Regulations on human remains and organ donation in Fujian Province

Chapter I General Provisions Article 1 In order to regulate the behavior of human remains and organ donation, safeguard the legitimate rights and interests of donation, acceptance and other parties, carry forward the spirit of selfless dedication, the development of medical science, and promote social progress, according to the actual situation in this province, the formulation of these regulations. Article II of these regulations shall apply to the administrative region of the province of human remains, organ donation and its related activities.

The remains referred to in these regulations refers to the body of a natural person after death.

Organs as referred to in these Regulations refer to the human organs and human tissues of natural persons other than blood, sperm, eggs and embryos. Article 3 Donation of human remains and organs shall follow the principle of voluntary and gratuitous. The transplantation of donated organs shall follow the principles of science, justice and fairness. It is prohibited to buy or sell human remains and organs. Article IV The donor's donation behavior and human dignity are protected by law and social respect.

The donor's close relatives shall respect the donor's willingness to donate, support the donor's donation behavior. Article V above the county level health administrative department in charge of the administrative region of the body, organ donation work. Civil affairs, justice, public security, education, science and technology and other departments in accordance with their respective responsibilities, to do a good job related to human remains and organ donation.

The local Red Cross is responsible for the registration of human remains and organ donation, consultation, organ transplantation sorting and other organizational services. Article 6 Local people's governments at all levels and relevant departments and units shall take measures to encourage citizens to donate human remains and organs.

Radio, television, newspapers and magazines, the Internet and other news media shall strengthen the publicity of human remains and organ donation, and promote the formation of good social customs.

Schools with the conditions should carry out the popularization of human remains and organ donation education. Article 7 The local people's governments at all levels, the relevant departments can give recognition and rewards to donors of human remains and organs and units and individuals who have made outstanding achievements in the work of human remains and organ donation. Chapter II Donation of human remains Article 8 A natural person with full capacity for civil behavior may donate human remains. Restricted capacity for civil behavior of natural persons willing to donate human remains, shall obtain the written consent of their guardians. Article IX donors to donate human remains shall apply for registration procedures, fill out the registration form and sign and seal. The registration form shall contain the donor's basic information, the implementation of the donation of the relevant information and consent to the implementation of the views of the unit to receive the remains and other matters.

Local Red Cross societies at all levels and the registration units entrusted by them are the registration organizations for the donation of human remains. The registration organization shall publicize its name, address, contact information, working hours and so on. Article 10 A donor who goes through the procedure of registering for the donation of human remains may register at the registration organization or request the registration organization to register at his doorstep.

If the donor does not choose a unit to receive the remains, the local Red Cross shall determine the unit to receive the remains.

The registration unit commissioned by the local Red Cross Society shall regularly report the status of the registration of body donation to the commissioned Red Cross Society, which shall promptly notify the relevant body-accepting unit.

The registration organization, the unit accepting the remains and its staff shall keep the matters registered confidential and shall not disclose them. Article 11 The donor entrusted and registered donation executor, can be the donor's close relatives, or other natural persons, or the donor's work unit, the residence of the village committee, pension institutions and other organizations. Article 12 After the registration procedures for human remains donation, the donor can change the registration content or revocation of registration. The registration organization shall promptly change or revoke. Article XIII of the provincial Red Cross unified printing of human remains donation registration form, donation card and certificate of honor.

Promoting the donor to carry the donor card. Article 14 Units meeting the following conditions may become units for acceptance of human remains upon registration with the provincial Red Cross:

(1) institutions of higher learning and scientific research units with the ability to carry out medical teaching and medical scientific research, or medical institutions with the ability to carry out medical scientific research and organ transplants;

(2) there are institutions and personnel engaged in the work of accepting human remains;

(c) There are equipment and places suitable for carrying out the work of accepting human remains.

The unit for acceptance of human remains may serve as the unit entrusted by the Red Cross for registration of human remains donation. Article 15 After the death of the donor, the donor executor shall promptly notify the unit of acceptance of human remains, the unit of acceptance of human remains shall accept the remains and go through the acceptance procedures within twenty-four hours after receiving the notification.

If the donor executor is unable to do so for any reason, the donor's work unit or the residential (village) committee of the place of residence, the nursing home and other organizations, may promptly notify the corresponding acceptance unit or the local local Red Cross.

In the event of death caused by sudden factors, the relevant units and individuals who learn that the deceased was a donor shall promptly notify the donor executor or the local local Red Cross.

After accepting the remains, the unit accepting the remains shall file a record with the local Red Cross within ten days. Article 16 The unit accepting the remains shall properly manage the donated remains and establish a file on the utilization of the remains; when the remains are utilized, a ceremony shall be held to show respect for the remains and respect for the donor, and there shall be no insult to the remains; the unit shall be responsible for the cremation of the utilized remains, and shall bear the transportation and cremation fees and other related expenses of the remains.

Local Red Cross societies and body acceptance units can set up memorial facilities for the body donor. Chapter III organ donation Article XVII of eighteen years of age and have full capacity for civil behavior of natural persons can donate living organs, donation should have agreed to donate written proof. Living organ donation shall not jeopardize the life and safety of the donor.

Natural persons willing to donate organs after death shall have written proof of consent to donate; if there is only a verbal expression of consent to donate, the following conditions shall be met:

(1) there is a written proof of his or her spouse as well as two physicians;

(2) if there is no spouse, there is a written proof of his or her parents or adult children as well as two physicians;

(3) there is no spouse, parents or adult children as well as two physicians;

(4) there is a written proof of his or her consent to donate. (C) without a spouse, parents, adult children, there are two other close relatives as well as two physicians' written proof;

(D) without any close relatives, there are their workplace or place of residence, residential (village) committees, nursing homes and other organizations, as well as two physicians' written proof.
