Compulsory medical treatment refers to involuntary compulsory treatment, which means that in order to avoid public health crisis, the state cures patients' diseases through compulsory treatment, prevents the spread of diseases and safeguards public health interests. Article 284th of China's Criminal Procedure Law stipulates:

Mental patients who commit violent acts, endanger public safety or seriously endanger citizens' personal safety, and are not criminally responsible according to law after legal procedures, and may continue to endanger society, may be forced to receive medical treatment. The decision-making organ of compulsory medical treatment is the people's court, and the executive organ is the public security organ. Specifically, the people's court is responsible for making the decision of compulsory medical treatment, and the public security organ is responsible for compulsory execution.

Therefore, there are three statutory conditions for compulsory medical care, which must be met at the same time:

(a) violence, endangering public security or seriously endangering the personal safety of citizens;

(2) A mental patient who has been identified by legal procedures and is not criminally responsible according to law;

(three) may continue to endanger society.
