School buses for primary school students shall be designed and manufactured in accordance with the national standards for special school buses. The special school bus shall be painted with colors and appearance signs that meet the national standards. Article 4 School buses are divided into class line (overtime) school buses and chartered school buses.
(1) Class line school bus refers to the school bus mode in which buses run on urban and rural roads according to fixed lines, times, stops and shifts, including direct school buses and ordinary school buses. Overtime school bus is a supplementary form of class line school bus. When the school bus on the class line cannot meet the needs or operate normally, the school bus will be temporarily added or deployed according to the line and site operation mode of the school bus on the class line.
(2) School bus charter refers to the school bus operation mode in which school bus service providers charter school buses for the purpose of transporting students, provide driving services, drive according to the agreed starting place, destination and route, and charge according to the mileage or charter time and pay the fees uniformly. Article 5 The municipal, district and county people's governments shall establish a coordination mechanism for school bus safety management, coordinate major issues in school bus safety management, and do a good job in school bus safety management.
The district and county people's governments shall take overall responsibility for school bus safety management within their respective jurisdictions, and uniformly lead, organize and coordinate relevant departments to perform school bus safety management responsibilities. Article 6 The administrative department of transportation shall be responsible for the operation and management of school buses; Participate in the formulation and implementation of school bus service plan; Responsible for the examination of school bus application; Supervise and urge automobile maintenance enterprises to implement the school bus maintenance quality guarantee period system.
The education administrative department is responsible for the acceptance, issuance, examination and submission of school bus license applications; Participate in the formulation and implementation of school bus service plan; Guide and supervise schools to establish and improve the school bus safety management system, implement school bus safety management responsibilities, and organize schools to carry out traffic safety education and school bus safety accident emergency response drills.
The traffic administrative department of the public security organ shall cooperate with the administrative department of education to organize schools to carry out traffic safety education; Participate in the formulation and implementation of school bus service plan; Put forward opinions on the application for school bus license according to law, and be responsible for the issuance and recycling of school bus signs; Responsible for the acceptance, review and identification of school bus driving qualification applications; Responsible for the supervision and inspection of school bus operation, maintain the school bus traffic order, and investigate and deal with traffic safety violations involving school buses according to law.
The administrative departments of development and reform, market supervision, industry and information, finance, auditing, emergency response and health shall perform the duties of school bus safety management in accordance with relevant regulations. Chapter II Administration of the Use of School Bus Article 7 Permission shall be obtained for the use of school buses. The school bus license shall be obtained in accordance with the regulations on the safety management of school buses.
In accordance with the provisions of laws and regulations, the road transport business license shall be obtained, and the relevant formalities shall be handled at the traffic administrative department. Article 8 Road passenger transport enterprises, urban public transport enterprises and school bus operating units established in accordance with the provisions of the municipal, district and county people's governments may provide school bus services. Ninth schools and school bus service providers to apply for school bus license, shall submit a written application to the district and county education administrative departments and provide relevant materials. The written application shall specify the school that intends to use the school bus, the person in charge of safety management, the driver of the school bus, and the driving route, running time, stops, number of students, caretakers and other related matters of the school bus.
The administrative department of education shall, within three working days from the date of receiving the application materials, send it to the traffic administrative department at the same level and the traffic administrative department of the public security organ for comments, and the traffic administrative department and the traffic administrative department of the public security organ shall give a reply within three working days. The administrative department of education shall, within 5 working days from the date of receiving the reply, put forward the audit opinions and report them to the people's government at the corresponding level. If the people's government at the corresponding level decides to approve, the traffic administrative department of the public security organ shall issue school bus signs and endorse the type and number of school buses on the motor vehicle driving license; If it is not approved, it shall explain the reasons in writing. Tenth school bus signs shall specify the owner, driver, license plate number, number of passengers, running time, driving route, stops along the way, issuing units, validity period and other matters. Eleventh vehicles that have obtained school bus signs shall be equipped with unified school bus sign lights and parking signs.
If the school bus does not carry students on the road, it is not allowed to use school bus signs, school bus signs and stop signs. Twelfth prohibit the use of vehicles without school bus signs to provide school bus services. Thirteenth school buses should conduct a motor vehicle safety technical inspection every six months. Fourteenth school buses should be equipped with safety equipment such as seat belts, escape hammers, dry powder fire extinguishers and first aid kits. Safety equipment should be placed in a convenient location, and ensure good performance and effective application.
