Prevention and control measures of atmospheric particulate pollution in Jiangsu Province

Chapter I General Provisions Article 1 In order to prevent and control atmospheric particulate pollution, focus on solving the problem of atmospheric fine particulate pollution, improve air quality and safeguard human health, these measures are formulated in accordance with the Law of People's Republic of China (PRC) on the Prevention and Control of Air Pollution and in light of the actual situation of this province. Article 2 These Measures shall apply to the prevention and control of atmospheric particulate pollution and related supervision and management activities within the administrative area of this province. Article 3 The prevention and control of atmospheric particulate pollution shall adhere to the principles of giving priority to prevention, combining prevention with control and comprehensive treatment, focusing on the prevention and control of dust generated during construction, material stacking and transportation, strengthening the prevention and control of industrial dust pollution, controlling motor vehicle exhaust pollution, actively promoting the comprehensive utilization of straw, and reducing the total amount of atmospheric particulate emissions. Article 4 Units and individuals that discharge atmospheric particulate matter are responsible subjects for pollution prevention and control.

The local people's governments at or above the county level should strengthen the organization and leadership of the prevention and control of atmospheric particulate pollution, increase investment in the prevention and control of atmospheric particulate pollution, establish a joint meeting system, improve the system and mechanism of the prevention and control of atmospheric particulate pollution, promote the joint prevention and control of regional air pollution, implement the management of environmental air quality reaching the standard, and improve the quality of the atmospheric environment. Article 5 The competent administrative department of environmental protection of the local people's governments at or above the county level shall be responsible for the supervision and management of the prevention and control of industrial smoke pollution, implement unified supervision and management of the prevention and control of motor vehicle exhaust pollution, strengthen air quality monitoring, and release environmental air quality information.

Departments of housing and urban and rural construction, planning, city appearance and environmental sanitation, urban landscaping and other departments of local people's governments at or above the county level shall, according to their respective functions and duties, supervise and manage the prevention and control of dust pollution caused by urban road dust, greening and maintenance, housing construction and municipal infrastructure, and material stacking, loading and unloading and transportation, and be responsible for the planning, construction and management of muck disposal sites.

The traffic (port) administrative department of the local people's government at or above the county level shall be responsible for the supervision and management of traffic engineering construction, the prevention and control of dust pollution caused by the stacking and loading and unloading of materials in port terminals and traffic engineering, and the implementation of industry supervision on motor vehicle maintenance and inspection of operating vehicles.

The administrative departments of agriculture and water of local people's governments at or above the county level are respectively responsible for the supervision and management of the construction of agriculture and water conservancy projects and the prevention and control of dust pollution caused by material stacking and loading and unloading.

The departments of development and reform, economy and informatization, public security, land and resources, commerce, price, quality and technical supervision of local people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the supervision and management of the prevention and control of atmospheric particulate pollution.

Township (town) people's governments (street offices, development zones, industrial parks) shall define personnel, organize and supervise the implementation of measures for the prevention and control of atmospheric particulate pollution. Article 6 Local people's governments at or above the county level and their relevant departments shall intensify information disclosure, organize the release of information such as urban ambient air quality and unfavorable meteorological conditions forecast, establish an expert demonstration and public consultation system for major problems of atmospheric particulate pollution, and protect citizens' right to know and participate. Seventh local people's governments at or above the county level and their relevant departments shall organize publicity and education on the prevention and control of atmospheric particulate pollution, and enhance the consciousness of the whole society to consciously protect the atmospheric environment.

Encourage the public to report all kinds of atmospheric particulate pollution. Upon verification, the relevant departments of the local people's governments at or above the county level shall give awards. Chapter II Prevention and Control of Pollution Article 8 The prevention and control of air pollution is divided into key control areas and general control areas, and differentiated management and control requirements are implemented. Districts and cities along the Yangtze River (Nanjing, Wuxi, Changzhou, Suzhou, Nantong, Yangzhou, Zhenjiang and Taizhou) are the key control areas, while other districts and cities (Xuzhou, Huai 'an, Lianyungang, Yancheng and Suqian) are the general control areas. Ninth local people's governments at or above the county level shall promote the adjustment of industrial structure, eliminate backward production processes and equipment, improve the level of prevention and control of atmospheric particulate pollution, and reduce the total amount of industrial smoke and dust emissions. The key control areas strictly limit high-pollution projects in thermal power, steel, cement and other industries. Tenth new construction, expansion and reconstruction projects that discharge particulate matter into the atmosphere shall abide by the provisions of the state on environmental protection management of construction projects and actively implement the environmental supervision system. Encourage and guide the construction unit to entrust the environmental supervision unit to supervise the design and construction of atmospheric particulate pollution prevention and control facilities. Article 11 Industrial enterprises that discharge smoke and dust into the atmosphere shall take effective pollution prevention and control measures to ensure that pollutants meet the standards.

Effective measures such as sealing, dust absorption and dust removal should be taken in smoke production and material transportation, so that unorganized discharge can be turned into organized discharge up to standard. Twelfth steel, thermal power, building materials and other key industries for the prevention and control of atmospheric particulate pollution shall, in accordance with the relevant provisions of the state and the province, upgrade high-efficiency dust removal technology to ensure that smoke and dust emissions meet relevant standards. Thirteenth ports, construction sites and material storage sites of iron and steel, thermal power, building materials and other enterprises should be hardened as required, and measures such as closing, fencing, covering, spraying, greening and setting up wind and dust suppression nets should be taken. If the loading and unloading materials can be closed, they should be closed to avoid dust. Large coal yards and material stacking places should be equipped with closed silos and conveying devices.

The exit of the construction site and the material stacking place should be hardened and equipped with vehicle cleaning facilities, and the transport vehicles can only be driven out of the workplace after being cleaned. The management personnel of the construction unit and the material stacking place shall clean and wash the road at the exit in time, and there shall be no obvious soil marks on the road surface, and encourage the mechanical cleaning (washing) of the entrance and exit.
