Sichuan Province public **** place health management measures
Chapter I General
Article 1 In order to create good health conditions in public **** place, prevention and control of the spread of disease and group health hazards, to protect the public's physical health, according to the "Chinese People's *** and the State of the Prevention and Control of Infectious Diseases Law", "public **** Place health management regulations" and other laws and regulations, combined with the actual situation in Sichuan Province, the development of this approach.
Second public **** places are divided into Category A places and Category B places.
___ Category A establishments include:
(a) hotels, inns, guest houses;
(b) public **** bathrooms, barber stores, beauty stores;
(c) theaters, video halls (rooms), amusement halls (rooms), dance halls, concert halls;
(d) stadiums (venues), swimming pools (venues);
(e) exhibition halls, museums, art galleries, art museums, art museums, art museums, art museums, art galleries, art galleries, art museums, art museums, art museums, art museums, art museums, art museums and art galleries. ) exhibition halls, museums, art galleries, libraries;
(F) shopping malls (stores), bookstores;

Type B places include:
(a) indoor areas outside the waiting room of medical institutions using centralized air-conditioning ventilation system, school teaching and living places, office buildings, business halls and state agencies to provide public **** services, such as office space;
(b) Internet cafes, kindergartens, youth centers and so on.
Article 3 of the administrative area of Sichuan Province, public **** place health management applies to this approach.
Article 4 The local people's governments at or above the county level shall strengthen the leadership of the supervision and management of health in public **** places, and guarantee the funds required for the supervision and monitoring of health in public **** places.
The health administrative departments of local people's governments at or above the county level are responsible for the supervision and management of health in public **** places within their administrative areas.
Education, public security, human resources and social security, construction, transportation, culture, commerce, industry and commerce, sports, food and drug supervision and other departments in accordance with their respective responsibilities to do a good job in the supervision and management of public **** place health.
Article 5 of the public **** places and related services industry organizations should strengthen health management, the implementation of health management responsibilities.
Article VI Category A establishments in accordance with the "public **** place health management regulations," the implementation of health licensing, Category B establishments in accordance with the provisions of this approach to the implementation of record management. __________ Chapter II Health Management
___ Article VII of the public **** place units should be developed to prevent and control the spread of infectious diseases and health hazards of the event emergency plan, establish and improve the public **** place health testing, supplies and appliances health and safety management system.
Public **** place unit shall be equipped with full-time (part-time) health management personnel, establish and improve the health examination of employees, health knowledge training and assessment system, the establishment of health management files.
Article VIII of category A and engaged in operating services of category B establishments units directly for customer service personnel should be in accordance with relevant state regulations for regular health checks, and obtain a health certificate before engaging in direct customer service.
Suffering from dysentery, typhoid fever, viral hepatitis A, viral hepatitis E and other infectious diseases of the digestive tract (including carriers), active tuberculosis, suppurative or exudative skin diseases, as well as other diseases that hinder the public health of the personnel, before the cure shall not be engaged in direct customer service.
Article IX of the public **** place in charge and health management personnel shall learn to master the health laws, regulations and relevant knowledge, accept the health administrative department business guidance.
Category A establishments and engage in business services of category B establishments unit shall organize health knowledge training for employees, qualified training before taking up their duties.
Training requirements and assessment standards developed by the provincial health administrative department and announced to the community.
Article 10 of the public **** places should have a special cleaning and disinfection sites, equipped with appropriate cleaning and disinfection facilities, equipment and cleaning and storage facilities, and categorized for use.
Public **** places should be equipped with effective prevention and control of rats, mosquitoes, flies, cockroaches and other vectorial organisms and waste storage facilities for special use.
Public **** places should be configured with the appropriate washing facilities, equipment, restrooms should be set up independent ventilation devices.
Public **** place units should ensure that the health facilities, equipment and normal operation, shall not be removed or diverted to other uses.
Article XI of the public **** place units to provide public **** supplies, utensils should be hygienic, safe, harmless. Prohibit the repeated use of disposable public **** supplies, appliances.
Article XII of the public **** place indoor air, indoor microclimate, drinking water, lighting, lighting, noise and other health indicators should be in line with national and provincial health administrative departments of the relevant health standards and norms.
A category of units should be based on the relevant provisions of the state health indicators for regular testing, B category of units should be provided by the provincial health administrative department of the frequency of testing for health indicators.
Article XIII of the public **** place centralized air-conditioning ventilation system health indicators should be consistent with the relevant national health standards or norms.
Article XIV of the centralized air-conditioning ventilation system in public **** place of the new air outlet should be set outdoors, away from the source of pollution, and set up protective nets and primary filters.
