This is determined by the special nature, characteristics and tasks of revolutionary soldiers, and it is also the requirement of the interests of the motherland, people and socialism. Those who destroy military marriages should be severely punished according to law.

It is embodied in the following aspects:

(1) Whoever knowingly cohabites with or marries a serviceman shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention.

(2) Whoever rapes the wife of an active serviceman by coercion by taking advantage of his authority and affiliation shall be sentenced to fixed-term imprisonment of not less than three years but not more than five years. If the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not less than 10 years, life imprisonment or death.

(3) The conditions for the breakdown of military marriage are different from ordinary civil cases, and the punishment is more severe than other similar crimes, which fully embodies the particularity of military marriage protection.

(4) The spouse of an active serviceman needs the consent of the active serviceman. This is also stricter than similar situations. This legally guarantees the basic stability of military families and marriages.

(5) The special provisions of our laws are conducive to consolidating the army and national defense, and are also in line with the interests of the people of the whole country.

Distinguish between "families of revolutionary martyrs", "families of soldiers who died in the line of duty", "families of soldiers who died" and "families of soldiers in active service"

(l) "Family members of revolutionary martyrs" refers to family members who have obtained certificates of revolutionary martyrs issued by People's Republic of China (PRC) and the Ministry of Civil Affairs with the approval of the prescribed authorities.

(2) "Family members of soldiers who died in the line of duty" refers to family members who have obtained certificates of revolutionary soldiers who died in the line of duty with the approval of the prescribed authorities.

(3) "Family members of deceased soldiers" refers to the family members who have obtained the death certificate of revolutionary soldiers as determined by the prescribed authorities.

(4) "Family members of servicemen" refers to the family members of servicemen in accordance with the provisions of the Military Service Law of People's Republic of China (PRC).

"Soldiers have been raised by them since childhood, and now they have to rely on other family members of soldiers to live" refers to those whose parents lost their ability to raise soldiers from birth to 18, voluntarily or entrusted to raise soldiers for more than 7 years, who have been certified by the township (town) people's government or notarized according to law and approved by the people's governments of counties, cities and municipal districts. Persons other than relatives who meet the requirements of dependents shall also be treated as dependents.
