Measures for the implementation of Shenzhen enterprises to recruit and transfer employees

Chapter I General Principles

Article 1 In order to standardize the recruitment of employees in enterprises in Shenzhen, actively introduce the required technical and skilled talents, and promote the economic construction and social development of our city, these Measures are formulated in accordance with the provisions of Several Opinions of Shenzhen Municipality on Strengthening and Perfecting Population Management and five supporting documents (Shenfu [2005]125).

Article 2 These Measures shall apply to the employees transferred from enterprises in this Municipality to our Municipality, except for receiving fresh graduates from full-time colleges and universities outside the city and transferring cadres as planned.

Article 3 The term "recruiting and transferring employees" as mentioned in these Measures includes recruiting and transferring workers. Those who have been employed outside Shenzhen, have a working relationship and have paid social insurance shall be handled according to job transfer, and other personnel shall be handled according to recruitment.

Article 4 The work of recruiting and transferring employees shall follow the principles of legality, openness and fairness, and accept social supervision in accordance with relevant regulations.

Article 5 The recruitment and transfer of employees shall be carried out in a unified city-wide policy, unified information management system, unified vocational skill appraisal and practical examination.

Article 6 The Shenzhen municipal labor and social security administrative department (hereinafter referred to as the municipal labor and social security department) and the district labor administrative department (hereinafter referred to as the district labor department) shall handle the relevant work of recruiting and transferring employees in our city respectively according to the principle of the division of labor and management authority between the city and the district.

Chapter II Conditions for Opening an Enterprise Account

Article 7 A legal person enterprise registered in this Municipality that meets one of the following conditions and has passed the annual industrial and commercial inspection may apply for recruiting and transferring employees to open an account:

(1) Enterprises that paid more than 50,000 yuan in tax in the previous year;

(2) Enterprises that earned more than $2 million in foreign exchange through export in the previous year;

(three) high-tech enterprises, advanced technology enterprises or enterprises with independent intellectual property rights patent products recognized by the relevant departments of the city;

(four) there are major construction projects or high-tech development projects in our city that need to recruit relevant talents.

Article 8 Enterprises or other employing units that do not meet the requirements for settlement and need to introduce employees with professional qualification certificates above senior level and special talents urgently needed by other enterprises may apply for agency introduction to the employment introduction service agencies organized by the municipal labor and social security department and the district labor department.

Chapter III Conditions for Recruiting and Transferring Employees

Article 9 A person to be recruited shall meet the following basic requirements:

(1) Having urban household registration (except as otherwise provided in Article 14 of these Measures);

(2) Having a high school education or above (if there are other provisions on academic qualifications in the Catalogue of Professional Posts for Recruiting Employees in Shenzhen published in that year, those provisions shall prevail);

(3) Age 18 years old and under 35 years old (except as otherwise provided by laws, regulations and these Measures);

(4) The occupation or specialty it is engaged in conforms to the occupation to be arranged by the employer;

(five) does not violate the provisions of the laws, regulations and relevant policies on population and family planning;

(six) did not participate in organizations and activities prohibited by the state;

(7) being in good health.

The married person to be transferred, whose spouse is a non-unemployed person, meets the requirements in Items (1), (2), (3), (6) and (7) of the preceding paragraph or meets the conditions stipulated in the relevant policies on the transfer of civil servants and staff in our city.

Article 10 The age limit may be appropriately relaxed for those who are transferred to our city by job transfer and meet one of the following conditions (if married, the age of their spouses may be relaxed accordingly):

(a) with senior professional qualifications, the age can be relaxed to 40 years old;

(two) with the professional qualification of technician or intermediate professional and technical titles, the age can be relaxed to 45 years old;

(three) with the professional qualification of senior technician, the age can be relaxed to 48 years old;

(four) with senior professional and technical titles, the age can be relaxed to 50 years old;

(five) the age of the project host who won the scientific and technological progress award in our city, Guangdong Province or above the national ministerial level can be relaxed to 50 years old;

(six) won the prize in the national first-class and second-class vocational skills competition and the skills competition organized by the national industry authorities; Won the prize in the vocational skills competition jointly organized by the labor and social security departments of Guangdong Province and Shenzhen City and related industries; The age of civilized citizens, outstanding security guards and advanced workers (producers) commended by the Shenzhen Municipal Party Committee and Municipal Government can be relaxed to 40 years old;