Public **** place to use centralized air conditioning ventilation system should be equipped with emergency shutdown of the return air and fresh air, for air duct system cleaning and disinfection can be opened and closed windows, return air supply and rodent control devices, air purification and disinfection devices, control of air-conditioning system sub-regional operation of the device and other health facilities.
Article XV of the public **** place centralized air conditioning and ventilation system management unit shall be in accordance with the following requirements for regular inspection, cleaning and maintenance, and have a complete record:
(a) cleaning of open cooling towers, air-handling units, the table cooler, heating (humidity), condensate tray, etc. not less than 1 time per year;
(b) checking or replacement of air filters, filters and purifiers, etc. not less than once every six months;
(c) cleaning air duct system not less than once every two years.
The use of split-type air conditioning public **** premises units should be regularly cleaned and disinfected and inspection and maintenance.
Article XVI of the public **** place unit of centralized air conditioning ventilation system health test failed, it should be promptly shut down the centralized air conditioning ventilation system of the area it involves, and cleaning and disinfecting treatment, and only after passing the test can be re-activated.
Airborne disease outbreaks and epidemics in the region, the public **** premises units should start the emergency plan, and weekly cleaning, disinfection, or replacement of open cooling towers, air-handling units and components of the centralized air conditioning ventilation system in operation.
Article XVII of the centralized air-conditioning ventilation system cleaning and disinfection services should have the following conditions:
(a) with a fixed office space;
(b) with the cleaning and disinfection services required instruments, equipment;
(c) professional composition of the personnel, skills training, etc. to meet the cleaning and disinfection service work;
(d) with a Quality management system;
(e) equipped with appropriate safety protection and personal protective equipment.
Article XVIII of the public **** place centralized air conditioning ventilation system cleaning and disinfection services should be in strict accordance with the relevant provisions of the state to carry out cleaning and disinfection work.
Public **** place centralized air conditioning ventilation system cleaning and disinfection services should be entrusted to the cleaning unit issued by the cleaning and disinfection effect test report.
Article 19 _ public health hazards occurring in the public **** premises, the public **** premises unit shall promptly start the emergency plan, according to the law report, and cooperate with the relevant departments to take preventive and control measures to prevent the expansion of the hazard.
Chapter III Control of Smoking in Public ****ing Places
Article 20 The local people's governments at or above the county level are responsible for organizing, coordinating, and guiding the work of tobacco control in the administrative area, and supervising the work of tobacco control in various departments and industries.
Article 21 The relevant administrative departments shall be responsible for the supervision and management of smoking control in the following public ****places in accordance with the principle of who manages and who is responsible. Where otherwise provided by laws and regulations, such provisions shall apply:
(1) The departments of education and human resources and social security shall supervise and manage the work of tobacco control in the schools under their respective jurisdiction;
(2) The departments of culture shall be responsible for supervising and managing the work of tobacco control in cultural and entertainment venues;
(3) The administrative law enforcement agencies of transportation, as well as the agencies responsible for law enforcement of the law in airports, railroads, and urban railroads shall, in accordance with their respective duties, supervise and manage the work of tobacco control in such venues. (c) Transportation administrative law enforcement agencies and agencies responsible for airport, railway and urban rail transit law enforcement in accordance with their respective responsibilities for the supervision and management of tobacco control in public **** transportation vehicles and their related public **** places;
(d) Food and drug supervision departments are responsible for the supervision and management of tobacco control in food and beverage business establishments;
(e) Public security departments are responsible for the supervision and management of tobacco control in Internet access service business establishments such as cybercafes;
(6) The commerce department is responsible for the supervision and management of tobacco control in public **** places such as shopping malls and supermarkets;
(7) The sports department is responsible for the supervision and management of tobacco control in public **** stadiums;
(8) The health department is responsible for the supervision and management of tobacco control in healthcare institutions and other public **** places stipulated in these measures. It guides the relevant departments to carry out scientific tobacco control work.
Article 22 The relevant departments, social organizations and units of public **** places shall carry out publicity and education on the hazards of smoking and tobacco control.
Radio, television, newspapers, magazines, networks and other media shall carry out smoking is harmful to health publicity.
Article 23 prohibits smoking in the following public **** places:
(1) kindergartens, primary and secondary schools, youth palaces;
(2) the indoor areas of schools other than primary and secondary schools;
(3) maternity and child health care centers (hospitals), children's hospitals;
(4) the indoor areas of other medical and health institutions;
(v) indoor areas of libraries, theaters, concert halls, exhibition halls, art galleries, museums, gymnasiums, etc.
(vi) indoor areas of offices of state organs providing public *** services;
(vii) indoor areas of shopping malls, bookstores, business halls, etc.
(viii) inside of buses, taxis, railroad vehicles, passenger ferries and other public * ** inside the transportation;
(ix) other public **** places specified by the state.
