The term "quality inspection" as mentioned in these Regulations refers to the activities of quality inspection institutions to determine the characteristics, performance and status of the inspected objects or whether they meet the relevant standards in accordance with the prescribed technical procedures and methods. Third units and individuals engaged in quality inspection, supervision and management within the administrative area of this province shall abide by these regulations. Article 4 Quality inspection shall follow the principles of independence, objectivity, impartiality and good faith.
No unit or individual may interfere with the normal inspection activities of quality inspection institutions and personnel. Article 5 The market supervision and administration department of the people's government at or above the county level shall be responsible for the supervision and administration of quality inspection within their respective administrative areas.
The administrative departments of development and reform, transportation, housing and urban and rural construction, natural resources, agriculture and rural areas, water conservancy, health, public security, judicial administration, ecological environment and meteorology of the people's governments at or above the county level shall, within their respective functions and duties, do a good job in quality inspection supervision and management. Sixth provincial market supervision and management departments are responsible for the metrological certification of quality inspection institutions in the province.
Provincial administrative departments in charge of transportation, housing and urban and rural construction, natural resources, agriculture and rural areas, water conservancy, health, public security, judicial administration, market supervision and management, ecological environment, meteorology, etc. shall be responsible for the qualification confirmation of relevant quality inspection institutions in accordance with the provisions of relevant laws and regulations. Seventh to encourage quality inspection institutions to adopt advanced technology, implement scientific quality management methods to engage in quality inspection.
The relevant administrative departments shall commend and reward the quality inspection institutions and individuals that have made remarkable achievements in quality inspection. Chapter II Quality Inspection Institutions Article 8 All administrative departments shall establish, authorize or confirm quality inspection institutions in accordance with the provisions of relevant laws and regulations.
Social intermediary institutions engaged in quality inspection shall be established in accordance with legal procedures. Ninth provincial market supervision and management departments in conjunction with the relevant administrative departments shall, in accordance with the principles of unified planning, scientific layout, making full use of existing inspection resources and improving the overall inspection ability, reasonably set up, authorize or confirm quality inspection institutions.
The relevant administrative departments shall solicit the opinions of the provincial market supervision and management departments when establishing, authorizing or confirming quality inspection institutions according to law. Tenth quality inspection institutions that issue notarized data and results to the society shall pass the metrological certification examination by the provincial market supervision and management departments and obtain the metrological certification certificate.
Inspection institutions that have not obtained metrological certification certificates shall not issue notarized data and results to the society. Article 11 An inspection institution applying for metrological certification shall meet the following conditions:
(1) Having a standardized name and organization;
(2) Having managers and inspectors with corresponding professional knowledge and skills;
(3) Having a workplace, working environment, instruments, equipment and facilities suitable for the quality inspection work it is engaged in;
(4) Having a perfect quality system;
(5) Being able to bear legal responsibilities independently. Article 12 An inspection institution applying for metrological certification shall submit a written application to the provincial market supervision and administration department, which shall make a decision on whether to accept or not within 15 days after receiving the application.
If it decides to accept the application for metrological certification, the provincial market supervision and management department shall organize the assessment and evaluation work within fifteen days from the date of acceptance; Those who pass the examination shall issue a certificate of measurement certification within fifteen days after the completion of the evaluation report; If the examination fails, it shall notify the applicant in writing and explain the reasons.
The provincial market supervision and management department shall announce to the public the name, inspection capacity range, inspection project range, number and validity period of the quality inspection institution that has passed the measurement certification. Thirteenth inspection standards, facilities and environmental conditions applicable to quality inspection institutions. Where there is a substantial change, it shall apply for metrological certification on the changed matters.
If a quality inspection institution issues notarized data and results to the society with new inspection capacity, it shall apply for metrological certification for the new inspection capacity. Fourteenth quality inspection institutions may set up representative offices, offices and other forms of branches to engage in publicity activities related to their quality inspection, but shall not engage in inspection activities that issue notarized data and results to the society. Fifteenth enterprises and institutions set up their own laboratories for scientific research, production and service, and only after obtaining the metrological certification certificate can they issue notarized data and results to the society. Article 16 If an inspection institution really needs to immediately carry out inspection activities without metrological certification due to public health, environmental pollution, safety accidents and other public emergencies or other circumstances, the provincial market supervision and management department may implement one-time metrological certification authorization. Seventeenth quality inspection institutions shall apply to the provincial market supervision and management department for review six months before the expiration of the validity period of the metrological certification certificate, and re-issue the certificate if the re-examination is qualified.
If the quality inspection institution fails to apply for re-inspection at the expiration of the validity period of the metrological certification certificate, the provincial market supervision and management department shall cancel its metrological certification certificate and recover the issued certificates, schedules, seals and signs.
