Chapter V Supplementary Provisions Education Supervision includes the following contents:

(a) the people's governments at or above the county level shall supervise the people's governments at lower levels to implement education laws, regulations, rules and national education policies;

(2) The local people's governments at or above the county level shall supervise the education and teaching work of schools and other educational institutions (hereinafter referred to as schools) within their respective administrative areas.

Article 3 The implementation of educational supervision shall adhere to the following principles:

(a) focus on improving the quality of education and teaching;

(two) follow the laws of education;

(three) abide by the provisions of education laws, regulations, rules and national education policies;

(4) Pay equal attention to the supervision of the government's education-related duties and the supervision of school education and teaching, and pay equal attention to supervision and guidance;

(5) Seeking truth from facts, being objective and fair.

Article 4 the State Council educational supervision institutions shall undertake the national educational supervision work, formulate basic guidelines for educational supervision, and guide the local educational supervision work.

The institutions responsible for educational supervision of local people's governments at or above the county level shall undertake the work of implementing educational supervision within their respective administrative areas.

Educational supervision institutions in the State Council and institutions in charge of educational supervision of local people's governments at or above the county level (hereinafter referred to as educational supervision institutions) independently exercise their supervision functions under the leadership of the people's governments at the corresponding levels.

Fifth people's governments at or above the county level shall include the funds for educational supervision in the fiscal budget. Article 6 The State practices the system of supervision.

The people's governments at or above the county level shall, according to the needs of educational supervision, provide full-time inspectors for educational supervision institutions. Educational supervision institutions may employ part-time inspectors according to the needs of educational supervision.

The term of office of part-time inspectors is 3 years, with no more than 3 consecutive terms.

Article 7 special inspector shall meet the following conditions:

(a) adhere to the party's basic line and love the cause of socialist education;

(two) familiar with education laws, regulations, rules and national education policies, with the corresponding professional knowledge and professional ability;

(three) adhere to the principle of fairness, honesty and self-discipline;

(four) with a bachelor's degree or above, engaged in education management, teaching or educational research 10 years or more, with outstanding work performance;

(5) Strong organization and coordination ability and expression ability;

(6) Being in good health and competent for educational supervision.

Those who meet the conditions specified in the preceding paragraph may be appointed as inspectors by the people's governments at or above the county level, or be appointed as inspectors by educational supervision institutions.

Eighth inspectors are appointed by the educational supervision institutions to carry out educational supervision.

Educational supervision institutions shall strengthen the management of educational supervision activities of inspectors, and assess the performance of their duties as inspectors.

Ninth inspectors in the implementation of educational supervision, should objectively and fairly reflect the actual situation, and may not conceal or fabricate facts.

Article 10 The inspector who conducts supervision is a close relative of the principal responsible person of the supervised unit or has other circumstances that may affect the objective and fair implementation of educational supervision, and shall withdraw. Eleventh educational supervision institutions shall carry out educational supervision on the following matters:

(a) the implementation of school quality education, education and teaching level, education and teaching management and other education and teaching work;

(2) the construction of principals, the construction and implementation of management systems such as teachers' qualifications, positions and appointments, the management of enrollment and student status and the quality of education, the construction and implementation of school safety and health system, the security of school buildings, the provision and use of teaching and living facilities and equipment, and the management and use of education investment;

(three) the popularization level and balanced development of compulsory education, and the planning, layout and coordinated development of all kinds of education at all levels;

(four) other matters stipulated by laws, regulations, rules and national education policies.

Twelfth education supervision institutions to implement education supervision, can exercise the following functions and powers:

(a) to consult and copy the financial accounts and other documents and materials related to the supervision matters;

(two) to require the supervised unit to explain the relevant issues of supervision matters;

(three) to carry out investigations on issues related to supervision matters;

(four) to the relevant people's government or the competent department to give rewards and punishments to the supervised unit or its relevant person in charge.

The supervised unit and its staff shall actively cooperate with the work of educational supervision institutions according to law, and shall not refuse or obstruct.

Article 13 The institutions responsible for education supervision of the people's governments at the county level shall, according to the layout of schools within their respective administrative areas, set up areas of responsibility for education supervision, and assign inspectors to regularly supervise the education and teaching work of schools within the areas of responsibility.

Educational supervision institutions may, according to the needs of educational development or the requirements of the people's government at the corresponding level, conduct special supervision on one or several matters specified in Article 11 of these regulations for the supervised units, or conduct comprehensive supervision on all matters specified in Article 11 of these regulations for the supervised units.

