Can a clerk be a judge?

A clerk can be a judge.

1. The clerk can be promoted to the judge if he meets the requirements of the judge.

2. Article 9 of Chapter 4 of the Judges Law of People's Republic of China (PRC) stipulates the qualifications of judges, that is, they have China nationality, have reached the age of 23, support the Constitution of People's Republic of China (PRC), have good political and professional qualities and conduct, are in good health and have legal professional knowledge.

3. Because the clerk works in the court and is familiar with the court trial workflow, if the above conditions are met, the court will generally give priority to being a judge.

4. At present, local courts generally require judges to pass the judicial examination and hold certificates.

Article 9 A judge must meet the following conditions:

(1) Having China nationality;

(2) At least 23 years old;

(3) Supporting the Constitution of People's Republic of China (PRC);

(4) Having good political and professional qualities and good conduct;

(5) Being in good health;

(6) Graduated from an institution of higher learning with a bachelor's degree in law or non-law, with legal professional knowledge, and engaged in legal work for two years, among which, he served as a judge of the Higher People's Court or the Supreme People's Court and engaged in legal work for three years; A master of law, doctor's degree or non-master of law, doctor's degree with legal professional knowledge, who has been engaged in legal work for one year and served as a judge of the Higher People's Court and the Supreme People's Court, has been engaged in legal work for two years.

Judges before the implementation of this Law who do not meet the requirements specified in Item 6 of the preceding paragraph shall receive training, and the specific measures shall be formulated by the Supreme People's Court.

If it is really difficult to apply the academic qualifications specified in Item 6 of Paragraph 1, the Supreme People's Court may, upon examination and confirmation, relax the academic qualifications of judges for a certain period of time until they graduate from institutions of higher learning with a major in law.
