Measures of Kunming Municipality on Implementing People's Republic of China (PRC) Metrology Law

Chapter I General Provisions Article 1 In order to strengthen the supervision and administration of measurement, improve the legal system of measurement, ensure the unity of national measurement units and the accuracy and reliability of measurement values, and safeguard the interests of the state and the people, these measures are formulated in accordance with the provisions of the National Metrology Law of People's Republic of China (PRC) and its detailed rules for implementation, combined with the situation of our city. Article 2 All units and individuals that establish standards of measurement, conduct metrological verification, manufacture, repair, sell and use measuring instruments in our city shall abide by these measures. Chapter II Compulsory Verification Article 3 All measuring instruments used for trade settlement, safety protection, medical and health care, environmental monitoring, etc. Included in the "Detailed Catalogue of Measuring Instruments for Compulsory Verification in Kunming", compulsory verification shall be implemented. Article 4 The verification period and location of working measuring instruments subject to compulsory verification shall be stipulated by the municipal and county standards and metrology management departments. Article 5 Units and individuals that use the measuring instruments for compulsory verification shall register the measuring instruments for compulsory verification used by them, report them to the local county-level standard measurement management department for the record, and conduct periodic verification in accordance with the provisions of the standard measurement management department. At the same time, according to the need to set up full-time or part-time personnel to manage the working measuring instruments for compulsory verification, and establish the necessary rules and regulations.

Ensure the correct use of measuring instruments for compulsory verification. Sixth metrological verification institutions that perform compulsory verification tasks must be in accordance with the relevant provisions of the province, and they can undertake the compulsory verification tasks of working measuring instruments only after passing the examination by the local government standard measurement management department. Without the authorization of the standard measurement management department, this unit shall not undertake the compulsory verification task of the work meter. Chapter III Standard Instruments of Measurement and Verification of Measurement Article 7 The highest standard instruments of measurement established by enterprises and institutions in their own units can only be used after passing the examination by the standard measurement administrative department of the people's government at the same level in charge in accordance with the following conditions:

(1) Having passed the metrological verification;

(2) Having the environmental conditions required for normal work;

(3) Having qualified and competent personnel for storage, maintenance and use;

(4) Having a sound management system. Article 8 The metrological standards and working measuring instruments that are not subject to compulsory verification shall be periodically verified by the user or sent to an authorized metrological verification institution for verification. Measuring instruments that exceed the verification period or fail to pass the verification are not allowed to be used. Article 9 Enterprises and institutions that use non-compulsory verification of measuring instruments shall report their selected metrological verification departments and verification cycles to the standard metrological management department of the people's government at the same level for the record and accept supervision and inspection. Tenth metrological verification must be carried out in accordance with the metrological verification system table and metrological verification regulations stipulated by the state. Eleventh metrological verification personnel should be managed according to the Measures for the Administration of Metrology Personnel issued by the State Bureau of Metrology. Chapter IV Management of Measuring Instruments Article 12 Enterprises and institutions that manufacture or repair measuring instruments must have facilities, personnel and verification instruments and equipment suitable for the measuring instruments they manufacture or repair, and have passed the examination by the local administrative department of standards and metrology and obtained the License for Manufacturing Measuring Instruments or the License for Repairing Measuring Instruments. Thirteenth applications for "license for manufacturing measuring instruments" or "license for repairing measuring instruments" shall be assessed in accordance with the "Measures for the Administration of Licenses for Manufacturing and Repairing Measuring Instruments" issued by the State Bureau of Metrology. Fourteenth imported measuring instruments must apply to the Provincial Bureau of Standards and Metrology for verification, and can only be sold after passing the verification. Fifteenth no product certificate and "license for manufacturing measuring instruments" or unqualified measuring instruments shall not be sold. Article 16 It is forbidden to sell defective spare parts of measuring instruments, and it is forbidden to assemble and repair measuring instruments with defective spare parts. Seventeenth measuring instruments without qualified seal (certificate), beyond the verification period or unqualified verification are not allowed to be used. Eighteenth individual industrial and commercial households can manufacture and repair simple measuring instruments according to the provisions of the state, but they must engage in business at a fixed site. The License for Manufacturing Measuring Instruments and the License for Repairing Measuring Instruments are only valid in the approved business premises. Article 19 Any unit or individual is prohibited from destroying or changing the accuracy of measuring instruments and deceiving consumers with false data. Twentieth prohibit the production of measuring instruments that are not legal units of measurement. Chapter V Supervision of Metrology Article 21 The administrative departments of standard metrology of counties and district governments shall be responsible for the supervision and management of metrological work within their respective administrative areas. Twenty-second enterprises and institutions should establish and improve the measurement institutions according to the needs, and uniformly manage the measurement work of their own units. Twenty-third the competent departments of enterprises and institutions should strengthen the leadership of the measurement work of their subordinate enterprises and institutions, and urge them to conscientiously implement the relevant measurement laws and regulations. Twenty-fourth units and inspectors who independently verify the measurement standards and working environment must be approved by the standard measurement management department of the people's government at the same level as the competent department before they can undertake the verification work of non-compulsory verification of measuring instruments. Twenty-fifth metrological verification institutions that undertake verification and testing tasks must be authorized by the administrative department of standards and metrology of the local people's governments at or above the county level. Twenty-sixth product quality inspection institutions that issue fair data to the society can issue inspection data only after their laboratory equipment, working environment and personnel have passed the examination by the Provincial Bureau of Standards and Metrology.
