Regulations of Fuzhou Municipality on Home Care for the Aged

Chapter I General Provisions Article 1 In order to meet the needs of the elderly at home and improve their quality of life, these Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Fujian Province on the Protection of the Rights and Interests of the Elderly and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the home-based aged care service and its supervision and management within the administrative area of this Municipality. Article 3 The term "home care service" as mentioned in these Regulations refers to a model of home care service that relies on urban and rural communities (villages), the government provides basic public services, enterprises, institutions and social organizations provide professional services, and grassroots mass autonomous organizations and volunteers provide public welfare mutual assistance services to meet the needs of the elderly at home. Article 4 Home-based care for the elderly should be guided by the service needs of the elderly at home, and adhere to the principles of government leadership, family responsibility, social participation, basic security, moderate universal benefit, voluntary choice and convenience nearby. Fifth home care services mainly include the following contents:

(1) Life care services such as short-term foster care, day care, meal assistance, cleaning assistance, bath assistance, travel assistance, and purchasing and paying on behalf of others;

(two) health management, disease prevention, medical rehabilitation and other medical and health services;

(three) spiritual comfort services such as caring visits, life companionship and emotional counseling;

(4) Emergency rescue service;

(five) legal advice and legal aid services;

(six) cultural entertainment, physical fitness, knowledge lectures and other services that are beneficial to the physical and mental health of the elderly. Article 6 The people's governments of cities and counties (cities, districts) shall perform the following duties:

(a) the home care service work into the regional national economic and social development plan and the government's annual work plan;

(two) to establish a financial security mechanism that is compatible with the aging population and the level of economic and social development;

(3) Incorporate the land for the construction of home care service facilities into the national spatial planning, and make overall plans for the construction of home care service facilities;

(four) to strengthen the overall coordination of home care services, improve the policy of home care services, clarify the responsibilities of relevant departments, and strengthen supervision, inspection and assessment;

(five) to cultivate the aged care service industry, improve the support policies, encourage and guide social forces to participate in the work of home-based aged care services;

(six) other home care services related work. Seventh city and county (city, district) civil affairs department is the competent department of home care services, responsible for the guidance, supervision and management of home care services.

City, county (city, district) health authorities are responsible for the guidance, supervision and management of medical and health services for the elderly at home.

Development and reform, finance, human resources and social security, medical security, natural resources and planning, urban and rural construction, housing security and real estate management, market supervision and management, emergency management and other departments. Should be in accordance with their respective responsibilities, do a good job in home care services.

Trade unions, Communist Youth League, women's federations, disabled persons' federations and other people's organizations shall, within the scope of their respective functions and duties, assist in the work of home-based care for the aged. Article 8 Township (town) people's governments and sub-district offices shall perform the following duties:

(a) to coordinate and implement the work of home-based aged care services within its jurisdiction;

(two) the management of home care service facilities;

(3) Organize regular visits to elderly people who live alone, are widowed and have difficulties at home;

(four) to guide villagers' committees, residents' committees, enterprises, social organizations and individuals to carry out home care services, and to assist in supervision and management;

(five) other duties as prescribed by the people's government of the city or county (city or district). Article 9 Villagers' committees and residents' committees shall be responsible for the following work:

(a) to register the basic information of the elderly, investigate the service needs of the elderly, collect opinions and suggestions, and publicize the policy of home-based care for the elderly;

(two) to assist the township (town) people's government, street offices to do a good job in the operation, maintenance and management of home care service facilities;

(three) to assist in the establishment of grassroots associations for the elderly, social organizations for the elderly, and volunteer service teams for the elderly, and to organize activities such as mutual assistance, recreation and sports, and volunteer service for the elderly;

(four) to guide the villagers and residents to perform their maintenance obligations according to law;

(five) other home care services related work. Article 10 Children of the elderly and other persons who have the obligation to support and support according to law shall fulfill their obligations of financial assistance, life care, medical care and spiritual comfort to the elderly and take care of their special needs.

Advocate family members to live with the elderly or live nearby. Article 11 The people's governments of cities and counties (cities, districts) and their relevant departments shall make use of radio, television, newspapers and the Internet to increase the publicity of home-based aged care services, and combine the Double Ninth Festival and other festivals to carry forward the excellent traditional culture of respecting and supporting the elderly and establish a social fashion of respecting and helping the elderly. Chapter II Facilities Planning and Construction Article 12 Municipal and county (city, district) departments in charge of civil affairs, resources and planning, development and reform, urban and rural construction, etc. Should organize the preparation of urban and rural communities (villages) special planning for old-age service facilities, and organize the implementation after the approval of the people's government at the same level. The special planning of the old-age service facilities shall be incorporated into the detailed planning in time to guarantee it.
