The old-age care institutions mentioned in the preceding paragraph refer to institutions that provide housing, life care, rehabilitation, custody and other services for the elderly. Article 3 The development of old-age care institutions shall adhere to the principle of combining government sponsorship with social sponsorship and combining government support with market promotion.
Encourage collectives, village (neighborhood) people's autonomous organizations, social organizations, enterprises and institutions, individuals and foreign investors to set up pension institutions in various forms, and donate money and materials to support the development of pension institutions. Article 4 The people's governments of cities, districts and counties (autonomous counties) shall, according to the economic and social development, the aging population and the demand for old-age care services, formulate the development plan for old-age care institutions and incorporate it into the local economic and social development plan. Fifth cities and counties (autonomous counties) civil affairs departments are responsible for the supervision and inspection of the old-age care services of the old-age care institutions within their respective administrative areas.
Development and reform, urban and rural planning, organization, industry and commerce, taxation, construction, land, finance, price, health, labor and social security departments shall, according to their respective responsibilities, do a good job in the management and development of pension institutions. Article 6 The personnel and civil affairs departments of cities, districts and counties (autonomous counties) shall commend the units or individuals that have made outstanding contributions to supporting and developing old-age care institutions. Chapter II Establishment of Institutions Article 7 The establishment of pension institutions shall go through the registration formalities in accordance with the relevant provisions of the state:
(a) the non-profit pension institutions established by using state-owned assets, the applicant shall go through the registration formalities at the registration authority of the organization;
(two) non-profit pension institutions run by non-state-owned assets, the applicant shall go through the registration formalities in the registration authority of private non-enterprise units in the place where they are held;
(3) To establish a profit-making pension institution, the applicant shall go through the registration formalities with the administrative department for industry and commerce.
Foreign investors who invest in the establishment of pension institutions shall also go through the relevant examination and approval procedures according to law. Eighth pension institutions shall, within 30 days from the date of registration, go to the local civil affairs department for the record. The following materials shall be submitted for the record:
(a) a copy of the registration certificate issued by the registration authority;
(2) Articles of association and management system;
(three) the basic situation of managers, technicians and nursing staff.
If the filing matters of the old-age care institution change, it shall be re-filed within 30 days from the date of change. Article 9 The service, management, facilities and equipment of an old-age care institution shall conform to the basic norms of social old-age welfare institutions, and its architectural design shall conform to the architectural design norms for the elderly.
If the old-age care institution meets the above two specifications, it may voluntarily apply to the civil affairs department for the certificate of the old-age care institution. The Certificate of Pension Institution shall not be transferred, leased, lent or altered. Chapter III Service Management Article 10 The clients of pension institutions are divided into adopters and convalescents.
The adopter refers to a person who has no ability to work, no source of income, and can't support (support) people, and receives old-age care services in an old-age care institution in accordance with relevant regulations.
Rest refers to people who voluntarily go to the old-age care institutions to receive old-age care services according to the contract. Article 11 Non-profit pension institutions run by state-owned assets mainly serve adopters, and can accept rest and recuperation personnel on the premise of completing the adoption task.
Non-profit pension institutions and for-profit pension institutions run by non-state-owned assets independently determine their service targets according to market demand. The government should encourage and support those who accept adoption. Article 12 An old-age care institution shall sign a service contract with the clients or their relatives, as well as the unit that puts out the children for adoption (hereinafter referred to as the person who puts them out for adoption).
The service contract shall include the following contents:
(a) the names and addresses of the parties to the contract;
(two) the content and mode of service;
(3) the time limit and place of service;
(4) charging standards and methods;
(five) the rights and obligations of both parties to the contract;
(6) Conditions for alteration, rescission and termination of the contract;
(7) Liability for breach of contract;
(8) dispute settlement methods;
(9) Other agreed matters.
The municipal civil affairs department can formulate a model text of the service contract of the old-age care institution to support the reference of the old-age care institution and the service object. Thirteenth pension institutions to carry out services shall comply with the following provisions:
(a) according to the service object's self-care ability and nursing grade standard, the implementation of graded nursing service;
(two) to develop a balanced diet for the elderly, reasonable distribution of suitable meals for the elderly. Cooking and dining for the elderly should be separated from the staff;
(three) to carry out rehabilitation activities and cultural and sports activities suitable for the characteristics of the elderly;
(four) the establishment of health records for the service object, regular physical examination, do a good job in disease prevention; For the elderly suffering from infectious diseases and mental illness after check-in, the old-age care institution shall promptly report to the relevant departments in accordance with the regulations, take necessary isolation measures, and notify the adopters to transfer them to specialized medical institutions for treatment;
(five) the establishment of night duty system, do a good job of night care for the elderly;
(six) to establish a system of sanitation and disinfection, regularly disinfect the tableware used by the elderly, regularly clean the bedding and clothing of the elderly, and keep the indoor and outdoor environment clean and tidy.
