Regulations of Xiangxi Tujia and Miao Autonomous Prefecture on Biodiversity Protection

Article 1 In order to protect biodiversity, promote the construction of ecological civilization, and realize the harmonious coexistence between man and nature, these Regulations are formulated in accordance with relevant laws and regulations and combined with the actual situation of this state. Article 2 These Regulations shall apply to the protection, utilization and management of biodiversity within their respective administrative areas.

The term "biodiversity" as mentioned in these Regulations refers to animals, plants, microorganisms and their genetic genes, as well as the complex ecosystem formed by them and their living environment, including three basic levels: ecosystem, species and genes.

Where laws and regulations have other provisions on biodiversity protection, those provisions shall prevail. Article 3 Biodiversity protection shall follow the principles of giving priority to protection, sustainable utilization, scientific management and benefit sharing. Article 4 State and county (city) people's governments shall be responsible for biodiversity protection within their respective administrative areas, establish an incentive mechanism combining biodiversity protection with poverty alleviation, strengthen ecological environmental protection and pollution prevention, prevent ecological damage and environmental pollution from harming biodiversity, and carry out publicity and education on biodiversity protection.

The competent department of ecological environment of the state people's government is responsible for the overall coordination and comprehensive management of biodiversity protection.

The departments of forestry, agriculture and rural areas, water conservancy, housing and urban and rural construction, natural resources and planning, health and other departments of state and county (city) people's governments shall supervise and manage biodiversity protection in accordance with the provisions of relevant laws and regulations.

Enterprises, institutions and other producers and operators should adopt green production methods to prevent and reduce the damage to biodiversity, and bear the liability for damage according to law.

The news media should publicize the laws and regulations on biodiversity protection and related protection knowledge, supervise illegal activities by public opinion, and improve the public's consciousness and participation in biodiversity protection. Article 5 The national people's government shall set up a deliberation and coordination body for biodiversity protection, which shall be responsible for the following matters:

(a) put forward suggestions on the formulation of protection management principles and policies, and carry out joint law enforcement inspection;

(two) to study the biodiversity conservation plan or action plan and establish an expert consultation mechanism;

(3) Organizing investigation and evaluation, and studying and formulating a list of biodiversity conservation;

(4) Coordinating regional cooperation. Sixth units and individuals that have made remarkable achievements in biodiversity protection shall be rewarded and commended by the state people's government. Seventh state, county (city) people's government should incorporate the content of biodiversity protection into the national economic and social development plan and the national spatial planning, organize relevant departments to prepare biodiversity protection plans or action plans, and publish them for implementation. Article 8 The people's government of the prefecture shall organize and coordinate the relevant competent departments to carry out background investigation of biodiversity resources on a regular basis, and conduct special investigation, collation and cataloguing of key areas and important biological genetic resources. Article 9 The people's government of the prefecture shall, according to the investigation results of biodiversity and key biological genetic resources, sort out and analyze data and information, establish a biological genetic resources database and information system, and publish information regularly. Article 10 The state people's government shall, on the basis of investigating biodiversity and key biological genetic resources, evaluate their threatened status, rare and endangered degree, local origin and uniqueness, development and utilization status, economic value, social value and ecological value, and formulate and publish a list of biodiversity protection, including wildlife protection, germplasm resources protection and traditional knowledge protection related to biodiversity. Article 11 The people's government of the state shall establish an evaluation and supervision mechanism for the effectiveness of biodiversity protection, conduct regular evaluation and release relevant information. Twelfth state and county (city) people's governments should establish and improve the capital investment mechanism, support biodiversity protection infrastructure and capacity building, implement the compensation system for ecological environment damage and ecological protection, and establish a biodiversity protection mechanism in which infringers are responsible and protectors are compensated.

Encourage, guide and support social funds to participate in biodiversity conservation. Article 13 The state people's government shall, according to the biodiversity conservation plan or action plan and biodiversity conservation list, organize and coordinate relevant departments to establish various nature reserves, such as nature reserves, forest parks, wetland parks, geological parks, scenic spots and original habitat protection points (districts) of germplasm resources, and implement in-situ protection.

According to the needs of protection, the establishment of botanical gardens, arboretum, seed conservation field, germplasm bank (nursery), gene bank, embryo bank and other facilities, the implementation of ex situ protection. Article 14 It is forbidden to spread, release or discard alien invasive species.

No unit or individual may introduce alien species into nature reserves without authorization. If it is really necessary to introduce it, it shall go through the examination and approval procedures according to law and conduct tests in accordance with relevant technical specifications. Fifteenth acquisition and utilization of biological genetic resources shall not endanger human health, ecological security and biodiversity, shall not cause damage to local social production and life, and shall not affect the genetic integrity of wildlife populations.

The collection, scientific research and biotechnology development of biological genetic resources should follow the principles of risk prevention, prudent development and whole process management. If the technology development is immature and the application consequences are unclear, risk management and control should be carried out by establishing an evaluation system and an early warning mechanism. Sixteenth domestic and foreign organizations or individuals shall abide by the relevant laws and regulations when collecting, purchasing, conducting field trips or carrying or mailing wildlife species out of the country; Relevant competent departments shall establish and improve the information sharing mechanism and report relevant information in a timely manner.