(seven) with a bachelor's degree or above can be relaxed to 45 years of age;

(8) The legal representatives (responsible persons), sole proprietors, natural person shareholders, partnership investors, taxpayers and individual industrial and commercial households of enterprises that meet the examination and approval conditions for investment, tax payment and transfer of households in Article 12 of these Measures may be relaxed to 50 years of age. For investors whose tax payment is more than twice the tax payment stipulated in the second paragraph of Article 12, the age may be relaxed to 55;

(9) The legal representatives and investors of enterprises that meet the examination and approval conditions in Article 13 of these Measures may be relaxed to 45 years old, but they still need to pay the over-age pension insurance premium according to the provisions of Shenfu [2003] No.56 document;

(ten) transferred to the husband and wife separation conditions, the age of the transferred personnel can be relaxed to 45 years old.

Eleventh to recruit staff now work in our city, the age can be calculated leniently. After deducting the accumulated years of participating in social endowment insurance in our city according to law, if the age does not exceed the corresponding age stipulated in the present Measures, you can apply for recruitment and transfer, but the age of the personnel to be recruited and transferred who meet the examination and approval conditions shall not exceed 48 years old. Transfer, but also according to the provisions of Shenfu [2003] No.56 to pay the over-age pension insurance.

Twelfth in accordance with the provisions of article ninth, article tenth of these measures and meet one of the following conditions, the plan indicators shall be approved:

(a) meet one of the following conditions of technical skills to recruit households:

1. It has been appraised by the municipal labor and social security department and obtained the professional qualification certificate of technician or above;

6. Possess an invention patent, obtain a national patent certificate, and invest in enterprises in this city with intellectual property rights;

7. Have senior professional and technical titles;

8. Have the intermediate title of engineering technology and have participated in Shenzhen social endowment insurance for more than 2 years;

9. Have a bachelor's degree or above, and have participated in Shenzhen social endowment insurance for more than 2 years.

(2) Tax payment for investments that meet one of the following conditions:

1. The legal representative (person in charge) of a legal person enterprise that is legally registered in our city and has paid more than 3 million yuan in the last three consecutive tax years;

2. The business owners of sole proprietorship enterprises, natural person shareholders and partnership investors of limited liability companies registered in our city according to law have shared the tax paid by enterprises in proportion to their capital contribution in the paid-in capital of enterprises for more than 600,000 yuan in recent three consecutive tax years;

3. Individuals employed in Shenzhen have paid personal income tax of more than 240,000 yuan in accordance with the law for three consecutive tax years recently;

4. Individual industrial and commercial households registered in our city according to law have paid more than 300,000 yuan in tax for three consecutive tax years recently;

The legal representative (person in charge), sole proprietor, natural person shareholder, partnership investor (partner), taxpayer and individual industrial and commercial operator of the above-mentioned enterprises must have worked in the same unit for three consecutive years and always have the qualifications suitable for the application.

(3) dependents.

Thirteenth in accordance with the provisions of article ninth, article tenth and article eleventh of these measures and meet one of the following conditions, the plan indicators shall be issued for approval:

(1) Holding the qualification certificate prescribed by the state (see Annex for the specific qualification list);

(two) by the municipal labor and social security department of vocational skills appraisal to obtain a senior vocational qualification certificate;

(three) by the municipal labor and social security departments to obtain intermediate vocational qualification certificate;

(four) organized by the Guangdong Provincial Department of Labor and Social Security and the Municipal Department of Labor and Social Security to participate in the unified examination of the Ministry of Labor and Social Security or the Guangdong Provincial Department of Labor and Social Security and obtain the vocational qualification certificate above the intermediate level;

(five) organized by the municipal labor and social security department to exchange the imported skilled workers;

(seven) technical school graduates with senior technical school education and senior vocational qualification certificate (senior technical school graduates with double certificates);

(eight) with a bachelor's degree or above (excluding fresh graduates);

(nine) with intermediate professional titles;

(ten) won the top three in the skills competition organized by the labor department of this Municipality;

