The financial funds mentioned in the preceding paragraph include budgetary funds, extra-budgetary funds and government loans. Article 3 The term "government procurement" as mentioned in these Measures refers to the procurement unit's acquisition of goods, projects and services through purchase, lease, entrustment or employment. Article 4 Dalian Municipal Finance Bureau is the competent department of Dalian Municipal People's Government responsible for government procurement. Dalian Municipal Government Procurement Management Office is subordinate to the Municipal Finance Bureau, responsible for the management and supervision of the city's government procurement, and performs the following duties:
(1) Drafting government procurement policies and regulations;
(two) to guide the government procurement activities of the county (city) and District People's governments;
(3) Collecting, publishing and counting the government procurement information of this Municipality;
(four) to organize the training of government procurement personnel in this Municipality;
(five) to examine and approve the qualifications of suppliers entering the municipal government procurement market;
(six) to approve the social intermediary institutions to obtain the qualification of the municipal government procurement agency;
(seven) to determine, adjust and publish the government procurement items and quota standards included in the centralized procurement catalogue of this Municipality;
(eight) the preparation of the annual government procurement budget of municipal procurement units;
(nine) to accept complaints in the procurement of the municipal government;
(ten) to handle other matters related to government procurement.
The financial department of the county (city) and District People's governments shall be responsible for the management and supervision of government procurement at the corresponding level. Article 5 Government procurement is divided into centralized procurement and decentralized procurement.
Government procurement projects listed in the centralized procurement catalogue, large-scale government procurement projects funded by the government and other projects determined by the municipal government shall be centralized procurement.
The government procurement projects listed in the centralized procurement catalogue are proposed by the competent government procurement department and reported to the municipal government for approval.
The competent department of government procurement may entrust a unit with the conditions to undertake as a centralized procurement unit.
Other procurement projects other than centralized procurement projects shall be organized and implemented by the procurement unit in accordance with the relevant provisions of these Measures. Article 6 A procurement unit may entrust a social intermediary agency with the qualification of government procurement agency to undertake government procurement affairs.
A social intermediary institution applying for the qualification of government procurement agency shall meet the following conditions:
(a) established in accordance with the law, with legal personality;
(two) familiar with the relevant laws, regulations and policies, and the personnel who have received training in government procurement business account for more than 20% of the total number of personnel in this institution;
(3) There are a certain number of qualified professionals, among whom the professional and technical personnel with senior titles account for 60% and 20% of the total staff of the institution respectively;
(four) have the ability to use modern scientific means to complete the work of government procurement agency;
(five) other conditions stipulated by the competent department of government procurement. Article 7 Suppliers who meet the following conditions may apply for the qualification to enter the Dalian municipal government procurement market:
(1) Having the qualification of a legal person or the ability to bear civil liability independently;
(2) Abiding by national laws and regulations and having a good reputation;
(3) Having the ability to perform the procurement contract and a good performance record;
(4) Having good capital and financial status;
(five) other conditions stipulated by the competent department of government procurement. Chapter II Procurement Methods Article 8 Government procurement shall be conducted by means of open tender, invitation to tender, competitive negotiation, inquiry and single source.
Public bidding refers to the procurement unit or its entrusted social intermediary agency (hereinafter referred to as the tenderer) that invites unspecified suppliers (hereinafter referred to as bidders) to bid by means of tender announcement.
Invitation to bid procurement means that the tenderer invites more than five specific suppliers to bid in the form of invitation to bid.
Competitive negotiation procurement refers to the procurement unit directly inviting more than three suppliers to negotiate on procurement matters.
Inquiry purchase refers to the comparison of quotations provided by more than three suppliers by the purchasing unit.
Single-source procurement refers to the procurement unit purchasing directly from suppliers. Article 9 Except as stipulated in Articles 10, 11 and 12, all single or bulk procurement projects that meet the quota standards set by the municipal government shall be procured through public bidding or invitation to bid. Article 10 In case of any of the following circumstances, the procurement unit shall report to the competent government procurement department for approval, and competitive negotiation may be adopted:
(a) after the tender, there is no supplier to bid or there is no qualified target;
(two) there are unforeseen emergency procurement needs, which can not be obtained through bidding;
(3) It takes a long time to prepare the tender documents;
(four) the supplier needs high fees to prepare the tender documents;
(five) there are special requirements for high-tech content;
(six) other circumstances identified by the competent department of government procurement.
