Interpretation of People's Republic of China (PRC) Blood Donation Law: Article 9

Article 9 Blood stations must conduct necessary health checks for blood donors free of charge. If the physical condition does not meet the requirements for blood donation, the blood station shall explain the situation to it and shall not collect blood. The physical health conditions of blood donors shall be stipulated by the administrative department of health of the State Council.

The amount of blood collected by a blood station from a blood donor at a time is generally 200ml, which shall not exceed 400ml, and the interval between two collections shall not be less than 6 months.

It is strictly forbidden for blood stations to collect blood from blood donors in excess and frequently in violation of the provisions of the preceding paragraph.

Interpretation This article is the basic requirement of blood collection in blood stations.

Blood donation without compensation is the basic system established by this law, and it is also the glorious obligation of every citizen. Protecting the health of blood donors and the safety of blood recipients is also one of the legislative purposes of this law.

The three paragraphs of this article stipulate the principles that should be followed in blood collection in blood stations from both positive and negative aspects. First of all, blood donors must meet the health conditions stipulated by the health administrative department of the State Council. Therefore, before collecting blood, blood stations must carry out necessary health checks on blood donors in accordance with regulations, and shall not charge any fees. The so-called necessary health examination means that the blood and physical health information of blood donors can be obtained in a short time by means of blood tests, without going to medical and health institutions for a comprehensive physical examination as usual. For example, you can ask questions about the age and weight of the blood donor, what diseases you have suffered in the past, how long has it been since you donated blood last time, and so on, so as to know whether it is suitable for blood donation conditions. For those who don't meet the requirements for blood donation, such as the blood donor has not reached the prescribed age or weight, or the blood donor has suffered from some infectious diseases in the past, the blood station should patiently persuade the blood donor not to participate in blood donation, but should affirm his enthusiasm for blood donation.

Secondly, this law also stipulates the amount of blood collected by a blood station at a time, that is, generally 200 ml at a time, up to 400 ml. This regulation mainly refers to the long-term actual situation in China and the amount of blood that a healthy citizen can donate without affecting human health, and also refers to the amount of blood collected in most countries in the world. According to the situation in China, the law also stipulates that the interval between two blood samples shall not be less than 6 months. However, according to the physiological laws of human body, the life span of red blood cells has a certain time limit, and there is also a process of constant aging and death. Under normal circumstances, 40 ml of red blood cells in the blood can age and die every day, and a corresponding number of red blood cells are regenerated. The average life span of red blood cells is 120 days. Therefore, the interval between two blood donations is more than 3 months. The reason why the interval of blood donation is not less than 6 months is entirely from the perspective of protecting the health of blood donors and ensuring blood quality.

The third paragraph of this article is a prohibitive norm, that is, it will be illegal for a blood station to collect blood excessively and frequently in violation of the provisions of the previous two paragraphs. In order to protect the health and safety of blood donors and ensure the vigorous development of blood undertakings, Article 18 of this Law also stipulates corresponding legal responsibilities for acts that violate the above provisions.
