Rights and obligations of guardians of the elderly

Legal analysis: Guardianship is both a right and an obligation. The guardian has the right to protect the health of the ward, take care of the ward's life, manage and protect the ward's property, conduct civil activities on behalf of the ward, manage and educate the ward, and conduct litigation on behalf of the ward. Guardians exercise their guardianship rights according to law, and no organization or individual has the right to interfere.

Legal basis: Article 26 of the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the elderly with full capacity for civil conduct may be determined by their close relatives or other individuals and organizations who are close to them and are willing to assume guardianship responsibilities through consultation. When the elderly lose or partially lose their capacity for civil conduct, the guardian shall bear the guardianship responsibility according to law. If the elderly have not determined their guardians in advance, they shall determine their guardians in accordance with the provisions of relevant laws when they lose or partially lose their capacity for civil conduct.