Public **** places other than the provisions of the preceding paragraph shall determine the no smoking area (room) and smoking area (room), indoor smoking area should be equipped with ventilation and exhaust facilities.
No one shall not smoke in the no-smoking places, areas (rooms).
Article 24 The units of no-smoking public ****places shall fulfill the following duties:
(1) establish a no-smoking management system, and do a good job of no-smoking publicity and education;
(2) set up a no-smoking sign and telephone number of supervisory department in a conspicuous position;
(3) shall not be set up with smoking-related appliances;
(4) Take effective measures to prevent smokers from smoking or persuade them to leave the premises. Smoking behavior that does not listen to dissuasion can be taken in a lawful manner to take evidence, and promptly report to the supervisory and management departments.
Chapter IV Health Supervision
Article 25_ In addition to sports stadiums (stadiums), public **** transport other than Category A places should be issued by the health administrative department of the public **** place health license. Public **** place health license is reviewed every two years.
Public **** place unit to change the name, legal representative or person in charge, should be applied to the original licensing health administrative department for change; change of business projects, business address, should be reapplied to the health administrative department for a health license.
Public **** place health license should be placed in a conspicuous position in the public **** place, shall not be altered, sold, transferred.
Type B establishments units should be opened within 30 days after the unit name, address, project, legal representative (or person in charge), contact person, contact phone number, etc., to the local county-level health administrative departments for the record.
Article 26 An application for a health license for a public **** place shall be submitted to the following information:
(1) health license application form;
(2) legal representative or person in charge of the identity documents;
(3) proof of legal use of the business premises;
(4) the address of the public **** place location schematic diagrams, plans and Sanitary facilities layout plan and health review and approval letter;
(e) health management system and related information;
(f) public **** place health indicators test or evaluation of qualified reports.
Article 27 The administrative department of health shall, within 20 working days from the date of acceptance of the application for a health permit, on-site inspection of health conditions, and in accordance with the statutory authority, scope, conditions and procedures for review.
Article 28 The administrative department of health shall regularly organize the public **** place of health hazards and the degree of danger for monitoring, analysis and assessment.
The administrative department of health shall, in accordance with national regulations on the implementation of health supervision of category A places quantitative grading management, and based on the quantitative results to determine the frequency of supervision.
Implementation of health supervision and quantitative grading management of premises units should be in the premises in a conspicuous position to publicize the quantitative assessment results.
Article 29 of the health administrative department shall promptly announce to the community public **** premises unit health license, health supervision and quantitative grading management information.
Article 30 The health administrative law enforcement officers shall, in accordance with the law, public **** places of health supervision and inspection, any unit or individual shall not refuse or conceal.
Article 31 The administrative department of health shall promptly report to the people's government at its own level and to the health administrative department at the next higher level upon receipt of a report on infectious diseases and public health hazards in public ****places, and shall not make false reports, late reports or concealment of such reports.
The occurrence of infectious diseases and public health hazards of public **** place or due to the relevant indicators of substandard testing, etc. may lead to outbreaks of infectious diseases, epidemics and hazards to public health of the public **** facilities or goods, the health administrative department shall promptly start the emergency response plan to dispose of.
Article 32 of the health technology service organizations shall, in accordance with the relevant provisions of the state to carry out health inspection, testing, hygienic evaluation and other work, shall not issue false reports.
Article 33 of the violation of these measures, any unit or individual has the right to report and complain.
Health administration and other departments receive reports, shall investigate and deal with according to law; does not belong to the scope of responsibilities of the department, it shall be promptly transferred to the relevant departments.
Chapter V Legal Liability
Article 34 Violation of the provisions of Article 7, Article 8, Article 9, paragraph 2, one of the following acts, by the health administrative department at or above the county level and ordered to make corrections within a specified period of time, and give a warning, may be subject to a fine of less than 1,000 yuan; if the person does not make corrections after the deadline, impose a fine of less than 2,000 yuan:
(a) not equipped with a full-time (part-time) Health management personnel;
(b) not establish the health management system and records of employees;
(c) employees who do not obtain health certificates and engaged in direct customer service;
(d) employees without health knowledge training and qualified for duty.
Article 35 violation of the provisions of Article 10, Article 11, Article 12, one of the following acts, by the health administrative department at or above the county level ordered to make corrections within a specified period of time, and give a warning, may be fined less than 2,000 yuan; if the person does not make corrections after the deadline, a fine of less than 10,000 yuan:
(a) Category B establishments, sanitary facilities and equipment do not meet the health standards or specifications;
(b) health facilities and equipment can not run normally;
(c) health facilities and equipment were removed without authorization or diverted to other uses;
(d) repeated use of disposable public **** supplies, utensils or provide supplies and utensils do not meet the requirements of health standards;
(e) health indicators do not meet the required standards or norms.
