The term "dust pollution" as mentioned in these Regulations refers to the pollution to the atmospheric environment caused by construction, demolition of buildings (structures), transportation and storage of materials, mining and earth borrowing, road cleaning, greening operations and other activities, as well as the particulate matter generated by bare ground. Article 3 The prevention and control of dust pollution shall follow the principles of government leading, departmental supervision, public participation and liability for damage, and implement source control, combination of prevention and control and comprehensive treatment. Fourth people's governments at all levels and relevant departments and units should strengthen the publicity and education of laws and regulations on dust pollution prevention and control, and improve the public's awareness of environmental protection and the concept of the rule of law.
The news media should actively carry out public welfare propaganda on the prevention and control of dust pollution and strengthen public opinion supervision on the prevention and control of dust pollution. Article 5 All units and individuals shall fulfill their environmental protection obligations and take effective measures to prevent and reduce dust pollution. Sixth to encourage and guide the popularization and application of new technologies, new processes and new equipment for the prevention and control of dust pollution.
Encourage and support industry associations to formulate and implement professional standards for dust pollution prevention and control, and strengthen self-discipline management. Chapter II Responsibility for Prevention and Control Article 7 The Municipal People's Government is responsible for organizing and leading the prevention and control of dust pollution in the whole city, establishing a mechanism of overall coordination, long-term management and information sharing, formulating a master plan for the prevention and control of dust pollution, studying and formulating relevant policies and measures, coordinating the prevention and control of dust pollution across regions, and incorporating the prevention and control of dust pollution into the assessment of environmental protection responsibility system.
County (city, district) people's governments shall be responsible for the prevention and control of dust pollution within their respective administrative areas, formulate specific implementation plans according to the overall planning of dust pollution prevention and control in this Municipality, and organize their implementation.
The Management Committee of Dezhou Economic and Technological Development Zone and the Management Committee of Dezhou Canal Economic Development Zone shall, with reference to the provisions of these Regulations on the people's governments of counties (cities, districts), perform their duties of preventing and controlling dust pollution in their respective regions.
Township people's governments and sub-district offices are responsible for the supervision and implementation of dust pollution prevention and control work within their respective jurisdictions, and do relevant specific work according to the arrangements of the people's governments at higher levels and relevant departments.
Villagers' committees and residents' committees shall assist in the prevention and control of dust pollution, promptly discover, discourage and report illegal acts of dust pollution, and cooperate with relevant departments to deal with them according to law. Article 8 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of dust pollution within their respective administrative areas, and coordinate and urge other relevant departments and units to perform their management duties. Responsible for the supervision and management of dust pollution prevention and control of industrial enterprises and stockyards, ready-mixed concrete and ready-mixed mortar production enterprises outside the urban built-up area. Ninth city and county (city, district) people's governments and other relevant departments shall, in accordance with the following division of responsibilities, do a good job in the supervision and management of dust pollution prevention and control:
(a) the competent department of housing and urban construction is responsible for the supervision and management of housing construction, municipal infrastructure projects and building demolition dust pollution prevention and control on state-owned land;
(II) The urban management department is responsible for the supervision and management of the prevention and control of dust pollution, such as the transportation and stacking of construction waste, sand and gravel, muck and other materials that are prone to dust pollution in urban built-up areas, municipal maintenance projects, the demolition of illegal buildings (structures) on state-owned land, the cleaning and cleaning of public places such as roads and squares, and the collection, removal and treatment of domestic garbage;
(3) The transportation department is responsible for the prevention and control of dust pollution of highways and their supporting projects, the supervision and management of highway maintenance and cleaning, highway transportation stations and highway construction;
(4) The traffic administrative department of the public security organ shall be responsible for setting the area and time when vehicles transporting materials liable to generate dust are prohibited and restricted, and investigating and handling road traffic violations according to law;
(five) the water conservancy department is responsible for the supervision and management of dust pollution prevention and control in water conservancy project construction;
(six) development and reform, natural resources, finance, commerce, agriculture and rural areas, civil air defense and other departments, according to their respective responsibilities to do a good job in the prevention and control of dust pollution. Tenth departments of the Municipal People's Government responsible for the supervision and management of dust pollution prevention and control shall, according to their respective responsibilities, formulate guidelines for the prevention and control of dust pollution and announce them to the public. Eleventh enterprises, institutions and other producers and operators shall bear the main responsibility for the prevention and control of dust pollution, prevent and reduce the damage of dust pollution to the atmospheric environment, and bear the responsibility for the damage caused by it according to law. Twelfth construction units shall comply with the following provisions:
(a) to formulate dust pollution assessment and prevention measures, and incorporate them into the environmental impact assessment documents of construction projects;
(two) according to the provisions of the standard rate of dust pollution prevention and control costs included in the project cost, and be clear in the construction contract, timely and full disbursement;
(three) clear the responsibility of the construction unit to prevent and control dust pollution, and incorporate it into the bidding documents and construction contracts;
(four) according to the construction contract, supervise the construction unit to implement the responsibility of dust pollution prevention and control.