Fourteenth inspectors to implement regular supervision of schools in the area of responsibility, not less than 2 times per semester.

The people's governments at or above the county level shall conduct at least one special inspection or comprehensive inspection of the people's governments at the next lower level every five years; The institutions responsible for education supervision of the people's governments at the county level shall conduct a comprehensive supervision of schools within their respective administrative areas every 3 to 5 years.

Fifteenth regular supervision, inspectors shall submit a report to the educational supervision institutions; If it is found that illegal school running or endangering the safety of teachers and students, it shall promptly urge schools and relevant departments to deal with it.

Sixteenth education supervision institutions to implement special supervision or comprehensive supervision, should determine the supervision matters in advance, set up a supervision team. The steering group consists of more than 3 inspectors.

Education supervision institutions may, according to needs, jointly implement special supervision or comprehensive supervision with relevant departments, and may also hire relevant professionals to participate in special supervision or comprehensive supervision activities.

Seventeenth education supervision institutions to implement special supervision or comprehensive supervision, it shall issue a written notice of supervision to the supervised unit in advance.

Eighteenth educational supervision institutions may require the supervised units to organize self-evaluation. The supervised unit shall conduct self-assessment according to the requirements and submit the self-assessment report to the educational supervision institution. The steering group shall review the self-evaluation report of the supervised unit.

The supervision team shall conduct on-site inspection of the supervised units.

Nineteenth educational supervision institutions to implement special supervision or comprehensive supervision, it should solicit the opinions of the public on the supervised units, and take the form of holding seminars or other forms to listen to the opinions of students and their parents and teachers.

Twentieth the steering group shall evaluate the self-evaluation report, on-site inspection and public opinions of the supervised units, and form preliminary supervision opinions.

The supervision team will feedback the preliminary supervision opinions to the supervised unit; The supervised unit may defend itself.

Twenty-first educational supervision institutions shall, according to the preliminary supervision opinions of the supervision team, comprehensively analyze the defense opinions of the supervised units and issue supervision opinions to the supervised units.

The supervision opinions shall make an objective and fair evaluation of the supervised units on the supervision matters; For the existing problems, we should put forward the requirements and suggestions for rectification within a time limit.

Twenty-second supervised units shall make rectification according to the supervision opinions, and report the rectification to the educational supervision institutions.

Educational supervision institutions shall verify the rectification of the supervised units.

Twenty-third special supervision or comprehensive supervision, education supervision institutions shall submit supervision reports to the people's government at the same level; The institutions in charge of educational supervision of local people's governments at or above the county level shall also report the supervision report to the educational supervision institutions of the people's governments at the next higher level for the record.

The supervision report shall be announced to the public.

Twenty-fourth people's governments at or above the county level or the relevant competent departments shall take the supervision report as an important basis for the assessment, reward and punishment of the supervised units and their main responsible persons. Twenty-fifth supervised units and their staff in any of the following circumstances, the education supervision institutions informed criticism and ordered to make corrections; Refuses to correct or the circumstances are serious, the directly responsible person in charge and other responsible personnel, by the education supervision institutions to the relevant people's government or the competent department to give punishment suggestions:

(a) refusing or obstructing the educational supervision institutions or inspectors to carry out educational supervision according to law;

(two) concealing the truth, practicing fraud and deceiving educational supervision institutions or inspectors;

(3) Failing to make rectification according to the supervision opinions and reporting the rectification to the education supervision institution;

(four) take revenge on inspectors;

(five) there are other circumstances that seriously hinder the educational supervision institutions or inspectors from performing their duties according to law.

Twenty-sixth inspectors or educational supervision institutions staff in any of the following circumstances, by the educational supervision institutions to give criticism and education; If the circumstances are serious, he shall be punished according to law, and the appointment or appointment of his inspector shall be cancelled; If the case constitutes a crime, criminal responsibility shall be investigated according to law:

Dereliction of duty, delaying supervision;

(two) fraud, favoritism, affecting the fairness of the supervision results;

(three) abuse of power, interfere with the normal work of the supervised unit.

Inspectors who violate the provisions of Article 10 of these regulations and should be avoided but not avoided shall be criticized and educated by educational supervision institutions.

Inspectors who, in violation of the provisions of Article 15 of these regulations, find illegal school-running behaviors or endanger the safety of teachers and students, and do not promptly urge schools and relevant departments to deal with them, shall be criticized and educated by educational supervision institutions; If the circumstances are serious, he shall be punished according to law, and the appointment or appointment shall be cancelled; If a crime is constituted, criminal responsibility shall be investigated according to law.
