Twenty-sixth the employer has one of the following acts, given a warning, ordered to make corrections within a time limit, and may impose a fine of less than 30 thousand yuan:
(a) the occupational health monitoring system has not been established or implemented;
(2) Failing to formulate occupational health monitoring plans and implement special funds in accordance with regulations;
(3) Practicing fraud and instructing others to take part in the occupational health examination as an impostor;
(4) Failing to provide the documents and materials needed for occupational health examination truthfully;
(5) Failing to take corresponding measures according to the occupational health examination;
(six) do not bear the cost of occupational health examination.
Article 27 If an employing unit commits any of the following acts, it shall be ordered to make corrections within a time limit, given a warning, and may be fined between 50,000 yuan and 654.38 million yuan:
(1) Failing to organize occupational health examination, establish occupational health monitoring files or truthfully inform the workers of the examination results;
(2) The employee fails to provide a copy of the occupational health monitoring file when he leaves the employer.
Twenty-eighth employers in any of the following circumstances, given a warning, ordered to make corrections within a time limit, overdue correction, a fine of 50 thousand yuan to 200 thousand yuan;
(1) Failing to arrange the diagnosis and treatment of occupational disease patients or suspected occupational disease patients in accordance with regulations;
(2) Concealing, forging, tampering with or destroying occupational health monitoring files and other relevant materials, or refusing to provide the information needed for the diagnosis and appraisal of occupational diseases.
Twenty-ninth employers in any of the following circumstances, shall be ordered to make rectification within a time limit, and impose a fine of 50 thousand yuan to 300 thousand yuan; If the circumstances are serious, it shall be ordered to stop the operation that causes occupational hazards, or to request the relevant people's government to order it to close down in accordance with the authority prescribed by the State Council:
(1) arranging workers who have not undergone occupational health examination to engage in operations exposed to occupational hazards;
(2) arranging underage workers to engage in operations that are exposed to occupational hazards;
(3) arranging female workers during pregnancy and lactation to engage in operations harmful to themselves, the fetus and the baby;
(4) arranging workers with occupational taboos to engage in taboo operations.
Article 30 If an employer violates the provisions of these Measures and fails to report occupational diseases or suspected occupational diseases, the safety production supervision and management department shall order it to make corrections within a time limit, give it a warning and may impose a fine of 1000 yuan; Fraud, punishable by a fine of 20 thousand yuan and 50 thousand yuan.
