Standards for setting up nurseries and kindergartens (for Trial Implementation)
Chapter I General Provisions
Article 1 In order to establish professional and standardized nursery institutions, this standard is formulated according to the Law of People's Republic of China (PRC) on the Protection of Minors and other laws and regulations and the Guiding Opinions of the General Office of the State Council on Promoting the Development of Nursery Services for Infants under 3 years old.
Article 2 Adhere to the principles of policy guidance, universal priority, safety and health, scientific standardization, territorial management and classified guidance, fully mobilize the enthusiasm of social forces, and vigorously develop child care services.
Article 3 This standard is applicable to institutions that provide full-time care, half-day care, hourly care, temporary care and other childcare services for infants under 3 years old, which are registered by relevant departments and filed by health departments.
Chapter II Setting Requirements
Article 4 The establishment of child-care institutions shall comprehensively consider the characteristics of urban and rural development, and make scientific planning and rational layout according to the level of economic and social development, the basis of work and the needs of the masses.
Article 5 Newly-built residential areas shall plan and build houses commensurate with the size of the permanent population. Old towns and built residential areas should adopt various ways to improve child care institutions to meet the needs of residents.
Article 6 The construction of urban child care institutions shall fully consider the demand for child care services for floating infants.
Seventh in the construction of comprehensive service facilities in rural communities, the construction of child care institutions should be considered as a whole.
Article 8 Support the employing units to provide welfare child care services for employees in the workplace in the form of holding them alone or jointly with other units, which can be opened to nearby residents if conditions permit.
Article 9 Encourage the establishment and improvement of child-care institutions in industrial clusters and employers with dense employment groups through various forms such as marketization, public-run and private-run, and private-run assistance.
Tenth give full play to the infant care service function of urban and rural community public service facilities, and strengthen the functional connection between community pension institutions and community service centers (stations) and community health, culture, sports and other facilities.
Chapter III Sites and Facilities
Eleventh child care institutions should have their own venues or venues with a lease term of not less than 3 years.
Article 12 The location of nursery institutions should be construction land with good natural conditions and convenient transportation, which meets the requirements of health and environmental protection, away from buildings, facilities and pollution sources harmful to the growth of infants, and meets the requirements of earthquake resistance, fire prevention and evacuation.
Article 13 The buildings of nurseries and kindergartens shall conform to the national standards and industry standards of relevant engineering construction, set up living rooms that meet the requirements of the standards, and set up service management rooms and supply rooms as needed.
Article 14 The house decoration, facilities, equipment and decorative materials of nurseries and kindergartens shall conform to the relevant national safety and quality standards and environmental protection standards, and shall be inspected and maintained regularly.
Fifteenth child care institutions should be equipped with furniture, utensils, toys, books and games that meet the age characteristics of infants, and meet the relevant national safety and quality standards and environmental protection standards.
Sixteenth child care institutions should have outdoor venues, equipped with suitable game facilities and corresponding safety protection facilities.
On the premise of ensuring safety, you can use nearby public venues and facilities.
Seventeenth child care institutions should set up safety protection facilities and equipment that meet the standards.
Chapter IV Personnel Size
Eighteenth child care institutions shall, according to the conditions of the site, reasonably determine the scale of infant care, and be equipped with comprehensive management, nursing, health care, safety and other staff.
The person in charge of a child care institution shall be responsible for the overall work, and shall have a college degree or above, have more than 3 years of experience in child care education, health and other related management, and have passed the on-the-job training of the person in charge of a child care institution.
Nurses are mainly responsible for the daily life care of infants, arranging game activities, promoting the physical and mental health of infants and developing good behavior habits. Nurses should have experience in infant care or related professional background, and have been trained in infant care and mental health knowledge.
Health care personnel should pass the health care professional knowledge training organized by maternal and child health care institutions.
Security personnel shall obtain the security guard certificate issued by the public security organ, and shall be stationed by the security company that has obtained the security service license of the public security organ.
Article 19 Nursery institutions are generally divided into three categories: infant classes (within 6-1February, 10), small kindergartens (within 12-24 months, 15) and large kindergartens (within 20 people from 24 to 36 months).

The living units of each class should be used independently.
Article 20 The ratio of nursing staff to infants shall not be lower than the following standards: infant class 1: 3, nursing class 1: 5 and nursing class 1: 7.

