Regulations of Kunming Municipality on the Protection of the Rights and Interests of the Elderly

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly and the Regulations of Yunnan Province on the Protection of the Rights and Interests of the Elderly in light of the actual situation of this Municipality in order to protect the legitimate rights and interests of the elderly and promote the traditional virtues and social customs of respecting, loving and helping the elderly. Article 2 These Regulations shall apply to activities to safeguard the rights and interests of the elderly within the administrative area of this Municipality. Article 3 The lawful rights and interests of the elderly are protected by law. Discrimination, insult, abuse or abandonment of the elderly are prohibited.

The elderly should abide by social morality and fulfill their obligations stipulated by laws and regulations. Article 4 The protection of the rights and interests of the elderly shall adhere to the principles of government-led, social participation and universal care, realize the goals of providing the elderly with a sense of security, medical care, learning, doing something and enjoying themselves, and promote the all-round development of the cause of the elderly. Article 5 The cause for the aged belongs to social public welfare undertakings, and the development of the cause for the aged is the common responsibility of the whole society.

The people's governments of cities and counties (cities, districts) shall formulate the development plan for the cause of aging in their respective administrative areas, incorporate the funds needed for the development of the cause of aging into the financial budget of the government at the same level, and increase the investment in the cause of aging year by year.

Advocate and encourage all sectors of society to provide voluntary services for the elderly and set up pension industries. Those who donate to the cause of aging shall enjoy preferential tax reduction and exemption according to law. Article 6 People's governments at all levels and their relevant departments shall organize various forms of activities to respect the elderly, and commend and reward units, organizations, families and individuals that have safeguarded the legitimate rights and interests of the elderly and made remarkable achievements in the work of aging. Article 7 Every year, September of the lunar calendar is the month of respecting the elderly, and the ninth day of the ninth lunar month is the day of respecting the elderly. Chapter II Organizational Guarantee Article 8 People's governments at all levels shall strengthen the leadership, organization and coordination of the protection of the rights and interests of the elderly, establish and improve organizations for the aged, and promote the development of the cause for the aged. Article 9 The working departments of the people's governments at all levels are the competent departments in charge of aging work and perform the following duties:

(a) to implement the laws, regulations and policies related to the work of aging, formulate the development plan and annual plan for the cause of aging in this area and organize their implementation;

(two) to guide, coordinate, inspect and urge the relevant departments to do a good job in protecting the legitimate rights and interests of the elderly;

(3) Organizing and coordinating activities such as culture, education, entertainment, sports, psychological consultation and medical treatment for the elderly, and guiding mass organizations for the elderly;

(four) to organize publicity, investigation, statistics and theoretical research on the work of aging;

(five) standardize and supervise the old-age service industry set up by social forces;

(six) training the elderly staff, organizing and guiding volunteers to carry out service activities for the elderly;

(seven) the issuance of preferential cards and subsidies for the elderly;

(eight) other duties as prescribed by laws and regulations. Tenth judicial organs, procuratorial organs, social organizations, enterprises and institutions shall do a good job in protecting the legitimate rights and interests of the elderly. Eleventh township (town) people's government, neighborhood offices and village (neighborhood) committees shall publicize the laws, regulations, principles and policies on aging work and implement the tasks of aging work. Twelfth organizations for the elderly established according to law shall serve the elderly in accordance with the articles of association. Chapter III Social Security Article 13 People's governments at all levels shall establish and improve the social security system for the elderly, implement urban and rural overall planning, improve the basic old-age security system, and ensure the basic livelihood of the elderly.

The basic pension and basic medical treatment enjoyed by the elderly according to law should be guaranteed. Fourteenth people's governments at all levels should increase investment in medical treatment, rehabilitation, health care and other facilities for the elderly, and gradually establish hospitals or geriatric specialties for the elderly.

County (city, district) health administrative departments shall guide and urge medical institutions to do a good job in medical care for the elderly and establish health records for the elderly. Encourage medical institutions to carry out free clinic activities for the elderly. Support social forces to set up hospitals or medical rehabilitation centers for the elderly. Fifteenth people's governments at all levels should bring the assistance to the poor elderly into the urban and rural social assistance system.

People's governments at all levels and their relevant departments should give priority to the poor elderly and key dependents who enjoy the minimum living guarantee into the scope of low-rent housing security. Sixteenth people's governments at all levels shall, in accordance with the relevant provisions, give preferential treatment to organizations or institutions established by social forces to serve the elderly.

Township (town) people's governments and sub-district offices shall organize village (neighborhood) committees and communities to carry out various forms of activities focusing on home-based care for the aged.

Advocate and encourage enterprises, institutions and rural collective economic organizations to use their idle houses, venues and facilities to carry out activities or services for the elderly. Seventeenth elderly people to the "Yunnan province elderly card" or "retirement card" to the relevant departments to go through the formalities, free to take public transport in the city. Eighteenth elderly people holding the "Yunnan province elderly card" or "retirement card", can enjoy the following preferential services:

(1) Free admission to parks, tourist attractions, scenic spots, museums, art galleries, science and technology museums, memorial halls, memorial buildings for martyrs, former residences of celebrities, public libraries and cultural centers (stations and palaces) in this Municipality; Belonging to individual and private enterprises, preferential prices shall be provided;

(two) give priority to medical treatment, medicine, payment, and free of ordinary registration fees;

(three) give priority to the purchase of bus tickets, train tickets, boat tickets and plane tickets, and give priority to boarding (ship) and boarding;

(4) giving priority to the development of bank savings business;

(five) public stadiums and theaters should provide preferential treatment for the elderly to carry out cultural and sports activities;

(6) Free use of public toilets.
