Article 30 The people's governments at or above the county level shall formulate emergency rescue plans for major production safety accidents in their administrative areas, and report them to the people's governments at the next higher level for the record after they have been signed by the person in charge.
The people's governments at or above the county level shall, in accordance with the provisions of the emergency rescue plan, formulate plans for exercises and organization and implementation, and amend them in a timely manner in the light of the actual situation.
Article 31 The people's governments at or above the county level shall establish an emergency rescue system, and set up emergency rescue teams for production safety accidents according to the local actual situation.
Article 32 The production, operation, storage and transportation of dangerous goods units, as well as mines, building construction units shall establish emergency rescue organizations, equipped with the necessary emergency rescue equipment, equipment; production and operation of smaller scale, can not establish emergency rescue organizations, should be equipped with emergency rescue equipment, equipment, designated part-time emergency rescue personnel, and with the nearest emergency rescue organization to sign the rescue Agreement.
Article 33 In the event of a production safety accident in a production and management unit that causes injury to a person in need of rescue, the injured person shall be sent to a medical institution in a timely manner, and advance payment of medical expenses.
Article 34 The investigation and handling of production safety accidents in production and management units shall be graded and handled in accordance with the following provisions:
(1) If one or two people die at one time, the people's government at the county level shall organize the relevant departments to investigate and approve the closure of the case, and report it to the supervisory and management department of work safety of the people's government of the municipality in the district for the record;
(2) If three or nine people die at one time, the municipal people's government shall organize the relevant departments to investigate and approve the closure of the case; and People's Government of the autonomous region to organize the relevant departments to investigate and approve the closure of the case, reported to the people's government of the autonomous region for the record of the supervision and management of work safety;
(c) a death of ten to twenty-nine people, the people's Government of the autonomous region to organize the relevant departments to investigate and approve the closure of the case, reported to the State Council for the record of the department responsible for the supervision and management of work safety;
(d) a death of more than thirty people, according to the State Council's regulations.
The people's government at a higher level may send its staff or directly organize the investigation and handling of production safety accidents that should be investigated and handled by the people's government at a lower level; the people's government at a higher level may entrust the people's government at a lower level to organize the investigation and handling of production safety accidents that should be investigated and handled by the people's government at a higher level.
Laws and regulations on the investigation and handling of production safety accidents are otherwise stipulated, from its provisions.
Article 35 The relevant departments and units responsible for the investigation and handling of production safety accidents shall establish and improve the accident investigation and handling information files.
Supervision and management of production safety departments of the people's governments at or above the county level shall regularly analyze statistics on production safety accidents occurring in the administrative area, and promptly report to the people's governments at the same level and the supervision and management of production safety departments of the people's governments at higher levels.
