Notice of the Fujian Provincial People's Government on Approving the Interim Provisions on the Administration of Planning and Construction of Villages and Towns in Fujian Province formulated by the Provincial Construction Committee Article 1 In order to strengthen the management and leadership of urban planning and construction and promote the healthy development of urban construction in our province, these Interim Provisions are formulated. Article 2 The scope of villages and towns mentioned in these Provisions includes towns below the county level, township governments (excluding county towns and industrial and mining areas) and villages of different sizes. Article 3 The overall planning and construction planning of townships and towns shall be organized by the local township and town people's governments, discussed and approved by the township and town people's congresses, and submitted to the people's governments at the county level for examination and approval. Village-level construction planning shall be compiled by the local villagers' committee, discussed and adopted by the villagers' congress or villagers' meeting, reviewed and agreed by the local township and town people's governments, and reported to the people's government at the county level for approval. The township construction planning within the urban planning area shall be examined by the people's government at the county level and reported to the Municipal People's government for approval. Article 4 In order to speed up the pace of urban reform and opening up and meet the needs of developing export-oriented economy, market towns, industrial communities, agriculture, forestry, animal husbandry and fishery farms in coastal open areas or developed areas of township enterprises should be incorporated into the overall planning of towns and villages. Article 5 The planning of villages and market towns shall follow the principles of adjusting measures to local conditions, combining distance with distance, facilitating production and life, rational layout, land saving, supporting construction and coordinated development, and be linked with the overall land use planning of villages and market towns. Sixth village and market town planning once approved, any unit or individual must strictly implement, shall not be arbitrarily changed. If it is really necessary to modify or change, it shall be reported to the original approval authority for approval according to the examination and approval procedures. Villages and towns that have not been planned or have not been approved must strictly control the approved construction. Seventh all localities, cities and counties should establish and improve the village construction management institutions, strengthen the village construction management power at all levels, and be equipped with certain professional technical and management personnel. Villages and towns should set up village construction management offices to be responsible for the specific management of village planning and construction. Eighth rural residential construction should be gradually incorporated into the guiding plan management channels, and towns should implement the control of residential construction land, household rights and construction area indicators. The people's governments at the county level shall, according to the actual needs of the construction of villages and towns and the macro-control level of social and economic development, issue the annual residential construction plan indicators in a comprehensive and balanced manner, and the people's governments of townships and towns shall master the use of all-inclusive and unified return. The construction of individual residential buildings in villages and towns shall be handled according to the following procedures:

1. Apply to the village (neighborhood) committee, report to the township people's government for examination and approval, and incorporate it into the annual housing plan;

2 villages and towns construction management departments and land management departments to determine the scope of construction, according to the "Fujian Province land management implementation measures" for land use approval procedures;

3 villages and towns construction management department issued a building permit before construction. Ninth villages and towns production buildings, public facilities, public welfare undertakings and collective housing construction, expansion and reconstruction projects, the construction unit according to the following procedures:

1. The village and town construction management department shall, according to the approval documents of the construction project, determine the construction address and scope together with the land management department, and delimit the planning building red line;

2. Go through the formalities for examination and approval of land use according to the Measures for the Implementation of Land Management in Fujian Province;

3 to provide design documents, land use approval documents and environmental impact assessment opinions of the environmental protection department to the village and town construction management department, and the construction can be started only after the village and town construction management department issues the construction permit. Article 10 The village construction management department shall, in accordance with the requirements of the overall planning and construction planning of villages and market towns, supervise, inspect and manage the implementation of village planning and construction in the whole process, and take measures at any time to stop acts and phenomena that violate the planning and construction. Eleventh conditional townships and towns should organize comprehensive development and supporting construction, real estate development companies should operate unified construction of rural houses or unified development of homestead, contracting infrastructure construction, building materials supply and component production. Twelfth village construction funds should be based on self-reliance, relying on economic development, expanding accumulation, self-financing, multi-channel and multi-form financing. In the construction of public facilities, whoever invests will benefit, and everyone will benefit from investment. The urban maintenance and construction tax levied by townships and towns shall be used for the construction of villages and towns. The market management fees charged by the administrative department for industry and commerce from the market towns should also be appropriately concentrated for the construction of the market towns' trade markets and small commodity markets. Thirteenth design offices of construction departments at all levels should actively undertake the planning and architectural design tasks of villages and towns in the region. Conditional counties can independently set up design rooms for village planning and construction, undertake the tasks of village survey, planning and architectural design within the planning area, and improve the standardization level of village construction. Fourteenth public buildings, production buildings with a construction area of more than 500 square meters and a span of more than 12 meters, as well as buildings with more than two floors, must be designed by certified units or adopt universal design, otherwise, no building permit will be issued and no construction will be allowed. Fifteenth rural construction teams without enterprise qualification certificate and business license shall not undertake construction projects with a construction area of more than 500 square meters and a span of more than 12 meters and buildings with more than two floors. After all the construction projects above designated size are completed, they must be accepted by the construction project quality supervision institutions at or above the county level before they can be delivered for use. Article 16 When building, rebuilding or expanding industrial projects with waste gas, waste water and waste residue in towns and villages, the "three wastes" treatment scheme must be reported to the environmental protection department at or above the county level for examination and approval, and the projects should be designed, constructed and put into operation at the same time, and projects with serious pollution transferred from cities to rural areas should not be accepted.