Article 22 An independent child care institution shall have at least 1 security personnel on duty.
Chapter V Supplementary Provisions
Twenty-third provinces, autonomous regions and municipalities directly under the central government health administrative departments can formulate specific implementation measures according to this standard.
Article 24 This standard shall come into force as of the date of promulgation.
Management standard of nurseries and kindergartens (for Trial Implementation)
Chapter I General Provisions
Article 1 In order to strengthen the management of nursery institutions, this Code is formulated in accordance with the Law of People's Republic of China (PRC) on the Protection of Minors and other laws and regulations and the Guiding Opinions of the General Office of the State Council on Promoting the Development of Nursery Services for Infants under 3 years old.
Article 2 Adhere to the principle of giving priority to children, respect the growth characteristics and laws of infants and young children, protect infants and young children to the maximum extent, and ensure their safety and health.
Article 3 This Code is applicable to institutions that provide full-time care, half-day care, hourly care, temporary care and other childcare services for infants under 3 years old, which are registered by relevant departments and filed by health departments.
Chapter II Filing Management
Article 4 After registration, the child-care institution shall file with the health department at or above the county level where the institution is located, submit the health evaluation report of the child-care institution, fire safety inspection certificate, site certificate, staff qualification certificate and other materials, and fill in the filing book (see Annex 1) and commitment letter (see Annex 2). Where catering services are provided, a food business license shall be submitted.
Article 5 The health department shall provide the filing receipt (see Annex 3) and the Notice of Basic Information of Child Care Institutions (see Annex 4) to the child care institutions that apply for filing.
Sixth child care institutions to change the record items, should go to the original filing department for the change of record.
Article 7 Where a child care institution terminates its service, it shall properly arrange the infants and staff who are under care, and go through the formalities of filing and cancellation.
Article 8 The health department shall publish policies and regulations on child care services, filing requirements of child care institutions and relevant information of child care institutions on the official website, and accept social inquiry and supervision.
Chapter III Consignment Management
Article 9 Parents or guardians of infants (hereinafter referred to as infant guardians) shall take the initiative to apply for foster care in foster care institutions, and submit the true identification materials of infants and their guardians.
Article 10 A child care institution shall sign a child care service agreement with the infant guardian, specifying the responsibilities, rights and obligations, service items, charging standards and dispute resolution methods of both parties.
Eleventh infants and young children should complete vaccination for school-age children before entering the child care institutions, and can only enter the child care institutions after passing the health examination of medical and health institutions; If you leave the institution for more than 3 months, you should re-examine your body when you come back.
Twelfth child care institutions should establish an infant information management system, timely collect and update, and regularly submit it to the filing department.
Thirteenth child care institutions should establish a system of contact with parents, hold regular meetings of parents, accept visits and consultations, and help parents understand the contents and methods of child care.
Nursery institutions shall set up parent committees, and listen to the opinions and suggestions of the parent committees on important matters related to infants and young children.
Nursery institutions should establish an open day system for parents.
Fourteenth child care institutions should strengthen contact and cooperation with the community, publicize scientific parenting knowledge to the society, and carry out various forms of service activities to promote the early development of infants and young children.
Fifteenth child care institutions should establish an information publicity system, and regularly announce the charging items and standards, conservation and care, diet and nutrition, health care, safety and security to the public. , and accept supervision.
Chapter IV Protection and Management
Sixteenth child care institutions should arrange the life of infants scientifically and reasonably, and do a good job in eating, feeding, going to the toilet, washing, cleaning, sleeping, putting on and taking off clothes, playing games and other services.
Seventeenth child care institutions should adapt to feeding, scientifically formulate recipes, and ensure the dietary balance of infants and young children. If there are special feeding needs, the guardian of the baby shall provide a written explanation.
Eighteenth child care institutions should ensure that the daily outdoor activities of infants are not less than 2 hours, which can be adjusted as appropriate in hot and cold seasons or special weather conditions.
Nineteenth child care institutions should take games as the main form of activities to promote the all-round development of infants in physical development, movement, language, cognition, emotion and sociality.
Twentieth game activities should pay attention to the emotional changes of infants and young children, pay attention to face-to-face, one-on-one communication and interaction with infants and young children, alternate dynamic and static, and reasonably match a variety of game types.
Twenty-first child care institutions should provide appropriate incentives to enrich the direct experience of infants, support their active exploration, operational experience, interactive communication and expression, give play to their autonomy and protect their curiosity.
