Chapter 1 General Provisions Article 1 In order to protect and rationally utilize forest resources, standardize forest park management, and develop forest eco-tourism, in accordance with the "Forest Law of the People's Republic of China" and other laws and administrative regulations, stipulates that these regulations are formulated based on the actual situation of the province. Article 2 These Regulations shall apply to the construction, protection and management of forest parks within the administrative region of this province.

Forest parks as mentioned in these regulations refer to forest scenery resources of a certain scale and quality and suitable environmental conditions that are based on forest resources and are established with approval in accordance with legal procedures for people to visit, relax or carry out activities. Article 3 The construction, protection and management of forest parks shall follow the principles of protection priority, scientific planning, unified management and rational utilization, and adhere to the unification of ecological, social and economic benefits. Article 4 The people's governments at or above the county level shall strengthen the organization, coordination and leadership of the construction and management of forest parks, incorporate the construction of forest park public infrastructure into the national economic and social development plans of their respective administrative regions, and incorporate the protection of forest landscape resources into the national economic and social development plans of their respective administrative regions. and management funds shall be included in the fiscal budget of the people's government at the same level. Article 5 The forestry administrative departments of the people's governments at or above the county level and their affiliated forestry management agencies are responsible for the supervision and management of forest parks within their respective administrative regions in accordance with their management authority.

The development and reform, public security, transportation, tourism, land and resources, environmental protection, housing and urban and rural construction, water conservancy, culture and other departments of the people's governments at or above the county level shall, in accordance with their respective responsibilities, do a good job related to forest parks. Supervise management work.

The forest park management agency is responsible for the daily protection and management of the forest park. Chapter 2 Establishment and Construction Article 6 Forest parks are divided into national and provincial levels.

To establish a national forest park, apply in accordance with relevant national regulations.

To establish a provincial forest park, the applicant shall submit an application and be subject to the approval of the provincial forestry administrative department. Article 7 The establishment of a provincial forest park shall meet the following conditions:

(1) Clear ownership of forests, trees and woodland, and clear boundaries of forest land;

(2) Area of ??100 hectares Above, the forest coverage rate is more than 50%;

(3) The quality level of forest scenery resources reaches the national standard level three or above, and the forest park quality rating score is more than 40 points;

(4) Have corresponding management institutions and technical and managerial personnel. Article 8 To apply for the establishment of a provincial forest park, the following materials should be submitted:

(1) Application documents;

(2) Feasibility study report;

(3) Certificates of ownership of forests, trees and woodlands;

(4) Landscape photos, CDs and other image materials of forest landscape resources;

(5) Responsibilities and systems of management agencies and descriptions of technical and management personnel configuration, etc. Article 9 When applying for the establishment of a provincial forest park, the local forestry administrative department shall provide review opinions within 15 days from the date of receipt of the application materials and report them to the provincial forestry administrative department. The provincial forestry administrative department shall make a written decision within 20 days from the date of receipt of the review opinions. If the conditions are met, the application will be approved; if the conditions are not met, the application will be disapproved and the reasons will be stated in writing.

The cancellation, division, merger, adjustment of boundaries, name change, etc. of a forest park must be reported to the original approving authority for approval. Article 10 Within 18 months from the date of approval of the establishment of a forest park, the forest park management agency shall entrust a unit with corresponding qualifications to prepare an overall plan for the forest park.

The overall plan of the provincial forest park is approved by the provincial forestry administrative department. The approved overall plan is the basis for the protection, construction and management of the forest park and may not be changed without authorization; if changes are really necessary, they must be approved by the original approval authority. Article 11 Construction projects in forest parks shall comply with the requirements of the overall plan. Their site selection, scale, style, etc. shall be coordinated with the surrounding landscape and environment. Corresponding tourist service facilities, waste treatment facilities, and fire prevention facilities shall be designed at the same time. , constructed at the same time, used at the same time.

If projects that have been built or are under construction in the forest park do not comply with the overall plan, they should be gradually transformed, demolished or moved out in accordance with the overall plan. Chapter 3 Resource Protection Article 12 The forest park management agency shall strengthen the protection and management of natural resources such as forests, trees, and water sources in the forest park, and number the ancient and famous trees, ancient garden buildings, and historical relics in the forest park. Register, create files, and set up special protection measures.

Article 13 Forest park management agencies shall strengthen the protection of wild animals and plants, conduct regular surveys of wild animal and plant resources, establish archives, and establish peripheral protection zones or protective facilities for the habitats of wild animals and the native places of wild plants. Article 14 The forest park management agency shall investigate, monitor and prevent forestry harmful organisms; if any abnormal events such as suspected sudden forestry harmful organisms are discovered, emergency measures shall be taken and the relevant forestry authorities shall be reported in a timely manner. Article 15 The forest park management agency shall establish a forest protection and fire prevention responsibility system, equip fire prevention facilities and equipment, set up fire prevention signs, delineate no-fire areas and fire prevention responsibility areas, formulate fire prevention emergency plans, conduct regular fire prevention inspections, and eliminate fire hazards.
