Measures for the Implementation of the Regulations on the Administration of Medical Institutions in Jiangsu Province (2018 Revision)

Chapter I General Provisions Article 1 According to the provisions of the State Council's Regulations on the Administration of Medical Institutions (hereinafter referred to as the Regulations), combined with the actual situation in this province, the formulation of these Measures. Article 2 These Measures shall apply to Western medicine, Chinese medicine, Chinese and Western medicine combined medical institutions engaged in disease diagnosis, treatment, physical examination, massage, analgesia and other activities within the administrative area of this province, as well as institutions set up by health epidemiological prevention, state border health quarantine, medical research and teaching to carry out diagnostic and treatment activities. Article 3 medical institutions to save lives, prevention and treatment of disease, for the purpose of citizens' health services. Article 4 The people's governments at all levels shall support the development of medical institutions, encourage various forms of medical institutions. Article 5 the local people's government at or above the county level, the health administrative department and the Chinese medicine administrative department is responsible for the supervision and management of medical institutions in the administrative region.

Local people's governments at all levels of industry and commerce, public security, finance, prices, civil affairs and other relevant departments shall, in accordance with relevant laws and regulations, within their respective areas of responsibility, with the administrative departments of health and Chinese medicine, the administrative departments of the supervision and management of medical institutions. Article 6 The Chinese People's Liberation Army and the Chinese People's Armed Police in the Soviet Union troops outside the establishment of medical institutions, by the people's governments of their local health administrative departments and administrative departments of traditional Chinese medicine in accordance with the management of these measures.

The Chinese People's Liberation Army and the Chinese People's Armed Police garrison in Suzhou within the establishment of the medical institutions open to the community, reported to the people's governments of their local municipalities, counties (cities and districts) health administrative departments for the record. Chapter II set up approval Article 7 The health administrative departments of the people's governments at or above the county level shall, in accordance with the population, medical resources, medical needs, and the distribution of existing medical institutions in the administrative region, formulate a plan for the setting up of medical institutions, approved by the people's government at the same level, and then included in the local regional health development planning and urban and rural construction and development of the overall plan.

Units or individuals to set up medical institutions, must be examined and approved by the health administrative department of the local people's government at or above the county level, and obtain approval to set up medical institutions. Article VIII of the following medical institutions set up by the county (city) people's government health administrative department for approval, reported to the municipal people's government health administrative department for the record:

(1) less than 100 beds of the first level of general hospitals, less than 80 beds of the first level of traditional Chinese medicine hospitals, specialized hospitals;

(2) less than 100 beds of rehabilitation hospitals, counties (municipalities) specialized prevention and treatment hospitals (stations), county Maternal and Child Health Institute, Maternal and Child Health and Family Planning Service Center;

(3) health centers without beds or with less than 100 beds;

(4) outpatient clinics, clinics, health clinics (rooms), infirmaries and other medical institutions. Article 9 The establishment of the following medical institutions shall be approved by the health administrative department of the people's government of the city or municipal district:

(1) clinics, health centers without beds;

(2) outpatient clinics, nursing stations (hospitals);

(3) health centers with beds under the jurisdiction of districts;

(4) health centers with more than 100 beds and first-class general hospitals; first-class Chinese medicine hospitals with more than 80 beds; and first-class traditional Chinese medicine hospitals with more than 80 beds; and first-class Chinese medicine hospitals with more than 80 beds. 80 beds or more of the first level of Chinese medicine hospitals;

(e) second-level general hospitals, second-level Chinese medicine hospitals, second-level hospitals combining traditional Chinese and Western medicine, second-level specialized hospitals, second-level rehabilitation hospitals, second-level maternity and child health hospitals, municipal maternity and child health care clinics;

(f) municipal specialized prevention and treatment hospitals;

(g) convalescent hospitals, medical testing laboratories, pathological diagnostic centers, diagnostic centers of medical images

(viii) Municipal Emergency Center (station), Municipal Clinic Center;

(ix) Ministry, province, city, district organs, enterprises, institutions, outpatient clinics, clinics, clinics, health centers (rooms, stations), infirmaries and other medical institutions.

The specific approval authority of the health administrative departments of the people's governments of the cities and municipal districts for the establishment of medical institutions shall be delineated by the people's governments of the cities. Article 10 The following medical institutions set up by the provincial people's government health administrative departments for examination and approval:

(1) three-level general hospitals, three-level specialized hospitals, three-level maternity and child health care hospitals, three-level rehabilitation hospitals;

(2) the provincial specialized prevention and treatment hospitals (institutes);

(3) foreign investors set up sole proprietorships, joint ventures, cooperative medical institutions;

(4) the province of Emergency Center, the provincial clinical examination centers, hemodialysis centers and other medical institutions. Article XI three Chinese medicine hospitals, Chinese and Western medicine hospitals and specialized hospitals set up by the provincial people's government for approval of the Chinese medicine administrative department. Article XII of health epidemiological, border health quarantine, medical research, teaching and family planning institutions outside the scope of business of the institution needs to carry out diagnostic and treatment activities, by the people's government of the city, county (city) health administrative departments, in accordance with the provisions of the approval of these measures. Article XIII of the following circumstances, shall not apply for the establishment of medical institutions:

(1) units that can not independently assume civil liability;

(2) is serving a prison sentence or does not have the ability to fully civil behavior of the person;

(3) the occurrence of a second-class or above, the medical staff of medical accidents not less than five years;

(4) revoked practicing certificate of the Medical personnel;

(e) the legal representative or principal person in charge of a medical institution whose license to practice medicine has been revoked;

(f) those who have not recovered from infectious diseases of Category A or B, or who are unfit to practise medicine due to other health reasons;

(g) those who have received more than five years of administrative sanctions for moral turpitude and poor medical ethics;

(H) dismissed from public office or unauthorized personnel.
