Chapter I General Provisions
Article 1 In order to strengthen the management of real estate brokers, improve their professional level and standardize the order of real estate brokerage activities, these Provisions are formulated in accordance with the relevant provisions of the national vocational qualification system.
Article 2 These Provisions shall apply to persons engaged in brokerage activities such as intermediary and agency in real estate transactions.
Article 3 The State implements the professional qualification system for real estate brokers and brings it into the unified planning of the national professional and technical personnel professional qualification system. Anyone who engages in real estate brokerage activities must obtain the corresponding professional qualification certificate of real estate broker, which will take effect after registration. Persons who have not obtained professional qualification certificates shall not engage in real estate brokerage activities.
Article 4 The professional qualifications of real estate agents mentioned in these Provisions include the professional qualifications of real estate agents and the professional qualifications of real estate agent assistants.
Obtaining the qualification of real estate broker is a necessary condition for entering key positions in real estate brokerage activities and initiating the establishment of real estate brokerage institutions. Obtaining the qualification of associate real estate broker is the basic condition for engaging in real estate brokerage activities.
Article 5 The Ministry of Personnel and the Ministry of Construction are jointly responsible for the policy formulation, organization and coordination, qualification examination, registration, supervision and management of the national professional qualification system for real estate agents.
Chapter II Examination
Article 6 The qualification of real estate agents shall be subject to a unified national outline, unified proposition and unified organizational examination system, which shall be jointly organized and implemented by the Ministry of Personnel and the Ministry of Construction, and shall be held once a year in principle.
Article 7 The Ministry of Construction is responsible for compiling the outline of the qualification examination for real estate brokers. Compile examination materials and organize proposition work, and uniformly plan, organize or authorize pre-examination training for real estate brokers.
Pre-test training shall be conducted in accordance with the principle of separation of training and examination and voluntary participation.
Article 8 The Ministry of Personnel is responsible for examining and approving the subjects of the real estate broker qualification examination. Examination outline and examination questions, and organize the implementation of the examination work. Check, supervise, guide and determine the qualified standards in combination with the qualification examination of real estate agents of the Ministry of Construction.
Ninth People's Republic of China (PRC) citizens, abide by the laws and regulations of the state, obtain the qualification of associate real estate broker, and meet one of the following conditions, you can apply for the qualification examination of real estate broker:
(a) to obtain a college degree and have worked for 6 years, including 3 years in real estate brokerage business.
(two) to obtain a bachelor's degree and work for 4 years, including 2 years in real estate brokerage business.
(3) Graduated from a double bachelor's degree or postgraduate program, and worked for 3 years, including real estate brokerage business for 1 year.

Article 10 If a real estate agent passes the qualification examination, the personnel departments of all provinces, autonomous regions and municipalities directly under the Central Government shall issue the Qualification Certificate of People's Republic of China (PRC) Real Estate Agent, which is uniformly printed by the Ministry of Personnel and the Ministry of Construction. The certificate is valid nationwide.
Article 11 The qualification of practicing assistant of real estate agents shall be subject to a unified national outline, and the provinces, autonomous regions and municipalities directly under the Central Government shall propose and organize examinations.
Article 12 The Ministry of Construction is responsible for drafting the outline of qualification examination for assistant practitioners of real estate brokerage. The personnel department is responsible for examining and approving the examination outline.
The personnel departments (bureaus) of all provinces, autonomous regions and municipalities directly under the Central Government and the real estate management bureaus shall organize and implement the qualification examination for associate practitioners of real estate brokers in the region in accordance with the examination outline and relevant regulations determined by the state.
Thirteenth People's Republic of China (PRC) citizens who abide by national laws and regulations, have a high school education or above, and are willing to engage in real estate brokerage activities can sign up for the qualification examination for associate practitioners of real estate brokers.
Article 14 If a real estate broker passes the qualification examination for associate practitioners, the personnel departments of all provinces, autonomous regions and municipalities directly under the Central Government shall issue the Qualification Certificate for Associate Practitioners of People's Republic of China (PRC) Real Estate Brokers in a unified format by the Ministry of Personnel and the Ministry of Construction. The certificate is valid within the administrative area.
Chapter III Registration
Fifteenth people who have obtained the Qualification Certificate of People's Republic of China (PRC) Real Estate Agent must be registered before they can practice as registered real estate agents.
Article 16 The Ministry of Construction or its authorized institution is the registration and management institution of real estate broker qualification.
Article 17 An applicant for registration must meet the following conditions:
(1) Obtaining the qualification certificate of a real estate agent.
(2) No criminal record.
(3) Being in good health and able to persist in working as a registered real estate agent.
(4) Having passed the examination of the brokerage institution.
Article 18 If I apply for the qualification registration of a real estate agent, the hired real estate agency shall report to the real estate management departments of provinces, autonomous regions and municipalities directly under the Central Government (hereinafter referred to as provincial real estate management departments) for preliminary examination, and then report to the Ministry of Construction or its authorized department for registration. The applicant who is granted registration shall be issued the Registration Certificate of Real Estate Broker by the Ministry of Construction or its authorized registration agency.
Nineteenth personnel departments at all levels and personnel departments have the responsibility to check and supervise the registration and use of real estate broker qualifications.
Twentieth real estate broker qualification registration is generally valid for three years, three months before the expiration of the validity period, the holder should go through the formalities for re-registration at the original registration authority. In the period of validity of registration, if the practice institution is changed, the change procedures shall be handled in time.
Re-registration, in addition to complying with the provisions of Article 17 of these Provisions, must also provide proof of continuing education and participation in business training.
Twenty-first registered real estate agents in any of the following circumstances, the original registration authority to cancel the registration:
(a) do not have full capacity for civil conduct.
(2) Being subject to criminal punishment.
(three) from the real estate brokerage work for 2 consecutive years (including 2 years).

