation;

(g) the status of the city's National economic and social development of the annual plan outside the newly added municipal major construction projects and state-controlled and supported by the financial resources of the public **** construction projects identified and its implementation program;

(viii) extrabudgetary funds of the management of revenue and expenditure;

(ix) the basic pension insurance fund, unemployment insurance fund, medical insurance fund and housing provident fund of the management of revenue and expenditure;

(ix) the basic pension insurance fund, unemployment insurance fund, medical insurance fund and housing fund;<

(x) the management and utilization of education funds and education funds;

(xi) the income and expenditure, reduction, exemption and management of land use right concession fees;

(xii) the implementation of the general plan for land use and the overall urban planning;

(xiii) the state of family planning, resource protection and comprehensive utilization, environmental protection and environmental quality;

(xiv) the handling of major incidents endangering social stability and causing serious losses to the State, the collective, and the lives and properties of citizens, as well as the handling of major disasters;

(xv) the integrity of the Municipal People's Government, the Municipal Intermediate People's Court, and the Municipal People's Procuratorate, and the handling of violations of law and discipline by staff members appointed by the Standing Committee of the People's Congress of the People's Republic of China.

Major matters specified in the preceding paragraph (b), (h), (i), (j), (k), (l), (m), (o), (o), (o), (p), shall be reported at least once a year; major matters specified in other paragraphs shall be reported in the light of the actual situation or in accordance with the requirements of the Standing Committee of the Municipal People's Congress. Article 5 The Chairperson's Conference of the Standing Committee of the Municipal People's Congress, the Municipal People's Government, the Specialized Committees of the Municipal People's Congress, the members of the Standing Committee of the Municipal People's Congress consisting of more than five persons jointly, the Intermediate People's Court of the Municipal People's Republic of China and the Municipal People's Procuratorate shall have the right to put forward bills and reports on the major matters listed in Articles 3 and 4 of these Provisions, and may also put forward bills and reports on other major matters falling within the scope of the Standing Committee of the Municipal People's Congress. Article 6 Motions and reports on important matters shall be made in accordance with the following procedures:

(1) The chairman of the Standing Committee of the Municipal People's Congress shall make motions and reports directly to the Standing Committee of the Municipal People's Congress for its consideration at a meeting of the Standing Committee of the Municipal People's Congress;

(2) The Municipal People's Government, the Specialized Committees of the Municipal People's Congress, the Intermediate People's Court of the Municipal People's Congress, and the Municipal People's Procuratorate, make motions and reports to the Standing Committee of the Municipal People's Congress (b) the municipal people's government, the specialized committees of the municipal people's congress, the municipal intermediate people's courts and the municipal people's procuratorates submit motions and reports to the Standing Committee of the Municipal People's Congress, which shall be submitted to the Standing Committee of the Municipal People's Congress for deliberation by the Director's Meeting, or shall be referred to the specialized committees concerned for deliberation and reports, and shall be submitted for deliberation to the Standing Committee of the Municipal People's Congress; and The chairman shall first refer the motion to the relevant specialized committee for consideration and submission of a report, and then decide whether or not to submit it to the Standing Committee for deliberation. Article 7 The motions and reports on important matters submitted to the Standing Committee of the Municipal People's Congress by the meeting of chairpersons of the Standing Committee of the Municipal People's Congress, the Municipal People's Government, the Specialized Committee of the Municipal People's Congress, the Municipal Intermediate People's Court and the Municipal People's Procuratorate shall be signed by the chairpersons, the mayor, the chairperson, the dean, and the procurator-general; and the motions on important matters submitted by five or more members of the Standing Committee of the Municipal People's Congress shall be signed by the joint signers***.

The motion and report on major matters shall be formally submitted to the Standing Committee of the Municipal People's Congress ten days before the meeting of the Standing Committee, and submit the relevant information at the same time.
