Regulations of Qinghai Province on the Protection of Minors

Chapter I General Provisions Article 1 In order to protect the physical and mental health of minors, safeguard their legitimate rights and interests, and promote their all-round moral, intellectual and physical development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Minors and other relevant laws and administrative regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to the protection of citizens under the age of 18 within the administrative area of this province. Article 3 Minors shall enjoy the rights of survival, development, education, protection and participation. The legitimate rights and interests of minors should be given special and priority protection. Article 4 Protecting minors is the common responsibility of the whole society.

Any organization or individual has the right to stop or report, complain and accuse violations against minors to the relevant departments.

The state, society, schools and families should educate and help minors to safeguard their legitimate rights and interests, enhance their awareness and ability of self-protection and enhance their sense of social responsibility. Fifth people's governments at or above the county level shall incorporate the protection of minors into the national economic and social development plan and the annual plan, and incorporate the funds for the protection of minors into the financial budget of the people's government at the corresponding level. Article 6 People's governments at or above the county level shall set up committees for the protection of minors to guide, coordinate and supervise the protection of minors.

Township (town) people's governments and sub-district offices shall determine the personnel specifically responsible for the protection of minors.

The Committee for the Protection of Minors is composed of persons in charge of the people's government at the same level and its relevant departments, people's courts, people's procuratorates and relevant social organizations. The director of the Committee shall be the person in charge of the people's government at the same level.

The offices of the Committee for the Protection of Minors are located in league organizations at all levels, staffed with full-time personnel, and are responsible for the daily work of the Committee for the Protection of Minors of the people's government at the same level. Article 7 The Committee for the Protection of Minors shall perform the following duties:

(a) to implement the laws, regulations and policies on the protection of minors, and to supervise and inspect the implementation;

(two) to formulate the development plan and annual work plan for the protection of minors;

(3) To study major issues concerning the protection of minors and put forward opinions and suggestions on the protection of minors to the people's governments at the corresponding levels and relevant departments;

(four) to accept reports, complaints and accusations of violations of the legitimate rights and interests of minors, and transfer them to the relevant authorities for investigation;

(five) investigation, research, exchange and promotion of experience in the protection of minors;

(six) to establish a joint consultation system for the protection of minors;

(seven) other work related to the protection of minors. Eighth June every year for the protection of minors publicity month. Ninth people's governments at or above the county level and relevant departments shall commend and reward organizations and individuals that have made remarkable achievements in the protection of minors. Chapter II Family Protection Article 10 Parents or other guardians shall create a good and harmonious family environment, perform their guardianship duties and support obligations for minors according to law, and protect the personal, property and other legitimate rights and interests of minors. Article 11 Parents or other guardians should accept family education guidance provided by relevant state organs and social organizations, learn correct methods of education and guardianship, and educate, influence and protect minors with healthy thoughts, good conduct and appropriate methods. Twelfth parents or other guardians shall perform the following obligations:

(a) to provide necessary living, learning and medical conditions for minors;

(two) pay attention to the physiological, psychological and behavioral habits of minors;

(three) to educate and guide minors to develop good ideological and moral character and study and living habits;

(four) to educate minors about traffic safety, electricity and gas consumption and other common sense of life safety, and enhance their awareness and ability of safety prevention;

(five) to encourage and support minors to participate in housework, social welfare activities and healthy cultural and social activities suitable for their age;

(six) other obligations stipulated by laws and regulations. Thirteenth parents or other guardians shall not have the following acts:

(a) domestic violence, abuse or abandonment of minors;

(two) infanticide and other acts of harming infants;

(3) discriminating against female minors or disabled minors;

(four) letting or forcing minors who receive compulsory education to drop out of school;

(five) forcing minors under the age of sixteen to work;

(six) allowing or forcing minors to get married, live together or enter into marriage contracts for minors;

(seven) let minors under the age of sixteen live alone without supervision;

(eight) other acts that infringe upon the legitimate rights and interests of minors or affect their physical and mental health. Fourteenth parents or other guardians shall prevent and stop the following acts of minors:

(1) Smoking and drinking;

(2) playing truant, staying out at night, running away from home, fighting, indulging in the internet and other bad behaviors;

(3) reading, watching, listening, collecting or disseminating newspapers, books, audio-visual products, electronic publications and online information that promote obscenity, pornography, murder, violence, terror and feudal superstition;

(four) theft, destruction of public property and damage to the legitimate rights and interests of others;

(five) gambling, drug abuse, prostitution and other illegal acts;

(six) other bad acts in violation of laws and regulations and social morality.