Article 22 The Ministry of Construction and the provincial real estate management departments shall regularly announce the registration and cancellation of real estate broker qualifications.
Twenty-third provincial real estate management departments or their authorized agencies are responsible for the registration and management of associate qualifications of real estate brokers. The annual registration of associate qualification of real estate agents shall be reported to the Ministry of Construction for the record.
Chapter IV Duties
Twenty-fourth real estate brokers and real estate brokers associate, in brokerage activities, must strictly abide by laws, regulations and industry management regulations, adhere to the principles of openness, fairness and impartiality, and abide by professional ethics.
Article 25 A real estate broker has the right to initiate the establishment or join a real estate brokerage institution according to law, undertake the work of key positions of the real estate brokerage institution, guide the real estate broker to assist in various brokerage businesses, conclude real estate brokerage contracts and other important business documents according to the authorization of the institution, conduct real estate brokerage business and obtain reasonable commissions.
When conducting real estate brokerage business, a real estate agent has the right to ask the client to provide information related to the transaction, pay the expenses arising from the real estate brokerage activities, and refuse to carry out the illegal instructions issued by the client.
Twenty-sixth associate real estate brokers have the right to join real estate brokerage agencies, assist real estate brokers to handle brokerage-related affairs and get reasonable remuneration.
Article 27 After registration, real estate brokers and real estate associates can only be employed by a brokerage institution and engage in brokerage activities in the name of the real estate brokerage institution, and may not engage in brokerage activities as real estate brokers, real estate associates or other brokerage institutions.
Real estate brokers and associate real estate brokers must use their professional knowledge and experience to handle or assist in handling the details of real estate transactions, disclose relevant information to clients, be honest and trustworthy, abide by contracts, complete entrusted business, keep business secrets for clients and fully protect their rights and interests.
Real estate agents and assistant real estate agents must receive continuing vocational education and constantly improve their professional level.
Twenty-eighth professional and technical ability of real estate agents:
(a) have a certain level of real estate economic theory and related economic theory, and have rich real estate professional knowledge.
(two) to master and apply the laws related to real estate brokerage business. Provisions of laws, regulations and industry management.

Chapter V Supplementary Provisions
Thirtieth before the promulgation of these provisions, people who have been engaged in real estate brokerage for a long time, have a high theoretical level and rich practical experience, can obtain the qualification of real estate broker through examination, and the specific measures shall be formulated separately by the Ministry of Construction and the Ministry of Personnel.
Thirty-first people who have passed the national unified examination and obtained the qualification certificate of real estate agents, the employer may employ economists according to the needs of the work.
Thirty-second foreigners and professionals from Hong Kong, Macao and Taiwan who are allowed to work in People's Republic of China (PRC) with the consent of the relevant state departments can also sign up for the professional qualification examination of real estate agents and apply for registration.
Thirty-third provinces, autonomous regions and municipalities directly under the central government, the personnel department (bureau) and the real estate management department shall, in accordance with the relevant provisions of the state, formulate specific measures and organize their implementation. The management measures formulated by various localities shall be reported to the Ministry of Personnel and the Ministry of Construction for the record.
Thirty-fourth these Provisions shall be interpreted by the Ministry of Personnel and the Ministry of Construction according to the division of responsibilities.
Article 35 These Provisions shall come into force as of the date of promulgation.

(1) Having obtained a college degree in pharmacy or traditional Chinese medicine, and having been engaged in pharmacy or traditional Chinese medicine for 5 years;
(two) to obtain a bachelor's degree or bachelor's degree in pharmacy or Chinese medicine, and to engage in pharmacy or Chinese medicine for 3 years;
(3) Having obtained a second bachelor's degree, graduated from a postgraduate class or a master's degree in pharmacy or traditional Chinese medicine, and worked in pharmacy or traditional Chinese medicine for 1 year;
