(I) general accidents: the occurrence of acute occupational disease of less than 10 people;
(II) major accidents: the occurrence of acute occupational disease of 10 or more than 50 or less or less than five deaths, or the occurrence of occupational anthrax of less than five people;
() (C) major accidents: the occurrence of acute occupational disease of more than 50 people or death of more than 5 people, or the occurrence of occupational anthrax more than 5 people.
The categorization and investigation of radiological accidents shall be carried out in accordance with the Provisions on the Management of Radiological Accidents formulated by the Ministry of Health. Article 3 The health administrative departments at or above the county level are responsible for the investigation and handling of occupational disease hazards within their jurisdiction.
Major and very large occupational disease hazards by the provincial level or above, the health administrative department in conjunction with the relevant departments and trade union organizations, in accordance with the prescribed procedures and responsibilities for investigation and handling. Article 4 The main contents of the investigation and treatment of accidents of occupational disease hazards are:
(1) to take temporary control and emergency rescue measures according to law, and to organize timely rescue of patients with acute occupational diseases;
(2) to report the accidents in accordance with the provisions;
(3) to organize the investigation of accidents;
(4) to investigate and deal with those who are responsible for the accidents in accordance with the law;
(5) to close the case and file it in accordance with the regulations. (E) close the file. Article 5 The investigation and treatment of accidents of occupational disease hazards shall be rapid, effective, scientific and fair. Chapter II accident report Article VI occupational disease hazards occurring in the accident, the employer shall immediately report to the local county-level health administrative departments and relevant departments. Article 7 The county-level health administrative department receives the report of occupational disease hazards, shall implement the emergency report:
(a) large and major accidents, should be immediately reported to the people's government at the same level, the provincial health administrative departments and the Ministry of Health;
(b) general accidents, should be reported to the people's government at the same level and the higher level of the health administrative departments within six hours. Article VIII receiving workers suffering from acute occupational disease hazards of the first medical and health institutions, shall promptly report to the local county-level health administrative departments. Article 9 The contents of the report on the accident of occupational disease hazards shall include the location, time, morbidity, number of deaths, possible causes, measures taken and development trend of the accident. Article 10 local health administrative departments at all levels in accordance with the "health supervision and statistical reporting regulations", responsible for the jurisdiction of the occupational disease hazards of statistical reporting, and should be regularly informed of the relevant departments and trade unions at the same level of the occurrence of occupational disease hazards.
The occurrence of occupational disease hazardous accidents, by the provincial level or above, the health administrative department unified public announcement. Article 11 No unit or individual shall, under any pretext, conceal, misreport, omit and late reporting of accidents of occupational disease hazards. Chapter III accident handling Article 12 In the event of an accident of occupational disease hazards, the employer shall immediately take the following emergency measures according to the situation:
(a) stop the operations leading to occupational disease hazards, control the scene of the accident, prevent the expansion of the situation, and reduce the hazards of the accident to a minimum;
(b) clear the emergency evacuation channel, evacuation of the operating personnel, and organization of the risk relief;
(C) protect the scene of the accident, retain the materials, equipment and tools leading to occupational disease hazards;
(D) workers who suffered or may have suffered from acute occupational disease hazards, timely organization of treatment, health checks and medical observation;
(E) in accordance with the provisions of the accident report;
(F) to cooperate with the health department of the investigation, and provide truthful information in accordance with the requirements of the health administrative department. (F) Cooperate with the administrative department of health in the investigation, and truthfully provide the accident situation, relevant materials and samples as required by the administrative department of health;
(VII) Implement other measures as required by the administrative department of health. Article 13 Upon receipt of a report on an occupational disease hazard accident, the administrative department of health may, according to the circumstances, take the following measures:
(1) order the suspension of the operation that caused the occupational disease hazard accident;
(2) organize the control of the scene of the occupational disease hazard accident;
(3) seal up the materials, equipments, and tools, etc. that caused the occupational disease hazard accident;
(4) Organize medical and health institutions to rescue and treat workers who have suffered or may suffer from acute occupational disease hazards. Article XIV of the accident, the health administrative department shall promptly organize the employer's competent departments, public security, production safety departments, trade unions and other relevant departments to form an occupational disease hazards accident investigation team to investigate the accident. Article 15 The members of the accident investigation team shall meet the following conditions:
(a) have the professional knowledge and practical experience required for accident investigation;
(b) no direct interest in the accident. Article 16 Duties of the investigation team of the accident of occupational disease hazards:
(1) to carry out on-site inspection and investigation and collection of evidence, and to ascertain the occurrence of the accident of occupational disease hazards, the causes, the casualties and the degree of harm;
(2) to analyze the responsibility for the accident;
(3) to put forward the punishment for the person responsible for the accident;
(4) to put forward the improvement measures that should be taken for the prevention of the accident from recurrence;
(4) to put forward the improvement measures that should be adopted for the prevention of the accident. (D) Proposing opinions on improvement measures to be taken to prevent the recurrence of the accident;
(E) Forming the report on the investigation and handling of the occupational disease accident. Article 17 When the accident investigation team conducts on-site investigation and evidence collection, it has the right to learn about the situation from the employer, relevant units and relevant personnel, and no unit or individual shall refuse, conceal or provide false evidence or information, or impede or interfere with the on-site investigation and evidence collection work of the accident investigation team.
