Technology introduction and equipment import work provisional regulations for the implementation of the rules

Chapter I. General Provisions Article 1 The introduction of technology and equipment imports specifically include the following five areas.

1. from foreign enterprises to obtain production technology, equipment manufacturing technology and business management technology, including the purchase of designs, processes, formulas, equipment manufacturing drawings and technology, inspection methods and other technical information, import prototypes, hiring experts to guide, commissioned to train personnel and so on;

2. with foreign enterprises to design and manufacture products;

3. commissioned by foreign Commission foreign consulting firms or foreign enterprises to provide technical services;

4. Contracted by foreign enterprises or cooperate with foreign enterprises in resource exploration, engineering design;

5. Import of complete sets of equipment or key equipment.

All projects in line with the contents of the preceding paragraph, regardless of the source of foreign exchange funds and payment methods (foreign exchange, intergovernmental loans, loans from international financial organizations, foreign banks, buyer and seller credits, compensatory trade, product sales, etc.), and regardless of the repayment of foreign loans, regardless of the difference between (national unified repayment, local, enterprise repayment, etc.), are within the scope of the management of these rules.

The import of general machinery, motors, electrical appliances and instruments without the content of introduced technology does not fall within the scope of these regulations. Article 2 The purpose of introducing technology and importing equipment is to enhance China's self-reliance, raise the level of China's science and technology, and accelerate the realization of the four modernizations. Therefore, the import of complete sets of equipment must be strictly controlled, with emphasis on the introduction of technology in design, process and manufacture, and any equipment that can be supplied domestically must be arranged and settled domestically.

Projects must be proposed in line with the long-term planning and five-year plan for the development of meteorological services. Article III of the introduction of technology and equipment imports must be economic results, according to economic laws, and seriously do a good job of feasibility studies. The introduction of technology and imported equipment must be applicable, advanced, reliable, suitable for China's specific circumstances, in line with national technology and economic policy and energy policy; do not go beyond the current digestion and mastery of the ability to break away from China's labor force, the conditions of the large number of one-sided pursuit of the advanced and ignored the economic effects. Article IV of technology and equipment importation of each project must organize a special working group, the establishment of a strict system of responsibility, fully prepared to implement the conditions of cooperation in all aspects; from the investigation to the completion of the project abroad, the various stages of the work should be closely linked to the completion of the schedule. All capital construction projects must be strictly in accordance with the capital construction procedures. Chapter II Program Management Article 5 The long-term planning and annual plans for the introduction of technology and equipment imported by the National Bureau of Meteorology according to the comprehensive balance of the plan reported by the units, in accordance with the Ministry of Foreign Trade and Economic Cooperation and the State Planning Commission issued a unified form and requirements were reported. The project proposal is the basis for the project to carry out the preparatory work and arrange the relevant work and expenses in the annual plan. Project proposal reviewed and approved for inclusion in the annual plan, you can carry out feasibility studies for the purpose of the work, including research, study tours abroad, technical exchanges with foreign manufacturers and informal inquiries, preliminary negotiations, etc., but shall not be signed with the foreign manufacturers of any binding agreements or other documents.

The feasibility study of the project is a prerequisite for the establishment of this project. Only after the project feasibility study has been reviewed and approved can the project be formally contracted with the foreign manufacturer on the basis of it.

If the content is relatively simple and the conditions are mature, and if the total amount of foreign exchange used in the project is less than 3 million US dollars, with the consent of the examination and approval authority as stipulated in Article 7, the procedure can be simplified and the content of the feasibility study report can be simplified appropriately. Article 7 Where the project proposal and project feasibility study report for projects with a total foreign exchange consumption of more than 1 million US dollars, the National Meteorological Administration shall organize the preliminary examination and submit it to the Ministry of Foreign Trade and Economic Cooperation, the State Economic Commission and the State Planning Commission for approval.

The total amount of foreign exchange used in the project is less than 1 million U.S. dollars, the project proposal and the project feasibility study report by the State Bureau of Meteorology after the organization of the review and submit to the Ministry of Foreign Trade and Economic Cooperation, the State Economic Commission for approval.

Any project that is a capital construction project should be included in the plan and handled in accordance with the capital construction procedures.

Technologies requested to be introduced, including those introduced in the projects of complete sets of equipment, whether they are in line with the state's technological policy, whether they are applicable, advanced and reliable, as well as whether they are integrated with domestic scientific research, shall be reported by the State Bureau of Meteorology to the State Science and Technology Commission for examination. Chapter III Feasibility Study Article 8 The basic task of the feasibility study of technology introduction and equipment import projects is to carry out program planning, technical demonstration, economic accounting and analysis and comparison, to provide a reliable basis for decision-making and recommendations for the project. The main contents include:

1. address selection, equipment selection, equipment delivery and cooperation in manufacturing, supporting collaboration, technical force and environmental protection, consumption, materials, energy and other issues such as analysis and arrangements;

2. investment estimates and sources of funds;

3. technical and economic benefits of the analysis and evaluation. Article 9 The feasibility study must be carried out by the sponsoring unit of the project organizing a special working team. Responsible for the feasibility study of the composition of personnel, there must be economic and accounting personnel, scientific research, engineering and planning personnel; which involves the importation of equipment and subcontracting, should also be absorbed by the instrumentation management department to participate in the personnel.