Twenty-second foster care institutions should establish a daily record and feedback system for foster care services, and communicate with the baby guardian on a regular basis about the development of the baby.
Chapter V Health Management
Twenty-third child care institutions shall, in accordance with the relevant provisions of the health care of child care institutions, improve the relevant systems, effectively manage the health of infants and staff, and do a good job in indoor and outdoor environmental sanitation.
Twenty-fourth child care institutions should adhere to the morning check-up and all-day health observation, and notify the guardians of infants and young children in time when they find that their bodies, spirits and behaviors are abnormal.
Twenty-fifth child care institutions found that infants suffered or suspected of suffering from domestic violence, it should promptly report to the public security organs for handling according to law.
Twenty-sixth babies should be treated in the hospital or cared for at home during their illness.
Twenty-seventh child care institutions should establish sanitation and disinfection, isolation of sick children, prevention and control of infectious diseases, and do a good job in disease prevention and control and infant health management.
Twenty-eighth nursery staff should accept the health examination of medical and health institutions before taking up their posts, and they can only take up their posts after passing the examination.
Nursery institutions should organize employees to have 1 health check-ups every year. On-the-job personnel suffering from infectious diseases should leave their posts immediately for treatment; After being cured, you must hold a medical record and a health certificate issued by a medical and health institution before you can return to work.
Chapter VI Safety Management
Twenty-ninth child care institutions shall implement the main responsibility of safety management, establish and improve the safety protection measures and inspection system, and equip necessary safety personnel and physical defense facilities.
Thirtieth child care institutions should establish a perfect system of baby transport, and babies should be transported by baby guardians or adults entrusted by them.
Thirty-first child care institutions shall formulate emergency plans for major natural disasters, infectious diseases, food poisoning, stampede, fire, violence and other emergencies, and regularly conduct safety education and emergency handling capacity training for their staff.
Kindergartens should clarify the full-time and part-time fire safety management personnel and management responsibilities, strengthen the maintenance and management of fire control facilities, and ensure the safety of using fire, electricity and gas.
The staff of nurseries and kindergartens should master the basic skills of first aid and the basic methods of prevention, avoidance, escape and self-help, and must give priority to ensuring the safety of infants and young children in emergency situations.
Thirty-second foster care institutions shall establish monitoring systems for foster care services and safety. The monitoring and alarm system ensures 24-hour fortification, and the baby's living and activity areas should be fully covered.
The storage period of monitoring video data is not less than 90 days.
Chapter VII Personnel Management
Article 33 The staff of a child care institution shall have full capacity for civil conduct and good professional ethics, love infants, be physically and mentally healthy, have no record of child abuse or criminal record, and meet the qualifications required by relevant national and local regulations.
Thirty-fourth child care institutions should establish a system of pre-job training and regular training for staff, and continuously improve the professional ability, professional ethics and mental health level of staff through centralized training and online learning.
Thirty-fifth child care institutions should strengthen the education of the rule of law for their staff and enhance their awareness of the rule of law. We will have zero tolerance for child abuse and other behaviors. Once found, the responsible person and the responsible person will be investigated in strict accordance with relevant laws, regulations and provisions.
Thirty-sixth child care institutions shall sign labor contracts with staff according to law to protect the legitimate rights and interests of staff.
Chapter VIII Supervision and Administration
Thirty-seventh child care institutions should strengthen the construction of party organizations and actively support trade unions, the Communist Youth League, women's federations and other organizations to carry out activities.
Kindergarten institutions shall establish a trade union organization or a system of workers' congresses, and strengthen democratic management and supervision according to law.
Thirty-eighth child care institutions shall formulate annual work plans, report to the health department at the end of each year, and report at any time when necessary.
Thirty-ninth maternal and child health care, disease prevention and control, health supervision and other institutions at all levels shall, in accordance with their duties, strengthen professional guidance, consulting services and supervision and law enforcement of health care work in kindergartens.
Fortieth, the establishment of nursery information publicity system and quality evaluation system, the implementation of dynamic management, strengthen social supervision.
Chapter IX Supplementary Provisions
Article 41 The health administrative departments of provinces, autonomous regions and municipalities directly under the Central Government may formulate specific implementation measures in accordance with this Code.
Article 42 These Standards shall come into force as of the date of promulgation.
