Legal basis: Law of People's Republic of China (PRC) on Medical Practitioners.
Article 55 If a doctor violates the provisions of this Law and commits any of the following acts in his practice, the competent health department of the people's government at or above the county level shall order him to make corrections and give him a warning; If the circumstances are serious, it shall be ordered to suspend the practice activities for more than six months and less than one year until the doctor's practice certificate is revoked:
(a) providing medical and health services or carrying out medical clinical research, failing to fulfill the obligation of informing or obtaining informed consent;
(2) refusing to give first aid to patients who need first aid, or delaying diagnosis and treatment because of irresponsibility;
(three) in case of natural disasters, accidents, public health incidents and social security incidents and other emergencies that seriously threaten people's lives and health, they do not obey the orders of the health authorities;
(4) Failing to report relevant information as required;
(five) in violation of laws, regulations, rules or professional norms, resulting in medical accidents or other serious consequences.
Article 56 If a doctor violates the provisions of this Law and commits any of the following acts in his practice, the competent health department of the people's government at or above the county level shall order him to make corrections, give him a warning, confiscate his illegal income and impose a fine of not less than 10,000 yuan but not more than 30,000 yuan; If the circumstances are serious, it shall be ordered to suspend the practice activities for more than six months and less than one year until the doctor's practice certificate is revoked:
(1) divulging the patient's privacy or personal information;
(two) issued a false medical certificate, or signed a diagnosis, treatment, epidemiological certificate or birth and death certificate without my own inspection and investigation;
(three) concealing, forging, tampering with or destroying medical records and other medical documents and related materials without authorization;
(4) Failing to use narcotic drugs, toxic drugs for medical use, psychotropic drugs and radioactive drugs in accordance with regulations;
(five) taking advantage of his position to ask for or illegally accept property or seek other illegitimate interests, or violating the norms of diagnosis and treatment, causing adverse consequences to patients;
(six) to carry out the clinical application of banned medical technology.
Article 57 If a doctor violates the provisions of this Law and fails to practice in accordance with the registered practice place, practice category and practice scope, the competent health department of the people's government at or above the county level or the competent department of traditional Chinese medicine shall order him to make corrections, give him a warning, confiscate his illegal income and impose a fine of not less than 10,000 yuan but not more than 30,000 yuan; If the circumstances are serious, it shall be ordered to suspend the practice activities for more than six months and less than one year, until the doctor's practice certificate is revoked.
