Measures for the administration of information disclosure in medical and health institutions
Chapter I General Principles
Article 1 In order to standardize the information disclosure of medical and health institutions, improve the level of medical and health services, and facilitate citizens, legal persons and other social organizations to obtain the service information of medical and health institutions, these Measures are formulated in accordance with the Regulations of People's Republic of China (PRC) Municipality on Information Disclosure and the Measures for the Formulation of Information Disclosure of Public Enterprises and Institutions of the General Office of the State Council.
Article 2 These Measures shall apply to medical and health institutions, including primary medical and health institutions, hospitals and professional public health institutions.
Article 3 The term "information" as mentioned in these Measures refers to information generated or obtained by medical and health institutions in the process of providing social services, and recorded and preserved in a certain form.
Article 4 Medical and health institutions shall adhere to the principles of legality and compliance, truthfulness and accuracy, convenience and practicality, and timely initiative.
Article 5 The National Health and Wellness Commission, state administration of traditional chinese medicine and the government information disclosure department of the National Bureau for Disease Control and Prevention take the lead in the supervision and management of information disclosure of medical and health institutions nationwide. The National Health and Wellness Commission, state administration of traditional chinese medicine, the National Bureau of Disease Control and Prevention and other competent departments are responsible for guiding the information disclosure of medical and health institutions in related fields.
The competent departments of health, traditional Chinese medicine and disease control of local people's governments at or above the county level shall be responsible for the supervision and management of information disclosure of medical and health institutions within their respective administrative areas.
Medical and health industry organizations should play an active role in the supervision and evaluation of information disclosure of medical and health institutions.
Chapter II Scope and Mode of Information Disclosure
Article 6 Medical and health institutions shall voluntarily disclose the following information according to their own characteristics and actual service:
(a) the basic situation of the organization and public service functions;
(two) the distribution of appraisal institutions and departments, appraisers and appraisal guidance;
(three) the service content, key disciplines and medical technology access, service process and description of this institution;
(4) Information related to public health and emergency treatment of diseases;
(five) medical insurance, prices, fees and other service information;
(six) health science publicity and education related information;
(7) Bidding information;
(eight) the construction of a clean government;
(nine) the way of consultation and complaint;
(ten) other laws, regulations and rules shall be voluntarily disclosed.
Article 7 Medical and health institutions shall not disclose the following information:
Involving state secrets;
(2) Involving commercial secrets;
(three) involving the protection of personal information of natural persons;
(4) The disclosure may endanger national security, public safety, economic safety, occupational safety, social stability and normal medical order;
(five) in violation of the "People's Republic of China (PRC) Advertising Law" and other laws and regulations, or suspected of exaggeration or false propaganda;
(six) information that is not disclosed by laws, regulations and rules.
Article 8 Relevant information such as internal management of medical and health institutions may not be made public. Where laws, regulations and rules provide otherwise, such provisions shall prevail.
Article 9 The National Health and Wellness Commission, state administration of traditional chinese medicine and the National Bureau for Disease Control and Prevention shall, in accordance with the provisions of these Measures, separately formulate the basic catalogue of information disclosure of medical and health institutions, and update and adjust it according to the actual situation. Medical and health institutions may, according to their own work needs, formulate their own information disclosure catalogue.
Article 10 The basic catalogue of information disclosure in these Measures is divided into two categories: qualification information and service information:
Qualification information refers to medical and public health service information specified by laws, regulations and rules or designated by government departments, as well as relevant qualification information obtained through licensing, examination and approval, filing and evaluation;
Service information refers to the service information that the public needs or pays attention to when medical and health institutions provide public services.
Eleventh medical and health institutions to take the initiative to disclose information, supplemented by providing consulting services.
Twelfth medical and health institutions can combine the existing conditions, take on-site consultation, website exchange platform, hotline, mobile phone client and other convenient ways to provide humanized consulting services in time to meet the public's information needs.
The information disclosure of medical and health institutions shall be subject to the supervision of the public, and if there is any dispute, it shall be well explained and communicated.
Thirteenth medical and health institutions shall, according to the actual situation, disclose the information voluntarily disclosed by one or more of the following ways:
(1) Public columns, bulletin boards, electronic display screens and touch screens in offices and service places;
(2) information desk and service desk;
(3) Personnel post identification;
(four) government portals at all levels or the portal of this institution;
(5) Internet communication platform, official WeChat account and mobile client;
(6) service manuals, convenience cards and instructions;
(seven) telephone number of consulting service;
(eight) other ways to facilitate the public to know.
Fourteenth citizens, legal persons or other organizations obtain medical service information through the consultation window set up by medical and health institutions, and medical and health institutions can charge fees for providing services such as copying and copying, and the charging standards shall be implemented in accordance with relevant regulations.
Chapter III Responsibility for Information Disclosure
Article 15 The legal representative of a legal person organization or the principal responsible person of an unincorporated organization is the first responsible person for information disclosure, and is responsible for supervising and managing the information disclosure of this medical and health institution.
Sixteenth medical and health institutions should establish and improve the information disclosure system, and make provisions on the scope and form of information disclosure, review and release, management and maintenance, consultation and response.
Medical and health institutions should make it clear that management departments or specialized personnel are responsible for the information disclosure of their own institutions.
Seventeenth medical and health institutions shall keep confidential the information to be disclosed in accordance with the Law of People's Republic of China (PRC) on Guarding State Secrets and the Law of People's Republic of China (PRC) on the Protection of Personal Information.
Eighteenth voluntary disclosure of information content changes, medical and health institutions should be adjusted within 20 working days from the date of formation or change of information.
Where laws, regulations and rules provide otherwise for the renewal period, such provisions shall prevail.
Nineteenth medical and health institutions shall regularly report the information disclosure work to the competent department.
Chapter IV Supervision and Administration
Twentieth local people's governments at or above the county level health, traditional Chinese medicine, disease control and other competent departments shall establish and improve the supervision and assessment system of information disclosure, and regularly assess and comment on the information disclosure of medical and health institutions within their jurisdiction.
Article 21 The competent departments of health, traditional Chinese medicine and disease control of local people's governments at or above the county level shall publicize and train the information disclosure work of medical and health institutions.
Article 22 If medical and health institutions fail to carry out information disclosure work in accordance with these Measures, citizens, legal persons and other social organizations may complain to the competent departments of health, traditional Chinese medicine and disease control of local people's governments at or above the county level, and the departments that accept complaints shall promptly investigate and handle them, and inform the complainant of the results.
If the investigation is true, the medical and health institutions shall make timely rectification.
Article 23 Where a medical and health institution violates the provisions of these measures, the competent departments of health, traditional Chinese medicine and disease control of the local people's government at or above the county level shall, according to the situation, urge rectification by means of interviews, etc., and relevant information shall be included in the supervision and management and business assessment records of the medical and health institution. If the circumstances are serious or cause serious consequences, the competent departments of health, traditional Chinese medicine and disease control of the local people's governments at or above the county level shall deal with them according to relevant laws and regulations.
In the name of information disclosure, those who illegally publish medical advertisements in disguised form or make exaggerated or false propaganda shall be punished by relevant functional departments in accordance with the Advertising Law of People's Republic of China (PRC) and other laws and regulations.
Where laws, regulations and rules provide otherwise, such provisions shall prevail.
Chapter V Supplementary Provisions
Twenty-fourth local people's governments at or above the county level in charge of health, traditional Chinese medicine, disease control, according to the provisions of these measures, with reference to the basic catalogue, combined with the actual work situation, formulate specific implementation details.
Twenty-fifth these Measures shall come into force as of February 6, 2022.
