Regulations of Hangzhou Municipality on Home Care for the Aged

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Law of the People's Republic of China on the Protection of the Rights and Interests of the Elderly, the Regulations of Zhejiang Province on the Promotion of Social Pension Services and other laws and regulations in light of the actual situation of this Municipality in order to promote and standardize the development of home-based pension services, meet the needs of the elderly at home (hereinafter referred to as home-based elderly), improve the quality of life of the elderly, and promote the virtues of the Chinese nation in respecting the elderly. Article 2 These Regulations shall apply to the home-based aged care service and its supervision and management within the administrative area of this Municipality.

The term "home-based aged care service" as mentioned in these Regulations refers to the aged care service provided for the elderly at home, which is based on the family, supported by the community (village) and supported by the social security system, and composed of basic government services, professional services of enterprises, institutions and social organizations, grassroots mass autonomous organizations and volunteer public welfare services. Article 3 Home-based care for the aged should be guided by the service needs of the elderly at home, and adhere to the principles of government leadership, family responsibility, social participation, market operation, basic moderate universal benefit, voluntary choice and convenience nearby.

Home care services mainly include the following contents:

(1) Life services such as meal assistance, bath assistance, cleaning assistance, transportation assistance, agency, home appliance maintenance and pipeline dredging;

(2) Medical care services such as physical examination, medical treatment, nursing, rehabilitation, medication guidance, family sickbed, and hospice care;

(3) Safety guidance and emergency rescue services;

(4) Providing day care, short-term care and other services for the elderly, especially those with special difficulties;

(five) care and visit, life companionship, psychological counseling, emotional counseling and other spiritual comfort services;

(six) cultural entertainment, physical fitness and other services that are beneficial to the physical and mental health of the elderly;

(seven) legal advice, fraud education, notarization, people's mediation and other services. Article 4 Children of the elderly and other persons who have the obligation to support and support according to law shall fulfill their obligations of financial assistance, life care and spiritual comfort to the elderly and take care of their special needs.

Advocate the elderly to establish a civilized, healthy, positive and reasonable way of old-age consumption.

Advocate family members to live with the elderly or live nearby. Article 5 The Municipal People's Government shall make overall plans, guide and coordinate the work of home-based aged care services in the whole city, incorporate the guarantee of home-based aged care services for the elderly, especially those with special difficulties, into the dynamic monitoring index system, establish a financial overall planning and guarantee mechanism that is compatible with the aging population and the level of economic and social development, improve policies and measures, and guide and cultivate standardized aged care services.

District and county (city) people's governments shall perform the following duties:

(a) the home care service work into the regional national economic and social development plan and the government's annual work plan;

(two) to establish a financial security mechanism that is compatible with the aging population and the level of economic and social development;

(three) in accordance with the provisions of the overall planning and construction of home care services;

(four) to clarify the responsibilities of relevant departments for home care services, improve the working mechanism, and strengthen overall coordination, supervision and inspection;

(five) to cultivate the aged care service industry, and guide and support social forces to participate in the work of home-based aged care services;

(six) other home care services related work. Article 6 The civil affairs department is the competent department of home-based care services within its administrative area, and is responsible for the guidance, management and supervision of home-based care services.

The health and medical security departments are responsible for the health and medical security of the elderly living at home within their respective administrative areas, and implement and promote the combination of medical care and nursing.

Development and reform, finance, human resources and social security, planning and natural resources, urban and rural construction, education, science and technology, housing security and real estate management, public security, commerce, culture and tourism, finance, taxation, emergency management, market supervision and management, sports, urban management, judicial administration, data resource management and other departments shall, in accordance with their respective responsibilities, do a good job in home-based care services.

Trade unions, youth leagues, women's federations, disabled persons' federations, federations of industry and commerce, family planning associations and other people's organizations shall, within the scope of their respective functions and duties, assist in doing a good job in home care services. Seventh township (town) people's governments and sub-district offices shall perform the following duties:

(1) Integrate the resources of aged care services within its jurisdiction, coordinate the work of home-based aged care services, publicize and implement the policies of home-based aged care services, and promote the construction of a "quarter-hour" home-based aged care service circle;

(two) the construction of home care services and the introduction of professional institutions to operate, to play the role of regional home care services;

(three) to guide the residents' committees and villagers' committees to carry out home-based care services, and to explore and support new models of home-based care services;

(four) to guide and support enterprises, institutions, social organizations and individuals to participate in home care services, and to assist in the relevant supervision and management work;

(five) other duties stipulated by the people's government of the city, district and county (city). Eighth residents' committees and villagers' committees are responsible for the following work:

(1) Registering basic information such as the health status and family situation of the elderly at home, investigating the service needs of the elderly at home, collecting and processing the opinions and suggestions of residents and villagers on home-based care services, publicizing home-based care services policies, and providing home-based care services information;

(two) operation, maintenance and management of home care facilities, to assist the government to do a good job in home care services;

(three) to take home visits, telephone inquiries and other ways. , regularly visit the elderly who are lonely, live alone and have special difficulties at home, and make a record of the visit;

(four) to supervise the services provided by the home care service institutions, and report to the relevant departments of the township (town) people's government, street offices or civil affairs in a timely manner if any illegal situation is found;

(five) to assist in the establishment of grassroots associations for the elderly, social organizations involving the elderly, and volunteer service teams for the elderly, and to organize activities such as mutual assistance, recreation and sports, and volunteer service for the elderly;

(six) to educate and guide residents and villagers to fulfill their maintenance obligations according to law;

(seven) other home care services related work.
