Legal analysis: The National Health and Wellness Commission is an administrative organ. The National Health and Wellness Commission is an integral part of the State Council and has ministerial status. Make overall plans for the allocation of health resources and guide the preparation and implementation of regional health planning. Formulate and organize the implementation of policies and measures to promote the equalization, generalization and convenience of basic public health services and the extension of public resources to the grassroots. Coordinate and promote the deepening of the reform of the medical and health system, study and put forward major principles, policies and measures to deepen the reform of the medical and health system. Organize and deepen the comprehensive reform of public hospitals, promote the separation of management and operation, improve the modern hospital management system, formulate and organize the implementation of policies and measures to promote the diversification of public health service providers and delivery methods.
Legal basis: Article 7 of the Basic Medical Care and Health Promotion Law of People's Republic of China (PRC). The State Council and local people's governments at all levels lead medical care and health promotion. The competent department of health in the State Council is responsible for the overall coordination of national medical care and health promotion. Other relevant departments in the State Council are responsible for medical care and health promotion within their respective functions and duties. The health authorities of local people's governments at or above the county level shall be responsible for the overall coordination of medical care and health promotion within their respective administrative areas. Other relevant departments of the local people's governments at or above the county level shall be responsible for the relevant medical and health promotion work within the scope of their respective duties.
