Chapter II of the medical and health institutions of medical waste management responsibilities Article IV medical and health institutions should establish and improve the responsibility system for the management of medical waste, its legal representative or the main person in charge of the first responsible person, to effectively fulfill their responsibilities to ensure the safe management of medical waste. Article 5 medical and health institutions shall, in accordance with relevant state laws, administrative regulations, departmental rules and normative documents, develop and implement the rules and regulations of medical waste management, workflow and requirements, the work duties of relevant personnel and the occurrence of medical waste loss, leakage, proliferation and accidents within the medical and health institutions of the emergency program. The contents include:
(1) the method of classifying and collecting medical waste at each place of generation of medical waste in medical and healthcare institutions and the requirements of work;
(2) the working system of the place of generation of medical waste in medical and healthcare institutions, the place of temporary storage, and the requirements of work of transporting medical waste from the place of generation to the place of temporary storage;
(3) the transportation and delivery of medical waste to the place of temporary storage in medical and healthcare institutions. Transportation and delivery of medical waste to the medical waste disposal unit of the relevant handover, registration requirements;
(d) medical waste management process of special operating procedures and the occurrence of medical waste loss, leakage, proliferation and emergency measures in the event of an accident;
(e) classification of medical waste collection, transportation, temporary storage process of occupational health and safety protection of the relevant staff. Article 6 medical and health institutions shall set up a monitoring department responsible for medical waste management or full-time (part-time) staff to perform the following duties:
(a) responsible for guiding and checking the implementation of medical waste classification, collection, transportation, temporary storage and disposal of medical waste in the process of the implementation of the work within the institution;
(b) responsible for guiding and checking the medical waste classification, collection, transportation, temporary storage and disposal of medical waste in the process of occupational health in the institution Occupational health and safety protection in the process of disposal within the institution;
(3) Responsible for organizing the emergency treatment of medical waste loss, leakage, proliferation and accidents;
(4) Responsible for organizing the training of medical waste management;
(5) Responsible for the management of the relevant medical waste registry and archives;
(6) Responsible for timely analysis and treatment of other problems in the management of medical waste. Article 7 medical and health institutions in the event of medical waste loss, leakage, proliferation and accidents, should be in accordance with the "Regulations on the Management of Medical Waste" and the provisions of this approach to take appropriate emergency treatment measures, and within 48 hours to the county-level people's government of the county-level administrative department of health, the competent department of environmental protection administration to report. The administrative department of health of the people's government at the county level shall summarize and report to the local provincial people's government administrative department of health on a monthly basis.
Provincial people's government health administrative departments reported to the Ministry of Health every six months after the summary. Article VIII of medical and health institutions due to improper management of medical waste caused by more than one death or more than three health damage, the need to provide medical care and on-site rescue of patients with major accidents, should be reported to the local health administrative department of the people's government at the county level within 12 hours, and in accordance with the "Regulations on the Management of Medical Wastes" and the provisions of the Measures, to take appropriate emergency treatment measures.
The competent health administrative department of the people's government at the county level shall, upon receipt of the report, report to the competent health administrative department of the people's government at the provincial level within 12 hours.
Medical and health institutions in the event of improper management of medical waste resulting in more than three deaths or more than 10 people with health damage, the need to provide medical care and on-site rescue of the causative agent of the major accidents, should be reported within two hours to the county-level people's government of the county-level administrative department of health report, and in accordance with the "Regulations on the Management of Medical Wastes" and the provisions of the Measures, to take appropriate emergency treatment measures.
The competent health administrative department of the people's government at the county level shall, upon receipt of the report, report to the competent health administrative department of the people's government at the provincial level within six hours.
After receiving the report, the competent health administrative department of the provincial people's government shall report to the Ministry of Health within six hours.
The occurrence of improper management of medical waste leading to the spread of infectious disease accidents, or evidence of infectious disease transmission of accidents are likely to occur, shall be reported in accordance with the "Prevention and Control of Infectious Diseases Act" and the relevant provisions of the report, and take appropriate measures. Article IX medical and health institutions should be based on the classification of medical waste collection, delivery, temporary storage and disposal within the institution in the process of professional and technical, occupational health and safety protection and emergency treatment of knowledge required to develop training programs for relevant staff and organization and implementation.
