Regulations of Liaoning Province on Multiple Prevention and Resolution of Contradictions and Disputes

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with relevant laws and regulations and in light of the actual situation of this province in order to standardize the diversified work of preventing and resolving contradictions and disputes, safeguard the legitimate rights and interests of the people, maintain social harmony and stability, and promote the modernization of social governance system and governance capacity. Article 2 State organs, people's organizations, enterprises, institutions, other social organizations and citizens within the administrative area of this province shall abide by these regulations when carrying out diversified activities to prevent and resolve contradictions and disputes. Article 3 Multi-dimensional prevention and resolution of contradictions and disputes should focus on improving the social governance system of party committee leadership, government responsibility, democratic consultation, social coordination, public participation, legal protection and scientific and technological support, and establish and improve the working mechanism of reconciliation, mediation, arbitration, administrative adjudication, administrative reconsideration and litigation relief, which are mutually connected and coordinated, so as to prevent and resolve all kinds of contradictions and disputes in a timely and effective manner.

The institutions responsible for guiding the diversified prevention and resolution of contradictions and disputes should carry out the construction of diversified prevention and resolution mechanisms, perform the duties of investigation and research, organization and coordination, supervision and inspection, assessment and evaluation according to law, establish and improve a comprehensive coordination platform for diversified prevention and resolution of contradictions and disputes, and provide linkage guarantee for diversified prevention and resolution of contradictions and disputes. Article 4 Multi-dimensional prevention and resolution of contradictions and disputes shall follow the following principles:

(1) Abide by laws and regulations and respect public order and good customs;

(two) respect the will of the parties to choose the way to solve contradictions and disputes according to law;

(3) giving priority to prevention and mediation;

(4) Convenience, fairness and justice;

(five) the territorial management is responsible for the classification, and whoever is in charge is responsible;

(6) Coordination and linkage, comprehensive policy. Article 5 The people's governments of provinces, cities and counties (including county-level cities and districts, the same below) and their departments, people's courts, people's procuratorates, people's organizations and other social organizations shall, in accordance with the division of responsibilities, establish and improve mechanisms for preventing the source of contradictions and disputes, investigating and early warning, and handling them according to law, clarify that the principal responsible persons of relevant departments and units are the first responsible persons for resolving contradictions and disputes, and improve a multi-level responsibility system for preventing and resolving contradictions and disputes with full coverage, clear division of labor and coordination. Article 6 The people's governments of provinces, cities and counties shall incorporate diversified prevention and resolution of contradictions and disputes into the construction plan of a government ruled by law, strengthen the capacity building of diversified prevention and resolution of contradictions and disputes, promote the construction of diversified organizations for prevention and resolution of contradictions and disputes, and establish a diversified training mechanism for prevention and resolution of contradictions and disputes. Integrate various grassroots forces such as towns (streets) and villages (communities), carry out diversified work to prevent and resolve contradictions and disputes, and guide social forces to participate in the prevention and resolution of contradictions and disputes.

The municipal and county people's governments shall provide financial guarantee for diversified prevention and resolution of contradictions and disputes, incorporate the funds for people's mediation, labor disputes and rural land contract management disputes into the fiscal budget according to law, and give appropriate financial subsidies or subsidies to people's mediation organizations and their mediators. Seventh provincial, municipal and county people's governments and their departments should incorporate diversified prevention and resolution of contradictions and disputes into the construction of peace, and improve the cross-regional conflict risk linkage disposal mechanism and work plan; And incorporated into the leadership responsibility system and work assessment, the units and individuals that have made remarkable achievements shall be commended in accordance with relevant regulations, and the outstanding problems shall be investigated for responsibility according to laws and regulations. Article 8 State organs, people's organizations, enterprises, institutions and other social organizations shall, according to their respective responsibilities, carry out publicity and education on the rule of law, use newspapers, radio, television, internet and other media to popularize legal knowledge and publicize typical cases, enhance the people's concept of the rule of law, cultivate self-esteem, self-confidence, rationality, peace and positive social mentality, guide citizens to consciously abide by laws and regulations, respect public order and good customs, rationally express their interests according to law, resolve interest disputes and safeguard legitimate rights and interests. Chapter II Prevention at the Source Article 9 The people's governments of provinces, cities and counties and their departments, people's courts and people's procuratorates shall adhere to source governance, and prevent contradictions and disputes throughout the whole process of major decision-making, administrative law enforcement and judicial procedures, so as to reduce the occurrence of contradictions and disputes. Article 10 Provincial, municipal and county people's governments and their departments shall, in accordance with the relevant provisions of the state and the province, improve the risk assessment mechanism for major decisions, conduct social stability risk assessment and legality review on major decision-making matters involving the interests of the people, make scientific predictions, judgments and decisions according to law, and ensure that risks are controllable.

The people's governments of provinces, cities and counties and their departments shall, in light of the actual situation of their respective regions, departments and systems, formulate measures for social stability risk assessment and organize their implementation. Article 11 The people's governments of provinces, cities and counties and their departments shall improve the open system of government affairs, promote the disclosure of major decision-making processes and results, and do a good job in ideological guidance and persuasion of administrative counterparts and related people through appropriate means for management and decision-making matters closely related to the interests of the masses, such as ecological environment, food and medicine, urban management, social security, land contracting, land expropriation and real estate development; If false or incomplete information that affects or may affect social stability and disrupt social and economic management order is found, accurate government information should be released in time to clarify and prevent the occurrence of mass incidents. Article 12 The people's governments of provinces, cities and counties and their relevant departments shall make overall plans to promote the equalization of basic public services in urban and rural areas, strengthen key services for poor areas and specific groups in the fields of public education, employment and entrepreneurship, medical and health care, social services, housing security, public culture and sports, and services for the disabled, so as to provide effective social security for vulnerable groups and promote social equity.
