1. The employing unit shall properly keep employee health monitoring files according to law. The employer may also formulate relevant regulations and negotiate with the employees to personally keep the occupational health monitoring files of the employees. Employee health occupational file is to check and evaluate the health status of employees, prevent possible diseases in the future, and reduce the risk of occupational diseases.
2. Legal basis: Article 36 of the Law of People's Republic of China (PRC) on the Prevention and Control of Occupational Diseases.
The employing unit shall establish occupational health monitoring files for workers and keep them properly within the prescribed time limit.
The occupational health monitoring files shall include the employees' occupational history, occupational hazard exposure history, occupational health examination results, occupational disease diagnosis and treatment and other relevant personal health information.
When leaving the employer, the laborer has the right to ask for a copy of his occupational health monitoring file, and the employer shall provide it truthfully and free of charge, and sign the copy provided.
Article 37
When an acute occupational accident occurs or may occur, the employing unit shall immediately take emergency rescue and control measures and report to the local health administrative department and relevant departments in time. After receiving the report, the health administrative department shall, jointly with relevant departments, promptly organize investigation and handling; When necessary, temporary control measures can be taken. The administrative department of health shall organize medical treatment.
For workers who have suffered or may suffer from acute occupational hazards, the employer shall promptly organize medical treatment, health examination and medical observation, and the expenses required shall be borne by the employer.
Second, which institutions can keep employee files?
According to the national policy, the personnel exchange institutions at all levels under the organization and personnel department are qualified to keep the personnel files of college graduates after employment. All kinds of private enterprises, township enterprises, Sino-foreign joint ventures and wholly-owned enterprises have no right to manage employee personnel files, and generally entrust personnel exchange institutions at all levels to manage them. Graduates can also entrust talent exchange institutions to handle personnel relations in their own names. In addition, talent exchange institutions at all levels, such as provincial talents, municipal talents and talents from all districts, are only different in their respective departments, and there is no difference in others. Enterprise personnel files are generally hosted in the labor and personnel trusteeship center, and you can go to the municipal personnel trusteeship center first. If not, you can check with the Municipal Archives Bureau when the files of bankrupt enterprises have been handed over to the Archives Bureau.