(eleven) residents with permanent residence in Baoan and Longgang District for more than 5 years, whose work place and housing are in the special zone, apply for transfer to the special zone;

(12) The legal representative of a household enterprise with an individual investment of more than 2 million yuan 1 year, a registered capital of more than 2 million yuan and a position of more than 1 year;

(thirteen) the legal representative of the enterprise who has paid enterprise income tax of more than 300 thousand yuan in the last three consecutive tax years;

(14) natural person shareholders, partnership investors and sole proprietors of limited liability companies who have shared the enterprise income tax (or individual income tax) paid by the enterprise in proportion to the paid-in capital of the enterprise in the last three consecutive tax years;

(fifteen) individual industrial and commercial households registered in our city and paid personal income tax of more than 80 thousand yuan in the last three consecutive tax years;

(sixteen) with the consent of the municipal labor and social security department, the enterprise or industry organization has obtained the vocational qualification certificate above the intermediate level, or the enterprise employees who have passed the examination and publicized without objection;

(seventeen) the husband and wife are separated.

Article 14 Those who meet the conditions in Items (2), (4) and (6) of Article 12 and Article 13 of these Measures, have a higher vocational qualification certificate or above, and belong to agricultural registered permanent residence at the time of recruitment, may apply for "citizenization" procedures; Married, their spouses are not restricted by the household registration category; At the same time, their minor children can choose to live with their parents.

Chapter IV Principles for Examination and Approval of Plan Indicators

Fifteenth examination and approval plan indicators to take a comprehensive evaluation of the employer's tax situation and the personal conditions of the personnel to be transferred, the implementation of merit-based admission.

Sixteenth enterprises that actively arrange the employment of dependents and cooperate with the government to promote the employment of unemployed people with difficulties will be given index rewards.

Seventeenth for high-tech, advanced technology, various policies to support enterprises and municipal major projects (or high-tech projects), priority should be given to ensuring the recruitment of employees; Give indicators to enterprises in vegetable basket projects, public transportation, energy, infrastructure and other industries, as well as enterprises with patented products with independent intellectual property rights; Give index support to pillar industries encouraged by the government.

Article 18 simplify the procedures for recruiting and transferring employees in large enterprises, and the information such as archival materials and payment of social insurance shall be audited by the personnel department of the enterprise, and the labor and social security department shall conduct spot checks and verification; Give priority to meeting the needs of large enterprises to recruit and transfer workers, and ensure that large enterprises recruit and transfer the required skilled personnel in time.

Nineteenth for skilled personnel with special expertise and special contributions, priority can be given to the issuance of planned indicators.

Twentieth policy resettlement personnel, according to the relevant provisions of the plan.

Twenty-first to meet the conditions of examination and approval to recruit employees, and children meet the conditions of moving, the plan indicators are issued together with the children's household indicators.

Twenty-second municipal labor and social security departments and district labor departments shall give priority to the separation of husband and wife who meet the following conditions:

(1) The spouse of a person with professional qualification of technician or above;

(two) the spouse of the person who has obtained the senior professional qualification through the professional skill appraisal of the municipal labor and social security department;

(3) The spouse of a person with a doctor's degree, a master's degree, a bachelor's degree or a postgraduate degree;

(4) Spouses of persons at or above the deputy division level in institutions fully funded by local and financial authorities;

(5) Spouses of persons with professional and technical titles above the intermediate level;

(6) The spouse of an investor who has personally contributed more than 2 million yuan in the family business;

(seven) I have a senior vocational qualification or above, or have obtained an intermediate vocational qualification as recognized by the municipal labor and social security department, or have a bachelor's degree or above, or have a professional and technical title above the intermediate level.

Chapter V Enterprise Evaluation

Twenty-third enterprises or industry jobs by enterprises or industry associations to apply, reported to the municipal labor and social security department for examination and confirmation. Enterprises or industry associations may organize skill assessment, and those who pass the assessment shall be awarded the corresponding level of vocational qualification certificates by the municipal labor and social security department.

