Interim Provisions on Port Management in Shantou Special Economic Zone

Article 1 These provisions are formulated in accordance with the basic principles of the relevant laws and administrative regulations and the actual situation of the Shantou Special Economic Zone (hereinafter referred to as the Special Zone) for the purpose of strengthening the management of the ports within the Special Zone, standardizing the port operation market, safeguarding the legitimate rights and interests of the parties concerned with the ports, and promoting the development of the port business. Article 2 These provisions shall apply to the planning, construction, production, operation and management of ports within the scope of the Special Administrative Region, as well as other activities related to ports.

Where laws and regulations provide otherwise, the provisions shall apply. Article 3 The meanings of the following terms in these provisions are:

(1) Port refers to all harbor areas and planned harbor areas within the scope of the Special Administrative Region with corresponding facilities to provide berthing of ships, embarkation and disembarkation of passengers, loading and unloading of goods, storage, barging and related services, excluding military ports and fishing ports.

Article 13 The port project shall implement bidding and tendering in accordance with the relevant provisions of the state, province and city, and shall be supervised and managed by the Municipal Construction Administration in conjunction with the Port Authority. Article 14 The design, construction and supervision units of port projects shall carry out design, construction and supervision in accordance with the laws, regulations and engineering and technical standards of the state and the industry as well as the provisions of the contract. Article 15 The quality supervision of port projects shall be carried out in accordance with the relevant provisions of the state, provinces and municipalities by the port project quality supervision organization established according to the law, and shall be subject to the supervision of the municipal construction administration department. Article 16 After the completion of port projects, acceptance shall be carried out in accordance with legal procedures. After passing the acceptance, the construction unit shall submit the completion data to the port authority and go through the registration, activation or other relevant procedures of the terminal.
