The health administrative department of the local people's government at or above the county level shall be responsible for the construction and management of health supervision institutions within its jurisdiction. Chapter II Organization Establishment and Personnel Management Article 8 Health supervision shall be managed at different levels. The health administrative departments of the central, provincial, city divided into districts and county-level people's governments shall set up health supervision institutions and health supervision execution institutions (hereinafter referred to as health supervision institutions) to be responsible for health supervision within their respective jurisdictions. Health supervision institutions at the county level may send health supervision personnel to towns and villages. Article 9 The staffing of health supervision institutions at all levels shall be scientifically and reasonably formulated according to the population, workload, service scope and economic level of the area under their jurisdiction. Article 10 A health supervisor shall meet the following conditions:
(1) Abide by laws and professional ethics;
(2) Having professional knowledge and legal knowledge related to health supervision;
(three) to accept the post training of health supervision and pass the examination;
(four) the newly hired personnel should have a college degree or above. Eleventh specific provisions of the qualification examination for health supervisors shall be formulated by the Ministry of Health and implemented by the provincial health administrative department.
Health supervision institutions at all levels shall employ corresponding professionals according to the supervision tasks, and constantly optimize the professional structure of the health supervision team. Article 12 The State implements a system of regular training and assessment for health supervision personnel.
Health supervision institutions at all levels should constantly improve the professional quality and political and ideological quality of health supervision personnel. Thirteenth national and provincial health supervision institutions should set up special personnel to supervise the health supervision work at lower levels, and their main tasks are:
1, supervision of major cases;
2, all kinds of special rectification, law enforcement inspection and supervision;
3, supervise and inspect the implementation of health laws and regulations;
4, check the law enforcement behavior of health supervision institutions and personnel at lower levels. Article 14 Health supervisors shall dress in accordance with state regulations when performing official duties. Fifteenth health supervision institutions at all levels should be equipped with relevant professional and technical personnel and conditions according to the needs of the work, and undertake the on-site inspection, law enforcement and evidence collection of health supervision. Sixteenth health supervision institutions at all levels should establish a law enforcement responsibility system, conscientiously perform their duties, so that the task is clear, the responsibility lies with the people, and carry out their duties to ensure the fairness and efficiency of health supervision. Seventeenth health supervision institutions at all levels shall establish and improve the rules and regulations and working procedures, and standardize the health supervision behavior; Improve the internal control mechanism, establish a rotation system for key positions and a law enforcement avoidance system; Open procedures and results, and accept social supervision; Strengthen service consciousness, protect and respect the legitimate rights and interests of the management counterpart. Chapter III Duties Article 18 Health administrative departments at all levels shall perform their duties of health supervision and management in accordance with the provisions of laws and regulations; Formulate relevant policies; Responsible for macro management, organization and coordination and information release of health supervision. Article 19 The main duties of health supervision are: to supervise and manage food, cosmetics, disinfection products, drinking water and products related to the health and safety of drinking water according to law; Supervise and manage public places, occupations, radiation and school health according to law; Supervise the prevention and control of infectious diseases according to law; Supervise the practice activities of medical institutions, blood collection and supply institutions and their employees according to law, rectify and standardize the medical service market, and crack down on illegal medical practice and illegal blood collection and supply; Undertake other duties as stipulated by laws and regulations.
Health supervision institutions at all levels shall undertake health supervision tasks under the leadership of the health administrative department at the same level. Twentieth health supervision institutions of the Ministry of Health shall be responsible for the national health supervision work, and its main responsibilities are:
(a) to formulate national health supervision policies and work plans, and formulate corresponding work systems and norms;
(two) to organize the implementation of national health supervision, guidance, supervision and inspection of local health supervision;
(three) to carry out law enforcement inspection and supervise the law enforcement behavior of local health supervision institutions and personnel;
(4) Organizing, coordinating, supervising and inspecting the investigation and handling of major cases;
(five) the organization of national health supervision and sampling;
(six) to undertake the work of health administrative licensing and qualification identification within the scope of duties according to law;
(seven) to be responsible for the collection and analysis of national health supervision information;
(eight) the organization of national health supervision personnel training;
(nine) to organize publicity and education of health laws and regulations;
(ten) to undertake health supervision matters designated or assigned by the Ministry of health.