Article 24 An enterprise with a certain scale or an enterprise with industries and projects that are encouraged by the municipal government to develop urgently needed skilled talents, whose professional jobs are not included in the scope of socialized vocational skill appraisal for the time being, may apply for evaluation, which shall be organized by the enterprise after being examined and confirmed by the municipal labor and social security department, and the evaluation results shall be posted.

Article 25 Graduates from senior technical schools who work in the following enterprises and graduates from full-time colleges and universities enrolled in the national plan who have worked in Shenzhen for over 3 years (declared enterprise 1 year) and paid social insurance for over 3 years may be assessed by their enterprises in accordance with the assessment rules formulated by the municipal labor and social security department. The evaluation results should be published within the enterprise.

(a) the government announced that large enterprises enjoy convenient through train service;

(2) Enterprises directly supervised by SASAC of the city and systematic enterprises of the municipal investment holding company;

(three) enterprises in the training base of high-skilled talents recognized by the government;

(four) enterprises with harmonious labor relations recognized by the government.

Chapter VI Supervision and Management of Staff Recruitment and Transfer

Twenty-sixth municipal labor and social security departments are responsible for the unified management of the city's employees, and guide, supervise and inspect the business of the employees recruited by the labor departments in various districts.

Article 27 The municipal labor and social security department and the district labor department shall establish and improve the work system and post responsibility system for recruiting and transferring employees, handle the business of recruiting and transferring employees in accordance with the unified requirements of the whole city, and provide high-quality and efficient services for enterprises and employees.

Twenty-eighth the employer shall carefully examine the relevant materials of the employees to be recruited, and the unit manager shall go to the municipal labor and social security department and the district labor department to handle the recruitment business.

Twenty-ninth municipal labor and social security departments, district labor departments in the recruitment of employees to implement the responsibility system of signing, the signatory is the person directly responsible. The staff who violate relevant regulations shall be dealt with as follows after investigation:

(a) do not strictly review the recruitment materials, resulting in adverse consequences, to give criticism and education and removed from the audit work;

(two) involved in fraud or not in accordance with the provisions of the implementation, removed from the audit work and disciplinary action as appropriate;

(three) bribery, favoritism, investigated and dealt with according to law; If it constitutes a crime, it shall be transferred to judicial organs for handling according to law.

Article 30 The employing unit shall ensure the authenticity of the application materials, and implement the responsibility system signed by the legal representative of the enterprise (or the client), the person in charge of personnel and the person in charge of the unit in the process of examination and approval of recruiting and transferring employees. Under any of the following circumstances, the municipal labor and social security department and the district labor department shall not handle the business of recruiting and transferring employees in their own units, and suggest that the employing unit give disciplinary action to the person directly responsible, and if the case constitutes a crime, the judicial organ shall investigate the criminal responsibility according to law:

(1) Failing to handle the recruitment and transfer of employees as required;

(2) Forging or deliberately providing false materials to recruit employees;

(3) Bribery, bribery or bribery.

Thirty-first persons to be employed in any of the following circumstances shall not go through the employment procedures, and those who have been transferred shall be returned to their original units by the relevant units; If a crime is constituted, criminal responsibility shall be investigated by judicial organs according to law:

Chapter VII Supplementary Provisions

First, the recruitment procedures.

(a) the city's labor and social security system uses the online office system for recruiting and transferring employees in a unified way, and reviews the materials of recruiting and transferring employees according to unified procedures and requirements.

(2) The employing unit that opened an account in 2005 and did not violate the regulations on recruiting and transferring employees in the previous year shall go through the account opening formalities with the industrial and commercial business license that passed the annual inspection and the tax payment certificate of the previous year, and receive the Manual for Recruiting and Transferring Employees Outside Shenzhen in 2006 and the relevant policy basis for recruiting and transferring employees outside Shenzhen in 2006; The employing unit with new household registration shall provide relevant materials to handle the account opening formalities according to the account opening conditions in the implementation measures, and receive the Manual of Shenzhen Municipality for Recruiting Employees Outside the City in 2006 and the Relevant Policy Basis for Recruiting Employees Outside the City in 2006.

