Legal basis: Regulations on the Implementation of People's Republic of China (PRC) Food Safety Law.
Article 18 Food producers and business operators shall establish a food safety traceability system, and truthfully record and save information such as incoming inspection, ex-factory inspection and food sales in accordance with the provisions of the Food Safety Law to ensure food traceability.
Article 19 The principal responsible person of a food production and marketing enterprise shall be fully responsible for the food safety work of the enterprise, establish and implement the food safety responsibility system of the enterprise, and strengthen the work of supplier management, incoming goods inspection and ex-factory inspection, production and marketing process control, and food safety self-inspection. The food safety management personnel of food production and marketing enterprises shall assist the main person in charge of the enterprise to do a good job in food safety management.
Twentieth food production and marketing enterprises should strengthen the training and assessment of food safety management personnel. Food safety management personnel should master the food safety laws, regulations, standards and professional knowledge suitable for their posts, and have the ability of food safety management. The food safety supervision and administration department shall conduct random supervision and spot checks on the food safety management personnel of enterprises. The evaluation guide shall be formulated and published by the food safety supervision and administration department of the State Council.
Article 21 Where producers and operators of food and food additives entrust the production of food and food additives, they shall entrust the producers who have obtained the food production license and the food additive production license to produce, supervise their production behavior, and be responsible for the safety of the food and food additives entrusted to produce. The entrusted party shall conduct production in accordance with laws, regulations, food safety standards and contracts, be responsible for the production behavior, and accept the supervision of the entrusting party.
Twenty-second food producers and business operators shall not store substances in the list drawn up in accordance with the provisions of Article 63 of these Regulations in food production and processing places.
Article 23 Irradiated food shall comply with the national food safety standards, and shall be inspected and labeled according to the requirements of the national food safety standards.