Article 36 violation of the provisions of Article 13, Article 14, Article 15, Article 16, Article 18, one of the following acts, by the health administrative department at or above the county level ordered to make corrections within a specified period of time, and give a warning, and may impose a fine of up to 2,000 yuan; overdue corrections, impose a fine of up to 20,000 yuan:
(a) centralized air-conditioning and ventilation system health indicators do not In line with national health standards or norms;
(ii) centralized air conditioning ventilation system is not set up in accordance with the provisions of the sanitary facilities;
(iii) centralized air conditioning ventilation system is not in accordance with the provisions of the regular inspection, cleaning and maintenance.
Article 37 In addition to sports stadiums (stadiums), public **** transport other than Class A venues in violation of the provisions of Article 25 of these Measures, one of the following acts, by the health administrative department at or above the county level and ordered to make corrections within a specified period of time, and give a warning, may be subject to a fine of up to RMB 10,000 yuan; if the person does not make corrections after the deadline, the fine shall be up to RMB 20,000 yuan:
(1) failure to obtain the health license for public **** premises Engaged in business activities;
(ii) alteration, resale, transfer of public **** place health license.
Article 38 Public **** places in violation of the provisions of Article 23 and Article 24 of these Measures, one of the following acts, by the relevant departments as stipulated in Article 21 of these Measures shall be ordered by the relevant departments to make corrections within a certain period of time, and shall be given a warning and may be imposed a fine of up to RMB 10,000 yuan; if the person does not make corrections after the expiration of the period of time, he or she shall be imposed a fine of up to RMB 20,000 yuan:
(1) public **** places other than those stipulated in paragraph 1 of Article 23 of these Measures do not set up smoking areas (rooms). * places are not set up smoking area (room);
(2) prohibited smoking places are not set up in accordance with the provisions of the no-smoking signs or set up smoking appliances in violation of the provisions.
Individuals who smoke in places where smoking is prohibited shall be ordered to make corrections by the relevant departments as stipulated in Article 21 of these Measures, and shall be fined not less than 50 yuan and not more than 200 yuan.
Article 39 Citizens, legal persons and other organizations who are not satisfied with the decision on administrative penalties may apply for administrative reconsideration or bring an administrative lawsuit in accordance with the law.
Chapter VI Supplementary Provisions
Article 40 The meaning of the following terms of this approach:
Health technology service organizations: refers to carry out the public *** place indoor air, drinking water, swimming pool water, lighting, lighting, noise, centralized air conditioning and ventilation system and other health indicators of the inspection, testing, evaluation and technical assessment of the health technology institutions.
Centralized air conditioning and ventilation system: refers to the room or closed space air temperature, humidity, cleanliness and air velocity and other parameters to meet the set requirements, and the air for centralized treatment, delivery, distribution of all equipment, piping and accessories, instrumentation and the sum.
Public **** bathroom: refers to the bath (including clubs, clubs, clubs set up by the bath), sauna centers (including hotels, restaurants, hotels, casinos open to the public of the sauna and water bar SPA), bathroom (including baths, bath centers), hot springs, footbaths, etc., excluding baby bath.
Barber store: refers to the use of techniques, equipment and instruments with the help of shampooing, hair care, hair coloring, perming and other products, to provide customers with hairstyling, trimming and styling, hair care and perming and dyeing and other services, including waiting, shampooing, barbering, perming and dyeing and other areas and special rooms. It does not include mobile hairdressing stalls.
Beauty store: refers to the use of techniques, instruments and equipment and with the help of make-up, beauty care products, to provide customers with non-traumatic and non-invasive skin cleansing, care, maintenance, grooming and other services, including waiting, washing, beauty, bodybuilding and other areas and special rooms.
Malls (stores), bookstores: refers to the business area of 200 square meters or more of various types of department stores, supermarkets, comprehensive or professional shopping malls (stores), bookstores and so on. Does not include farmers' markets.
Gym: refers to more than 200 square meters of various types of sports venues, fitness venues and so on.
Swimming venues: refers to the indoor and outdoor water (domain) and its facilities and equipment that can meet the needs of people for swimming fitness, training, competition, recreation and other activities. Including artificial swimming places, natural swimming pools and water recreation facilities.
Business Hall: refers to the area of 200 square meters or more of trading, service venues, including securities trading venues, banking services, communications services, etc..
Public Health Hazard Incident: refers to the public **** place of occurrence due to air quality, water quality does not meet the hygiene standards, supplies and appliances or facilities are contaminated resulting in group health damage accident.
Article 41 These Measures shall come into force on May 1, 2011 .
