Measures of Shanghai Municipality on Supervision and Administration of Quality and Safety of Aquatic Products

Chapter I General Provisions Article 1 (Purpose and Basis)

In order to strengthen the supervision and management of the quality and safety of aquatic products, ensure the quality and safety of aquatic products, and ensure the public's health and life safety, these measures are formulated in accordance with the People's Republic of China (PRC) Food Safety Law, the People's Republic of China (PRC) Agricultural Products Quality Safety Law, the Shanghai Food Safety Regulations and other laws and regulations, and combined with the actual situation of this Municipality. Article 2 (Scope of application and definition)

These Measures shall apply to the production and operation of aquatic products and related supervision and management activities within the administrative area of this Municipality.

The term "aquatic products" as mentioned in these Measures refers to aquatic animals, plants, microorganisms and their primary products that can be eaten by human beings. Primary products refer to products that have been sorted, peeled, shelled, dried, cleaned, cut, frozen, graded and packaged, but their basic natural and chemical properties have not changed. Article 3 (Responsibilities of Producers and Operators)

Aquatic product producers and operators are responsible for the quality and safety of aquatic products produced and operated by them. Aquatic product producers and operators shall engage in production and business operations in accordance with the law, implement relevant standards for aquatic product quality and safety, accept social supervision and assume social responsibilities. Article 4 (Government Duties)

The municipal and district people's governments shall be responsible for the supervision and management of aquatic product quality and safety within their respective administrative areas, lead, organize and coordinate the supervision and management of aquatic product quality and safety and the response to aquatic product quality and safety emergencies, and establish and improve the supervision and management mechanism and information sharing mechanism for the whole process of aquatic product quality and safety.

The District People's Government shall, in accordance with the relevant provisions of the state and this Municipality, clarify the responsibilities of township people's governments and sub-district offices for the quality and safety management of aquatic products, urge and guide township people's governments and sub-district offices to do a good job in the daily work of aquatic product quality and safety, and form a joint effort. Article 5 (Responsibilities of the Food and Drug Safety Committee and its Office)

The Food and Drug Safety Committee established by the municipal and district people's governments shall perform the duties of research and deployment, overall guidance and other duties on the quality and safety of aquatic products.

The municipal and district food and drug safety committee has an office located in the market supervision department at the same level, which is responsible for the comprehensive coordination, supervision and evaluation, emergency management, etc. of aquatic product quality and safety within its jurisdiction, and undertakes the daily work of the committee in aquatic product quality and safety.

The food safety comprehensive coordination institution established by the township people's government and the subdistrict office is responsible for the comprehensive coordination of aquatic product quality and safety, hidden danger investigation, information reporting, assistance in law enforcement and publicity and education within its jurisdiction. Article 6 (Responsibilities of Departments)

The market supervision department is responsible for the supervision and management of the quality and safety of aquatic products in the wholesale and retail markets of this Municipality.

The agricultural and rural departments are responsible for the quality and safety supervision and management of aquatic products production in this city and before entering the wholesale and retail market or production and processing enterprises; At the intersection designated by the Municipal People's Government, the quarantine certificate of aquatic fingerlings shall be inspected.

The customs shall carry out inspection, quarantine, supervision and administration of import and export aquatic products according to law.

Ecological environment, health, commerce, public security, urban management and law enforcement, planning and resources departments shall, according to their respective responsibilities, do a good job in the supervision and management of the quality and safety of aquatic products. Article 7 (Information Traceability System)

This Municipality establishes a traceability system for aquatic product quality and safety information, and implements dynamic supervision and sharing of aquatic product quality and safety information. Consumers, producers and operators of aquatic products can query the traceability information of aquatic products through the Shanghai food safety information traceability platform.

The municipal market supervision department shall, jointly with the municipal agriculture, rural areas, commerce, health, customs and other departments, determine the catalogue of varieties included in the traceability management of aquatic product quality and safety information according to the consumption situation, risk degree, quality and safety status and public concern, and announce it to the public after being reported to the Municipal Food and Drug Safety Committee for approval. The variety catalogue shall be subject to dynamic management.

Aquatic product producers and operators shall timely and truthfully upload traceability information according to the variety catalogue. Encourage aquatic product producers and operators to upload relevant information about varieties outside the catalogue. Article 8 (Emergency Response Requirements)

Aquatic product producers and operators shall implement food safety accident prevention measures according to law to prevent the occurrence of food safety accidents.

In the event of public health emergencies, aquatic product producers and operators shall, in accordance with relevant requirements, do a good job in daily protection, environmental disinfection, inspection and quarantine, and emergency response. Article 9 (Encourage standardized production and operation and technological research and development)

This Municipality encourages producers, operators and social organizations of aquatic products to formulate enterprise standards or group standards that are stricter than national or local food safety standards, and carry out standardized production and operation activities.

This Municipality encourages producers and operators of aquatic products and social organizations to carry out scientific and technological research on the quality and safety of aquatic products, implement scientific quality and safety management methods, popularize advanced and safe production technologies, and promote the development and construction of aquatic products brands. Article 10 (Trade Organizations)

This Municipality encourages aquatic product producers and operators to establish or join corresponding aquatic product industry organizations independently according to law.

Aquatic products industry organizations should strengthen self-discipline education and industry management, guide members to establish the concept of green and high-quality development, establish a quality and safety management system for aquatic products, promote ecological and healthy farming, and promote standardization and branding of production and operation.