(four) the following employers in the special zone shall go through the recruitment procedures at the municipal labor and social security department:

1. Municipal SASAC directly supervised enterprises and municipal investment holding company system enterprises;

2. Enterprises with a registered capital of100000 yuan or more (including100000 yuan);

3. Units stationed in Shenzhen by the central government, provinces, autonomous regions and municipalities directly under the Central Government;

4. Large municipal enterprises with production bases outside the SAR but living bases in the SAR.

Employers other than the above-mentioned units in the special zone shall go through the recruitment procedures at the local labor (human resources) department.

(5) If the employing units in Baoan District and Longgang District recruit and transfer employees according to the implementation measures, they shall go to the labor department in their respective districts to handle matters related to recruiting and transferring employees.

(6) For employees who meet the examination and approval conditions, the computer will automatically issue planned indicators, and others will be locked in batches according to the principle of awarding indicators, and the examination and approval results will be published online.

(seven) the labor and social security department shall accept the personal materials of the employees to be transferred within the effective period after the plan index is issued. The employing unit shall submit the personal materials of the employees to be transferred for review within the validity period of the planned indicators.

(8) Those who have been approved to transfer their household registration shall receive the Notice of Employee Transfer or the Notice of Employment of Employees and the 2006 Shenzhen Household Registration Index Card before 65438+February 3 1, and go through the household registration transfer formalities with the public security department, and will not do so after the deadline.

Second, the index approval and reward

The municipal (district) labor and social security department implements the method of combining the placement of dependents and unemployed people with difficulties with the examination and approval of recruitment adjustment indicators, and the municipal labor and social security department carries out the examination and approval of indicators and rewards according to the following methods:

(1) Assess the basic indicators of enterprises by paying taxes: If the tax is 500,000-500,000 yuan (including 500,000 yuan), issue 1 indicator; Pay 500- 1 ten thousand yuan, and issue two indicators; If the tax payment is increased by 500,000 yuan, 1 indicator will be increased.

(2) For foreign exchange earning enterprises, the index of 1 is issued.

However, if the index is fraudulently placed, the enterprise will be cancelled and blacklisted, and the recruitment business will be suspended for three years. (4) If the employer wants to recruit people with unemployment difficulties, please register at Shenzhen Labor and Employment Service Center (address: window, 6th floor, Building 6 12, Bagua Second Road 13, 14, tel. 82 1328 165438) or recruit by yourself. After signing the contract, go to the employment service center for employment registration (address: No.4, Floor 6, Building 6 12, Tel: 82 132850), and the human resources management office of our bureau will implement the reward index according to the employment registration. Please register with the employment management office for the employment of dependents. Our bureau can directly issue resettlement tasks to units that have the ability to resettle dependents. Units that refuse to complete the task of resettling their dependents will stop handling the recruitment and job-changing business of their own units, and will be rewarded for active resettlement.

(five) through train enterprises, high-tech enterprises and other policy support enterprises can give priority to the indicators.

(6) The labor (human resources) departments of each district may, according to the specific conditions of registered enterprises in this district, formulate their own tax payment and incentive measures and implement them in this district.

Three, occupation skill appraisal and enterprise evaluation

(1) If the transferred workers need to take part in the vocational skill appraisal, the vocational skill appraisal standard shall be implemented according to the intermediate or above vocational standard promulgated by the Ministry of Labor and Social Security, and the range of positions that can be selected is generally in the Catalogue of Professional Jobs for Recruiting Workers in Shenzhen in 2006 (hereinafter referred to as the Catalogue of Professional Jobs, see Annex 1).

(II) The "occupation skill appraisal jobs" in the Catalogue of Occupation Jobs is listed as the jobs that have been recruited and transferred this year and the occupation skill appraisal has been carried out in our city, and the marked grade is the starting grade that meets the conditions of recruitment and transfer. For details of the schedule and requirements of skill appraisal, please refer to the Notice on Announcing the Schedule of Shenzhen Vocational Skill Appraisal Examination in 2006 (Shen Lao She [2005] 170).

(three) enterprises that meet the conditions of self-organization evaluation shall be implemented in accordance with the relevant provisions of our bureau.

(4) An enterprise applying to organize enterprise evaluation according to Article 24 of the Implementation Measures shall generally have a registered capital of 5 million yuan, more than 100 employees and a tax payment of more than 500,000 yuan.
